Case 1
On January 25, 2024, in Dazhou, Sichuan, Deng Moumou and his companions went to a furniture warehouse in Tongchuan District that was about to be demolished to buy scrap iron.
The Tongchuan District Fire and Rescue Brigade, together with the police station in the jurisdiction, investigated and handled the case of the fire caused by negligence, and imposed a penalty of 10 days of administrative detention on Deng in accordance with the law, and imposed an administrative fine on the furniture company.
Case 2
Mr. Zhang is the legal representative of a textile limited company in Pingyi County, and Mr. Li is the maintenance worker of the company. On March 23, 2023, without obtaining the welding operation certificate, Li carried out electric welding operations on the east side of the warehouse, without taking any protective measures on the site, and the high-temperature welding slag of the electric welding operation ignited the surrounding combustibles and caused a fire, and the direct property loss of the fire was about 6.96 million yuan.
In the process of fire accident investigation, the fire rescue agency found that Zhang, the legal representative of the unit, and Li, a maintenance worker, were suspected of major liability accidents, and transferred them to the public security organs in accordance with the law. On March 15, 2024, the court sentenced Zhang, the legal representative of the unit, to one year in prison and nine months in prison to Li, an illegal operator, for the crime of major liability accidents.
Case 3
At about 8:46 on February 14, 2023, a fire broke out in the 3-1 venue of Kunming International Trade Old Hall, Guandu District, Kunming City, Yunnan Province, when organizing the demolition of old objects. After on-site inspection and investigation, comprehensive analysis determined that the cause of the fire was: during the demolition of the site, Chen (the project contractor) instructed Wang (the oxygen welding operator) to use oxygen welding to cut and dismantle the exhaust pipe at high altitude, and the welding slag fell and ignited the old sofa directly below the exhaust pipe, which eventually spread and expanded into a disaster.
After investigation, Wang did not obtain the welder's operation qualification, and no corresponding fire prevention measures were taken in the operation area during the operation. Chen and Wang's behavior violated the provisions of paragraphs 1 and 2 of Article 64 of the Fire Protection Law of the People's Republic of China. For this reason, Chen and Wang were administratively detained for 10 days.

Article 21 of the Fire Protection Law of the People's Republic of China stipulates that smoking and using open flames in places with fire and explosion hazards are prohibited. If it is necessary to use open flame operation due to special circumstances such as construction, the approval procedures shall be handled in advance in accordance with the regulations, and corresponding fire safety measures shall be taken; Operators shall comply with fire safety regulations. The Fire Protection Law of the People's Republic of China sets out clear requirements for the legal obligations of operators and persons in charge of premises.
