On December 18, 2023, the Rizhao Municipal Intermediate People's Court publicly pronounced a verdict on the case of embezzlement and bribery of the defendant Chen Zhongqian, and sentenced Chen Zhongqian to two years imprisonment and a fine of RMB 100,000 for the crime of embezzlement, and sentenced to 10 years imprisonment and a fine of RMB 500,000 for the crime of accepting bribes, and decided to enforce the sentence of 11 years imprisonment and a fine of RMB 600,000, and ordered Chen Zhongqian to return or hand over to the state treasury the proceeds and fruits of corruption and bribery in accordance with law.
The Rizhao Intermediate People's Court ascertained that:
1. Embezzlement
From 2017 to 2020, defendant Chen Zhongqian took advantage of his position as the general manager of the Shandong branch of Taiping Property Insurance Co., Ltd. to defraud the Shandong branch of Taiping Property Insurance Co., Ltd. of more than 250,000 yuan of public funds by falsely listing expenditures on several occasions.
2. The crime of accepting bribes
From 2010 to 2022, defendant Chen Zhongqian took advantage of his position as deputy general manager and general manager of the Shandong branch of Taiping Property Insurance Co., Ltd. and assistant general manager of Taiping Property Insurance Co., Ltd. to provide assistance to relevant units and individuals in insurance agency business, insurance loss adjustment business, job promotion, etc., and illegally accepted property from others totaling more than 6.15 million yuan, of which 3 million yuan was attempted and 119,000 yuan was obtained.
At trial, the court held that the defendant Chen Zhongqian, as a state functionary, took advantage of his position to defraud public property of a huge amount, and his conduct constituted the crime of embezzlement; taking advantage of his position to seek benefits for others and illegally accepting other people's property, the amount of which was particularly huge, and his conduct constituted the crime of accepting bribes. Chen Zhongqian committed several crimes and should be punished concurrently. In view of the fact that Chen Zhongqian's crime of embezzlement had the circumstances of voluntary surrender, that he had confessed to the crime of accepting bribes, and that some of the bribes were attempted, he also pleaded guilty and accepted punishment, returned all illegal gains and fruits, and voluntarily paid the fine, and the punishment for the crime of embezzlement was reduced in accordance with the law, and the punishment for the crime of accepting bribes was mitigated. The above judgment was rendered in accordance with the law.
