The reporter later received a reply from Xi'an Sports University that Xi'an Sports Institute signed an agreement with Wukang University in Spain in January 2021 for a joint doctoral program (doctoral degree awarded by the University of Physical Education). After the preliminary investigation of the project, it was confirmed that Wukang University is in the list of foreign-related supervision network recognized by the Ministry of Education of China, and is a school certified by the Ministry of Education of China. The Chinese Embassy in Spain issued a certificate of accreditation of Wukang University. Wukang University issued a letter of authorization for the legal cooperation of Huang Moufang, a partner of Wukang University Xi'an Office (Xi'an Wukang Cultural Exchange Co., Ltd.). In January 2021, Xi'an Sports Institute signed a cooperation agreement with Wukang University, which was reviewed by the legal counsel of Xi'an Sports Institute. "Sports" turned into "philosophy", and the students had no choice but to cooperate, hoping to get a degree smoothly.
All 28 students in the third phase were stranded
Xiaoqiang introduced that the incident has many twists and turns, and June 2023 is the time for the first batch of students to go abroad for classes, and everyone is waiting and seeing.
As a rule of thumb, student visas need to be processed months in advance, but they have not received any information about how to apply for a visa. I went to ask the person in charge of Xi'an Sports Institute and Wukang University in Xi'an, and the news I got was to continue to wait. Until October 2023, the second cohort of students was supposed to go abroad, but they still did not receive any official notice.
What is the reason why the two groups of students were unable to study abroad normally? At this time, the responsible persons of the Xi'an Sports Institute and Wukang University began to push each other. The person in charge of Xi'an of Wukang University said that this matter was directly connected by the Xi'an Sports Institute and the International Exchange Office of Wukang University, and the Xi'an Sports Institute said that this was recruited by the Xi'an Office of Wukang University.
So far, all the 28 people studying abroad in the third phase have been stranded.
The cultural exchange company has been listed as operating abnormally
Under the feedback and inquiry of students and parents, Xi'an Sports Institute entrusted a third party to send a letter of solicitation of opinions. In the comment letter, the student was told that there were three directions to choose: one is to get a refund, the second is to transfer the student to a partner school in Thailand, and the third is to continue to study at Vu Kham University.
Xiaoqiang said that it seems that there are options, but in fact, they can't get through. Under the continuous questioning of the students, some teachers privately said that the refund may take a long time, if the transfer to the Thai school needs to do credit certification, the other school will not accept it is still a problem, if you continue to study at Wukang University, you will have to re-register for another three years.
On March 11 this year, after many times of communication with the leaders of Xi'an Sports Institute to no avail, the students reported to the market supervision and administration bureau of the jurisdiction. The Market Supervision and Administration Bureau responded that Xi'an Wukang Cultural Exchange Co., Ltd. has been empty.
The reporter found through Tianyan that Xi'an Wukang Cultural Exchange Co., Ltd. was established in 2017 and is an enterprise mainly engaged in education. The registered capital of the enterprise is 200,000. It shows that shareholders Li Mouyun and Huang Moufang, Huang Moufang is the general manager. According to the administrative license, on July 14, 2021, the company's business scope was changed to general projects: self-funded study abroad intermediary services, education consulting services.
As early as May 7, 2021, the company contacted Xi'an Sports Institute and Wukang University to hold the first joint training conference, and when they implemented the organization of studying abroad, they did not obtain the right to operate study abroad intermediary services from relevant government departments.
On March 27 this year, the company was listed as abnormal by the Market Supervision and Administration Bureau of Yanta District, Xi'an City. Reason: It is not possible to contact through the registered residence or place of business.
The reason for the stranding of the project is a change in policy and a change in personnel
According to the Xi'an Sports Institute, the project has been stranded, mainly due to changes in Spain's national education policy. As a result of Spain's reform of the awarding of diplomas by universities, the awarding of diplomas is not included in the agreement between the mainland and the Government of the Kingdom of Spain on the mutual recognition of academic degrees. After learning the news, the International Exchange Center of Xi'an Sports Institute quickly contacted Wukang University to discuss the problem.
In December 2022, the two sides reached a preliminary consensus: Wukang University recognized the transfer of students who have reached the official PHD English requirements among the doctoral students of the Xi'an Sports Institute-Wukang Joint Training Program, and Wukang University issued a notice of conversion of academic programs for eligible students. Since then, the International Exchange Center of Xi'an Sports Institute has been constantly contacting and hoping to formally sign the project conversion agreement, but Wukang University has delayed it for various reasons.
In October 2023, the overseas director of Wukang University was changed to the head of Wukang University (Beijing). The person in charge said that the Xi'an Sports Institute-Wukang joint doctoral program can only award doctoral short-term courses in accordance with the original agreement, and cannot be transferred to official courses, and the issue of academic certification is force majeure, and they refuse to be responsible. For existing program students, they can only reapply for a government PhD (a new three-year program) or get a refund.
In mid-November 2023, the person in charge of Wukang University (Beijing) sent a "Notice of Termination of the Entrustment Relationship with Huang Moufang" to Xi'an Sports Institute, and claimed that he was no longer responsible for other relief solutions for students related to the project, and could only reapply for an official doctorate (a three-year new program) or refund the fee for the student.
Since October 2023, Wukang University's Xi'an office has closed its office space in Xi'an and refused to meet with students.
At this point, things have reached a dead end.
5.72 million fees were collected by intermediary companies
Because the study abroad program was stranded, and the affected students were distributed in various places, the Huashang Daily Gale News reporter learned after an interview that the cost of the project was collected by Xi'an Wukang Cultural Exchange Co., Ltd., and Xi'an Sports Institute and Wukang University did not intervene. The project recruits students in three phases, with a total of 28 students (including 8 faculty members of Xi'an Sports Institute). The Xi'an Office of Wukang University collected a total of 5.72 million yuan in tuition and miscellaneous fees, of which 8 people from Xi'an Sports Institute paid 190,000 yuan/person, and 20 people from outside the school paid 210,000 yuan/person.
The reporter learned through an internal document that Xi'an Wukang Cultural Exchange Co., Ltd., where Huang Moufang works, paid a total of 830,000 yuan in training fees for Xi'an Sports Institute three times on June 18, 2021, May 31, 2022, and June 30, 2022. At present, the total expenditure is 562,496.32 yuan, and the balance is 267,503.68 yuan (the main expenditure items: guidance fees, printing fees, opening defense evaluation fees, tutor labor fees, etc.).
In the interview, a staff member of the Xi'an Sports Institute introduced that they did not directly charge students' fees, and a large part of the nearly 6 million tuition fees were in the intermediary company. Now the project is stranded and the intermediary company cannot be contacted, which has brought a great negative impact to the Xi'an Sports Institute. Millions of dollars in tuition fees, all collected by an intermediary company, are inherently very risky. In early April, a reporter from Huashang Daily Gale News called Huang Moufang, the head of Xi'an Wukang Cultural Exchange Co., Ltd. and Wukang University's Xi'an Office, many times, but no one answered, and there was no reply to the text message.
According to the staff of the Beijing office of Wukang University, they are responsible for the relevant affairs of Wukang University in China, and there is no charge for promotion and docking affairs. For academic qualifications, one is officially recognized and the other is recognized by the university, and the Beijing office is only responsible for officially recognized academic qualifications. Huang's Xi'an Wukang Cultural Exchange Co., Ltd. is an intermediary company, and it is unclear what fees are charged and how they are used. The person in charge of the matter at the time resigned and returned to China last year.
Lawyer: Students may choose to pursue accountability from Seibu Culture
Xiong Ruonan, a foreign-related lawyer at Kangda (Xi'an) Law Firm, said that it should be clarified that the "school-awarded sports science doctorate certificate" agreed in the cooperation agreement between Xi'an Sports Institute and Wukang refers to PHD or short-term course certificate. The so-called short-term courses are generally income-generating projects of the school, which can be set up according to market demand, and cannot be registered or issued diploma certificates, and only short-term course certificates can be issued after graduation.
The actions of Xi'an Wukang Cultural Exchange Co., Ltd. may constitute apparent agency, and the students involved in the case may demand that Wukang University or Xibu Culture bear the corresponding responsibility. The authorization letter issued by Wukang University only authorized Huang Moufang for the project involved in the case, and Xiwu Culture also collected the fees of the project involved in the case on behalf of Wukang University, and paid the training fee to Xi'an Sports Institute three times. According to article 172 of the Civil Code, if the actor does not have the power of agency, exceeds the power of agency, or after the power of agency is terminated, but still carries out the act of agency, and the counterpart has reason to believe that the actor has the power of agency, the act of agency is valid. Therefore, although Wukang University did not receive the student's tuition fees, as long as the student involved in the case can prove that he has legitimate grounds to believe that Seibu Culture has the right of agency, Seibu Culture's conduct constitutes apparent agency. Students can pursue responsibility against Seibu Culture or against the person being represented, but they can only choose one of the two.
