The evidence in the case shows that Zhao's driver's license is consistent with the type of quasi-driving, there is no drunk driving or drug driving, and the vehicle's driving braking performance, lighting signal device, and steering all meet the requirements. But when we interrogated the suspect, he said, "I don't know why, I just can't stop the car", which attracted everyone's attention and further clarified the direction of the review.
We found that the car was illegally modified and the vehicle was overweight, and the important cause of the accident was that the overweight and overload affected the braking effect and made it difficult to brake. So the question is, how is this car licensed, and how does it pass the annual inspection?
With doubts, we reviewed the annual inspection process of engineering and freight vehicles in the city with relevant functional departments, and found that the number of licensed inspections at one of the inspection stations accounted for 47.96% of the city's total, and it was this inspection station that passed the inspection of the vehicle that caused the accident in this case. Is it really a coincidence?
The public security organs filed a case for investigation.
Sure enough.
After investigation, the vehicle inspection station set up by Liu and others, after charging the so-called "number fee" ranging from 500 to 1,500 yuan, not only turned a blind eye to the illegal modification of engineering vehicles, but also used a variety of ways to help engineering vehicles that do not meet the national quality standards to pass the motor vehicle safety technology testing, such as pressing the weighbridge and adjusting the weighbridge to a negative value; Even directly adjust the equipment parameters, etc., and issue false certification documents, resulting in unqualified vehicles on the road.
In the year from September 2019 to August 2020 alone, the inspection station issued false certification reports for 116 engineering vehicles that did not meet national quality requirements. In May 2022, after being prosecuted by the Xihu District Procuratorate, the court sentenced the testing station to a fine of RMB 500,000 for providing false supporting documents, sentenced Liu to four years and six months in prison, and fined RMB 50,000, and other relevant personnel were also sentenced to corresponding punishments.
At this point, the case came to an end.
However, in the handling of the case, we noticed that the counterfeiting of the inspection station is not isolated, and it is very likely that a gray and black industrial chain of illegal modification and illegal detection of overweight vehicles has been formed, and there is even the problem of illegal benefit transfer to management personnel.
We thought of big data, and according to the problems and clues reflected in the case, we integrated the criminal verdict of the traffic accident of engineering vehicles, the traffic administrative punishment decision and other data, and built a "supervision model for illegally modified trucks" with the keywords of "unauthorized change", "modification" and "overweight".
After data collision, we issued pre-trial procuratorial suggestions to the functional departments for the illegal licensing and inspection of the vehicles found to be in violation of the license plate and inspection, and requested that the owners involved in the case be contacted one by one. In view of the more than 40 testing stations outside the province that were suspected of providing false supporting documents, we issued a letter of assistance to the public security organ where the problematic testing institution was located, recommending that they be investigated and dealt with; and in view of the clues of some public employees suspected of job-related crimes, we transferred them to the higher court for investigation or transferred them to the Commission for Discipline Inspection and Supervision for investigation and investigation of relevant responsibilities.
In order to solve the problem of illegal vehicles on the road from the source, we have jointly established an abnormal alarm system for illegal detection with functional departments to assist them in the initial screening of detection stations and vehicles suspected of major violations and crimes. In April this year, we also promoted the application of the "illegal modified truck supervision model" to Anhui, Shanghai and other places.
Engineering vehicles have run out of the acceleration of urban construction, but the engineering vehicles on the road in violation of laws and regulations also make people afraid to avoid them. Based on case handling, with big data legal supervision as a means, the "four major procuratorates" integrate their duties, review, investigation, and investigation go hand in hand, and strive to make engineering vehicles no longer "crazy".
