Basic facts of the case

In 1978, a department of the former Quanzhou City leased the house to Hu Mou, the former owner of Su Tingyu's former residence, as office space, and built a two-story "comprehensive building" within the land area of the house. Since then, the property owner and the custodian have long lacked effective management of Su Tingyu's former residence, and the department was restructured into a state-owned enterprise and became the actual custodian of Su Tingyu's former residence.

In 2014, the state-owned enterprise subleased the disputed house to a cultural company in Quanzhou. The cultural company repaired and constructed Su Tingyu's former residence, and carried out cultural promotion and operation. Hu Mou and Wang Mou, the current owners of Su Tingyu's former residence, filed a civil lawsuit with the Licheng Court, demanding the return of the house and compensation for the loss of rent during the occupation of the house.

During the trial, the Licheng court found that the cultural company had certain experience and strength in the repair of ancient buildings and the promotion of traditional culture in southern Fujian, while the property owner had lived abroad for a long time and the economic conditions were not abundant. In order to be more conducive to the protection of cultural relics, maintain the integrity of Su Tingyu's former residence, and fully excavate its profound historical and cultural resources, the Licheng Court has organized the parties to coordinate many times, and finally promoted the parties to sign a mediation agreement. The current owner re-signed a 15-year lease contract with the cultural company, and the case was satisfactorily resolved.
