The Chongqing Municipal Bureau of Science and Technology recently issued the "Notice on Carrying out the Application for the Identification of High-tech Enterprises in 2024", and the relevant matters related to the identification and declaration of high-tech enterprises in Chongqing in 2024 are notified as follows:
1. Scope of declaration
Resident enterprises registered within the administrative area of Chongqing Municipality and in the "High-tech Fields Supported by the State".
Sole proprietorship enterprises and partnership enterprises are not included in the scope of declaration.
Organization of work
(1) The time of declaration
The first batch of declaration time: March 29, 2024 - May 13, 2024, the recommended time of the district and county is before 12:00 on May 31, 2024.
The second batch of declaration time: June 1, 2024 - July 31, 2024, and the recommended time for districts and counties is before 12:00 on August 16, 2024.
The third batch of declaration time: August 1, 2024 - September 6, 2024, the recommended time of the district and county is before 12:00 on September 20, 2024.
(2) Change of the name of the high-tech enterprise
Submission time: April 5 - April 30, 2024
(1) If the name of the high-tech enterprise recognized in 2021 changes, the name change procedure must be completed before applying for recognition again in 2024. If the name change procedures are not completed in advance, it will not be possible to submit the application materials for the recognition of high-tech enterprises online.
(2) If the enterprise changes its name after submitting the application materials for the recognition of high-tech enterprises, it shall go through the procedures for changing its name after it is recognized as a high-tech enterprise (see Annex 1 for the specific handling procedures and application materials).
3. Application conditions
Enterprises should conduct self-evaluation in accordance with the Identification Measures and Work Guidelines, and need to meet the following conditions at the same time:
(1) When applying for recognition, the enterprise must be registered and established for more than one year.
(2) The enterprise obtains the ownership of the intellectual property rights that play a core supporting role in the technology of its main products (services) through independent research and development, transfer, donation, merger and acquisition, etc.
(3) The technologies that play a core supporting role in the main products (services) of the enterprise fall within the scope of the provisions of the "High-tech Fields Supported by the State".
(4) The proportion of scientific and technological personnel engaged in R&D and related technological innovation activities in the total number of employees of the enterprise in the current year shall not be less than 10%.
(5) The proportion of the total R&D expenses of the enterprise in the past three fiscal years (the actual operating period is less than three years shall be calculated according to the actual operating time, the same below) to the total sales revenue of the same period meets the following requirements:
1. Enterprises with sales revenue of less than 50 million yuan (inclusive) in the latest year, the proportion shall not be less than 5%;
2. Enterprises with sales revenue of 50 million yuan to 200 million yuan (inclusive) in the latest year, the proportion shall not be less than 4%;
3. The proportion of enterprises with sales revenue of more than 200 million yuan in the latest year shall not be less than 3%, of which the total R&D expenses incurred by enterprises in China shall not be less than 60% of the total R&D expenses.
(6) The proportion of high-tech products (services) revenue in the total income of enterprises in the same period shall not be less than 60%.
(7) The evaluation of the enterprise's innovation ability should meet the corresponding requirements.
(8) The enterprise has not had any major safety or quality accidents or serious environmental violations within one year prior to the application for recognition.
Fourth, the application materials
(1) Implement a notification and pledge system.
The applicant enterprise shall refer to the notice of the Ministry of Science and Technology on the implementation of the notification and commitment system for the certification matters related to the identification of high-tech enterprises (Guo Ke Fa Huo [2021] No. 362) (Annex 2), and provide other supporting materials required for relevant matters as required.
(2) The following written materials shall be submitted for enterprise identification.
(1) Letter of Commitment to Inform and Confirm Matters (printed, signed, and stamped with official seal).
(2) Application for Recognition of High-tech Enterprises (printed and signed online and stamped with official seal).
(3) A copy of the "Business License" and other relevant registration certificates established by the enterprise in accordance with the law.
(4) Intellectual property related materials (the full text of the intellectual property certificate and the proof materials reflecting the technical level, participation in the formulation of standards, etc.), the certificate of scientific research project establishment (the acceptance or completion report of the accepted or completed project shall be attached), the transformation of scientific and technological achievements (the overall situation and the transformation form, the application effect of the item-by-item description), research and development organization and management (the overall situation and the specific description of the compliance with the four indicators) and other related materials.
(5) The specific description of the key technologies and technical indicators of the enterprise's high-tech products (services), relevant production approvals, certification and qualification certificates, product quality inspection reports and other materials.
(6) Explanatory materials for employees and scientific and technological personnel of the enterprise, including the number of on-the-job, part-time and temporary employees, the educational structure of personnel, the list of scientific and technological personnel and their positions, etc.
(7) The research and development expenses in the past three fiscal years (if the actual life is less than three years, the same below) research and development expenses and the special audit or assurance report on the income of high-tech products (services) in the past fiscal year issued by the intermediary institutions that are qualified and meet the relevant conditions of the "Work Guidelines", and attach explanatory materials for research and development activities.
(8) The financial and accounting reports (including accounting statements, notes to accounting statements and financial fact sheets) of the enterprise for the past three fiscal years certified by qualified intermediaries.
(9) Annual tax return of enterprise income tax for the past three fiscal years (including the main table and the attached table).
本年度申报中,前述(7)(8)(9)所提的"近三个会计年度"指2021年度、2022年度、2023年度,"近一个会计年度"指2023年度。
5. Application process
(1) Online declaration. Enterprises log in to the "High-tech Enterprise Identification Management Network" (www.innocom.gov.cn), enter the enterprise declaration window to fill in and submit the application materials online.
(2) Submission of materials. Before the deadline specified in the batch of reports, the enterprise shall submit a copy of the written declaration materials (the special audit report or assurance report must have the original copy of the anti-counterfeiting identification code and fresh seal that can be queried through the industry website) to the administrative department of science and technology of the district (county) where it is located.
If the enterprise belongs to the scope of the state-level development zone, the written application materials shall be submitted to the science and technology department of the management committee of the state-level development zone.
(3) District and county preliminary examination. The science and technology department, together with the finance and taxation departments at the same level, shall accept the application materials in a timely manner, and conduct a preliminary review of the enterprise qualifications, the completeness of the application materials, the special audit report or assurance report, the financial accounting report and the conditions of the intermediary agency. If necessary, on-site inspections can be conducted.
(4) District and county recommendations. For enterprises that meet the conditions of high-tech enterprises in the preliminary examination, the science and technology department that accepts the application materials will jointly issue a letter of recommendation (Annex 3) with the financial and taxation departments at the same level, and submit the recommendation letter and the paper copy of the enterprise application materials to the office of the municipal high-tech enterprise identification management agency (Municipal Science and Technology Bureau, address: Productivity Building, No. 2 Xinli Avenue, Yubei District; contact number: 67788354, 67300549).
(5) Organize reviews. After accepting the materials, the Municipal High-tech Enterprise Identification Office will organize experts in a timely manner to conduct a centralized online evaluation review.
(6) On-site spot checks. For the enterprises that have passed the expert review, the Municipal High-tech Enterprise Identification Office will screen the list of random inspection enterprises according to a certain proportion and conduct on-site inspections.
(7) Designation and reporting. Enterprises that have passed the expert review and on-site spot checks shall immediately go through the identification and filing procedures in accordance with the regulations.
6. Precautions
(1) The special report (special audit report or assurance report) in the application materials shall be issued by the enterprise itself to select and determine the intermediary agency (the report issued by the intermediary agency that does not meet the conditions shall be deemed invalid), and the "Letter of Commitment" stamped by the intermediary agency shall be issued in the submitted materials, and the enterprise may consult with the competent unit that issued the intermediary qualification certificate locally. The Work Guidelines stipulate that intermediaries are required to meet the following conditions:
(1) Have independent practice qualifications, established for more than three years, and have no bad records in the past three years.
(2) The proportion of the number of certified public accountants or tax agents in the year of undertaking the certification work shall not be less than 30% of the annual average monthly number of employees, and the average monthly number of employees shall be more than 20 throughout the year.
(3) Relevant personnel should have good professional ethics, understand the national science and technology, economic and industrial policies, and be familiar with the relevant requirements for the identification of high-tech enterprises.
(2) Please refer to the "Reference Template for the General Catalogue of Application Materials for High-tech Enterprises" (Annex 4) to arrange and bind the application materials one by one, and compile the page numbers against the general catalog. The required supporting documents should correspond to the contents of the application form, and in principle, it is sufficient to be able to prove the relevant matters. If the supporting materials are photocopies, they should be stamped with the official seal.
Enterprises should arrange and bind the application materials, please contact the local science and technology administrative department to receive free guidance and services.
(3) Enterprises involved in secrets should declassify the application materials to ensure the security of confidential information.
(4) Once the application materials are submitted, they will not be returned. If the data of the application materials submitted online and the application materials submitted on paper are not the same, or if there are only online or paper materials, it will be regarded as invalid materials.
After the enterprise submits the paper materials, it can fill in the storage information of the science and technology enterprise from the "science and technology enterprise management system" of the portal website of the Municipal Science and Technology Bureau, so as to enjoy the support policies to support the innovation and development of enterprises in a timely manner.
(5) The application for recognition of high-tech enterprises shall adhere to the principle of honesty and trustworthiness, and the reporting enterprises shall make a commitment to honesty and trustworthiness. For enterprises that are found to have deficiencies in the commitment to honesty and trustworthiness, the application for the identification and reporting of the relevant enterprises will be withdrawn. It is strictly forbidden to falsify application materials, and once discovered, enterprises and relevant intermediaries are to be included in the management of untrustworthy conduct in scientific research, share credit information with other social fields, and carry out joint disciplinary action.
(6) Consultation on declaration matters. Enterprises are requested to consult with the local science and technology administrative departments, see (Annex 5) for consultation telephone numbers, and the staff of each district and county should consult with the municipal high-tech enterprise certification management agency.
