Announcement of land requisition compensation and resettlement plan

Shanghai (Gold) Land Requisition Supplement [2024] No. 46

In accordance with the "Land Management Law of the People's Republic of China", "Regulations on the Implementation of the Land Management Law of the People's Republic of China" and other relevant provisions, in accordance with the "Pre-announcement of Land Expropriation" (Hujin Pre-Land Requisition Notice [2024] No. 9) and the current situation of the ownership, land type, area and ownership, type and quantity of above-ground attachments to be acquired, the People's Government of Jinshan District organized relevant departments to formulate the "Land Acquisition Compensation and Resettlement Plan", and the relevant matters are hereby announced as follows:

1. The scope of the land to be expropriated this time:

The second villager group of Baowei Village, Tinglin Town, Jinshan District, the third villager group of Baowei Village, Tinglin Town, Jinshan District, the second villager group of Luyan Village, the eighth villager group of Sangyuan Village, the ninth villager group of Sangyuan Village, and the sixth villager group of Sangyuan Village (village team); 51,270.37 square meters of agricultural land, 315.51 square meters of construction land, and 10,946.19 square meters of unused land are to be expropriated, with a total area of 62,532.07 square meters.

2. Compensation standards, payment objects and payment methods for land compensation fees:

The standard of land compensation fee shall be implemented in accordance with the "Shanghai Land Acquisition Land Compensation Standard (2024)" (Shanghai Planning and Resources Gui [2023] No. 6), the standard is 126.15 yuan/square meter, and the compensation fee is paid to the rural collective economic organization to be acquired, and the payment method is transfer.

3. Compensation standards, payment objects and payment methods for above-ground attachments and seedlings:

The compensation standard for above-ground attachments shall be implemented in accordance with the Shanghai Municipal Land Acquisition Property Compensation Standard (2024) (Shanghai Planning and Resources Gui [2023] No. 6), and the compensation fee shall be paid to the owner by transfer.

The compensation standard for green seedlings shall be implemented in accordance with the "Shanghai Land Acquisition Compensation Standard for Green Seedlings (2024)" (Shanghai Planning Resources Gui [2023] No. 6), the standard is 4.95 yuan/square meter for grain and cotton land, and 8.7 yuan/square meter for vegetable land, and the compensation fee is paid to the owner, and the payment method is transfer.

5. If the compensation for residential houses and non-residential houses (co-organized enterprises) is involved within the scope of land acquisition, please refer to the Announcement on the Compensation Plan for Land Acquisition Houses for details.

6. After the promulgation of the "Pre-announcement on Land Expropriation", if the property status changes without legal reasons, the land acquisition compensation registration shall not be handled for the changed property.

7. If the rural collective economic organizations, rural villagers or other rights holders who intend to acquire land have different opinions on the content of this announcement, please submit written comments within 30 days from the date of the announcement, that is, before May 16, 2024, and send them to the Jinshan District Planning and Natural Resources Bureau. If it is not submitted within the time limit, it will be regarded as no opinion.

If the majority of the members of the rural collective economic organization believe that this plan does not comply with the provisions of laws and regulations, and clearly point out in the written opinion, the Jinshan District People's Government shall organize a hearing.

8. After soliciting opinions on the "Land Acquisition Compensation and Resettlement Plan", the Jinshan District Planning and Natural Resources Bureau shall organize and implement the follow-up work after being confirmed by the Jinshan District People's Government.
