With the in-depth promotion of the Jiangxi Provincial Procuratorate's "white pollution" special rectification procuratorial public interest litigation supervision activities, the waste agricultural film originally scattered in the rural fields was recycled and destroyed in time, and the fertile fields were rejuvenated.

Since the 18th National Congress of the Communist Party of China, the Party Central Committee with Comrade Xi Jinping as the core has attached great importance to national food security, always regarded solving the problem of feeding more than one billion people as the top priority in governing the country, accelerated the modernization of agriculture and rural areas, and implemented the national food security strategy. Based on the actual situation of Jiangxi's major food province, the Jiangxi Provincial Procuratorate actively cooperated with the Standing Committee of the Provincial People's Congress to carry out the Jiangxi tour of the Standing Committee of the Provincial People's Congress on the theme of "Guarding the Red Line of Cultivated Land", listed the remediation of "white pollution" of agricultural film as an important part of the supervision of theme activities, increased the intensity of case handling, and gathered the joint efforts of all parties to promote the green development of agriculture and ensure food security.

Jiangxi is a large agricultural province, in the process of agricultural production, in order to improve the yield of agricultural products, prevention and control of pests and diseases, agricultural film is used in large quantities, but due to the recycling and disposal of non-standardized, agricultural film pollutes the soil and other phenomena occur from time to time.

In May 2023, Ding Shunsheng, chief prosecutor of the Jiangxi Provincial Procuratorate, found that agricultural film residues polluted cultivated land during his investigation in Jiujiang. After research and judgment, the provincial procuratorate decided to deploy and carry out the "white pollution" special rectification procuratorial public interest litigation supervision activities in the province's procuratorial organs from May 2023, and promote the special activities of cultivated land protection, and strive to promote the prevention and control of agricultural film pollution.

In the process of carrying out special supervision activities, the Jiangxi Provincial Procuratorate supervises and guides the city, county (district) procuratorates through regular scheduling and monthly reports, regularly compiles and distributes special issues on the "white pollution" remediation work, and promotes advanced work experience and typical cases to the procuratorial organs of the province in a timely manner.

Under the guidance of the provincial procuratorate, the city, county (district) procuratorates have refined the work plan according to local conditions, and comprehensively carried out agricultural film pollution control. The Jiujiang City Procuratorate has formulated a small special plan for the remediation of "white pollution", implemented work measures, and clarified specific work requirements; the Fuzhou City Procuratorate has conducted special research and organized the city's procuratorial organs to focus on the whole chain and each link of agricultural film production, sales, use, and recycling, and carry out special supervision; Yongxin, Wannian, Yudu and other county procuratorates have gone deep into the townships and towns to find out the clues and successively carry out special supervision activities for the control of "white pollution" of agricultural films.

Up to now, the Jiangxi Provincial Procuratorate has filed and handled 425 public interest litigation cases in the field of agricultural film pollution remediation, issued 355 pre-trial procuratorial suggestions or consultations, supervised the establishment of 226 agricultural film recycling points, and promoted the cleanup and recycling of 1,307 tons of waste agricultural film and plastic film.

Pay close attention to outstanding problems

Wuning County is known as "the most beautiful city in China", and its idyllic scenery is its business card, but the phenomenon of discarded agricultural film being discarded at will and black mulch mixed with soil is also widely present here.

In order to rectify the problem of agricultural film pollution, the Wuning County Procuratorate set up a special case-handling team to visit 54 agricultural stores and major fruit and vegetable planting bases in the county, statistically analyze the sales and recycling of agricultural film in the jurisdiction, and understand the difficulties and blockages of agricultural film recycling supervision.

After investigation, the institute found that the source channels of agricultural film used by farmers are complex, and it is difficult to supervise the market; after the agricultural film is damaged, it is mixed with soil, which is not easy to pick up, and the recycling is difficult and costly; the farmers' awareness of environmental protection is weak, and the importance of waste agricultural film recycling is not fully understood, and the enthusiasm is not high.

According to the results of the investigation, the Wuning County Procuratorate formed a special investigation report and submitted it to the county party committee and the Standing Committee of the county people's congress. At the same time, the court held a public hearing, inviting relevant departments, township governments and county people's congress deputies, CPPCC members, public welfare observers, and volunteers to clarify the responsibilities of relevant departments and supervise the performance of duties in accordance with the law. After the hearing, the relevant departments purchased more than 2,000 recycling bins, and added recycling devices in administrative villages and fields to form agricultural film recycling outlets covering the county, township and village levels.

"The agricultural film recycling point in the village makes it convenient for the villagers to dispose of the waste agricultural film nearby, so that the pollution in the farmland has become less and the living environment in the countryside has also improved. Zhang Bin, deputy to the Wuning County People's Congress and secretary of the Party branch of Daping Village, Songxi Town, said.

The effectiveness of the Wuning County Procuratorate is a microcosm of the "white pollution" control work carried out by the Jiangxi Provincial Procuratorate. In the special supervision activities, the provincial procuratorate focused on the outstanding problems in the use, disposal and recycling of agricultural films, and went deep into the fruit and vegetable planting bases, agricultural cooperatives and other major mulching land and farmland to visit and investigate, and exert supervision. In addition, the provincial procuratorate pays attention to the simultaneous investigation of clues on the pollution of agricultural inputs such as pesticide packaging waste. For example, the Hukou County Procuratorate urged the administrative organs to actively promote the recycling and disposal of agricultural waste, and established a recycling and disposal mechanism of "user return, operator recycling, collection point storage, and professional disposal" and "grassroots collection, township recycling, and county-level disposal";

"It is recommended that the cleaning and recycling of waste agricultural film be included in the work of rural revitalization and the improvement of the living environment, implement paid recycling, and mobilize the enthusiasm of the masses. On September 26, 2023, Shu Guixiu, deputy to the Jiangxi Provincial People's Congress and executive chairman of Jiangxi Wuyi Group, was invited by the Yugan County Procuratorate to participate in the rectification of agricultural film pollution. Walking around Qianmo, looking at the rows of clean and tidy planting greenhouses, Shu Guixiu affirmed the effectiveness of the procuratorial work and made suggestions.

Subsequently, the Yugan County Procuratorate formed a special research report on the remediation of agricultural film pollution, reported to the county party committee, promoted the inclusion of waste agricultural film recycling subsidies in the government budget, and included the remediation of waste agricultural film in the improvement of the rural living environment, and promoted the formation of a waste agricultural film recycling and reuse system. At present, the county has established 21 agricultural film recycling outlets.

According to reports, the Jiangxi Provincial Procuratorate has deepened the use of the "Procuratorial Suggestions + Research Report" case-handling model while carrying out the "white pollution" special rectification procuratorial public interest litigation supervision activities, integrating the "white pollution" remediation into the overall situation of cultivated land protection and promoting agricultural modernization, and actively striving for the support of local party committees, people's congresses and governments.

Under the leadership of the local party committee and government, the provincial procuratorate has established a long-term mechanism with relevant departments to achieve joint governance. The Xinyu Municipal Procuratorate and the Municipal Bureau of Agriculture and Rural Affairs signed the Opinions on Coordinating the Prevention and Control of Agricultural Film and Helping the Ecological Protection of Cultivated Land, and reached an agreement on strengthening the deployment of agricultural film supervision, information exchange and sharing, and smooth clue transfer. At present, the provincial procuratorate and the departments of agriculture and rural affairs, ecology and environment, market supervision and other departments at the same level have established 50 coordination mechanisms for the prevention and control of agricultural film pollution, and have achieved close cooperation and cooperation in the transfer of clues and work consultations, forming a good situation of multi-party participation and joint governance.
