On September 11, the Liaocheng Intermediate People's Court publicly pronounced a verdict in accordance with law on the case of Xu Yuheng, former director of the Liaocheng City Land and Resources Bureau and secretary of the party leading group, for accepting bribes and abusing his power. Defendant Xu Yuheng was convicted of accepting bribes and abusing his power and was sentenced to eight years' imprisonment and fined RMB400,000. Recently, the criminal judgment released by the Liaocheng Intermediate People's Court disclosed more details of the case.

According to the judgment, between 2009 and 2014, defendant Xu Yuheng took advantage of his position as director of the Liaocheng Land and Resources Bureau and secretary of the party leading group to provide assistance to Liaocheng Zhongganglian Metal Manufacturing Co., Ltd., Shandong MCC Petroleum Machinery Co., Ltd., and Liaocheng Beidou Automobile Investment Management Co., Ltd. in handling land formalities, and accepted a total of RMB 2.6 million in cash from the actual controllers of the above-mentioned companies, Yan X, Sun X1 and Shang X.

Among them, between the second half of 2009 and November 2010, defendant Xu Yuheng took advantage of his position as director of the Liaocheng Land and Resources Bureau and secretary of the party leading group to seek benefits for Liaocheng Zhongganglian Metal Manufacturing Co., Ltd. in handling land use rights procedures, and accepted RMB 900,000 in cash from Yan Mou, the chairman of the company, on two separate occasions.

From before the Spring Festival in 2010 to November 2013, defendant Xu Yuheng took advantage of his position as director of the Liaocheng Land and Resources Bureau and secretary of the party leading group to seek benefits for Shandong MCC Petroleum Machinery Co., Ltd. in handling land use rights procedures, and accepted RMB 500,000 in cash from the company's chairman Sun Mou1 on two separate occasions.

In May 2011, defendant Xu Yuheng took advantage of his position as director of the Liaocheng Land and Resources Bureau and secretary of the party leading group to seek benefits for Liaocheng Beidou Automobile Investment Management Co., Ltd. in handling land use rights formalities and late payment of land transfer fees. In May 2014, Xu Yuheng accepted RMB1.2 million in cash from Shang Mou, a shareholder of the company, in two installments in the name of borrowing.

The facts of abuse of power include that, in January 2010, defendant Xu Yuheng, as director of the Liaocheng City Land and Resources Bureau and secretary of the party leading group, violated the Provisions of the Interim Measures for the Management of State-owned Assets of Administrative Units and the Measures for the Management of State-owned Assets of Administrative Institutions in Shandong Province, and decided to dispose of a case of industrial land and factory building located in the Liaocheng Economic Development Zone under the name of Liaocheng Baokun Xinjian'an Engineering Co., Ltd., a subsidiary of the Municipal Land and Land Bureau, without examination and approval, assessment and other procedures, knowing that the actual appraised price of the land was known. Shandong Huanpai Food Co., Ltd., the buyer who was the responsible person of Qin, did not require him to pay the difference in land price, resulting in a loss of 1,416,959.78 yuan in state-owned assets.

Between 2011 and 2013, defendant Xu Yuheng, as the director of the Liaocheng City Land and Resources Bureau and secretary of the party leading group, helped Liaocheng Hanbo Real Estate Co., Ltd., which was funded by Shang, to acquire the right to use the land located in Dong'a County by way of transfer, and after Xu Yuheng's confession, he took a stake in Hanbo Company in the name of Zhang. Later, Xu Yuheng and Shang transferred the land to Li Mou, the son of Li Mou, the former chairman of Liaocheng Mengda Jian'an Development Group Co., Ltd., by concealing the nature of the land and promising to help coordinate with the relevant government departments in the future development process. Later, Xu Yuheng used his position to help Li coordinate the change of land planning use in order to realize his personal interests, and knowing that according to the Land Administration Law and other laws and regulations, the change of land use should be paid in return, and did not supervise the former Dong'a County Land and Resources Bureau to recover the land transfer fee in accordance with the regulations, resulting in a loss of 22.6566 million yuan in the state land transfer fee.

It was also ascertained that after the defendant Xu Yuheng arrived at the case, he truthfully confessed all the facts of his crime of accepting bribes and the facts of the first crime of abuse of power charged by the prosecution, voluntarily confessed the facts of the second crime of abuse of power that the investigation organs did not yet have, and his relatives and friends returned all the bribes on his behalf of 2.6 million yuan and paid a fine of 400,000 yuan in advance. Before the judgment of this case was pronounced, the relatives and friends of defendant Xu Yuheng returned to the economic losses caused by defendant Xu Yuheng's abuse of power of 24,073,559.78 yuan, and the economic losses caused by defendant Xu Yuheng's abuse of power alleged in this case have all been recovered.
