Zhou Moumou was born in Sichuan, went to Shanghai at the age of 6 to attend primary school, and then transferred back to Sichuan to attend junior high school and high school. "All the parents' meetings in the study stage are attended by me, and I accompany me when I am sick." Wang Moumou said. When he was in junior high school, his son was obsessed with playing game consoles, and he did not trust his son's learning, and he retired from home early to take care of his son's life. After that, the son was finally admitted to college, but after entering the university, his son looked down on his mother, who only had a Chinese.

In 2002, Wang Moumou was willing to suffer hardships for his son's move of hukou to Shanghai. After his son went to work in Shanghai, he often brought him food to increase his nutrition. But What hurt Wang's heart was that in 2010, at his son's home in Shanghai, Wang personally heard his son yelling at his father: "Dad, don't pay attention to this beast." Wang Moumou was frightened and stupid. But in the face of his son's yelling, his father did not block education even if he was present.

Wang Moumou believes that he is old and his son should assume the obligation of support. To this end, she sued the court, asking her son Zhou xxx to pay alimony of 1,000 yuan per month; to talk to herself on the phone once a week and visit herself once a month (in the trial, it was changed to: once a week to talk to the plaintiff on the phone, and once a year on New Year's Day, Spring Festival, Labor Day, Dragon Boat Festival, Mid-Autumn Festival, and National Day); the litigation costs in this case were borne by defendant Zhou XX.

During the trial, his son Zhou X claimed that the plaintiff Wang X was the most vicious person he had encountered in his life, and he was also the person who hurt him the most. "People are always responsible for what they have done, and I have the right not to forgive people who have hurt themselves so much." Mr. Zhou agreed to give the plaintiff 1,000 yuan in monthly alimony, but did not agree to visit the plaintiff on the phone once a week and on holidays. Because I have stopped talking to Wang Moumou since I was 12 years old, it has been 30 years now.

Court: Relationships that have deteriorated for a long time are not grounds for refusing maintenance

The evidence shows that the plaintiff, Mr. Wang, is a disabled person, lives alone in Yangpu District of this city, and has now retired, with a monthly retirement salary of more than 3,000 yuan. Defendant Zhou and his father reside in Jiuting Town, Songjiang District, Shanghai, are freelancers, have no fixed job, are divorced and single, and must pay their daughter 3,000 yuan per month for living expenses.

After trial, the court held that the child had an obligation to support his parents. The breadwinner shall fulfill the obligation of providing economic support, daily care and spiritual comfort to the elderly.

First of all, in terms of material support, the plaintiff asked the defendant to pay alimony of 1,000 yuan per month, and the defendant agreed, so the plaintiff's claim was upheld by the court. Secondly, in terms of spiritual comfort, children should give their parents more spiritual care than material support.

It is undeniable that the relationship between the plaintiff and the defendant in this case has deteriorated for a long time, but this is not the reason for the defendant's refusal to perform the maintenance obligation. The plaintiff is now 73 years old, currently living alone, no longer in good health, and has a stronger need for spiritual understanding, respect, care and consideration for his children. It is sincerely hoped that the defendant can put aside his past grievances, think more about the plaintiff's kindness, think more about the opportunity to fulfill his filial piety, and avoid the regret of "the son wants to raise but does not wait". At the same time, it is also hoped that the plaintiff will pay attention to the way of communication in handling the relationship between the two parties, strive to resolve the defendant's long-standing knot, and improve mutual affection. The plaintiff's claim for regular phone calls and visits by the defendant was well founded and ethical, and the court upheld it.

In summary, the court ordered defendant Zhou xxx to pay plaintiff Wang xxx alimony of 1,000 yuan before the end of each month; defendant Zhou xxx called plaintiff Wang xx once a week on the effective date of this judgment, and visited plaintiff Wang xx once a week on New Year's Day, Spring Festival, Labor Day, Dragon Boat Festival, Mid-Autumn Festival, and National Day. If the obligation to pay money is not performed within the period specified in this judgment, the interest on the debt during the period of delayed performance shall be doubled in accordance with the provisions of the Civil Procedure Law of the People's Republic of China. The case acceptance fee of 10 yuan is borne by the defendant Zhou X.
