Chapter I: General Provisions

Article 1 This Law is enacted for the purpose of maintaining road traffic order, preventing and reducing traffic accidents, protecting personal safety, protecting the property safety and other lawful rights and interests of citizens, legal persons and other organizations, and improving traffic efficiency.

Article 2 Vehicle drivers, pedestrians, and passengers within the territory of the People's Republic of China, as well as units and individuals related to road traffic activities, shall abide by this Law.

Article 3 Road traffic safety work shall follow the principles of management in accordance with law and convenience for the masses, and ensure the orderly, safe and smooth flow of road traffic.

Article 4 The people's governments at all levels shall ensure that the management of road traffic safety is compatible with economic construction and social development.

Local people's governments at or above the county level shall, in accordance with the needs of road traffic development, formulate road traffic safety management plans in accordance with road traffic safety laws, regulations and relevant national policies, and organize their implementation.

Article 5 The public security department of the State Council shall be responsible for the management of road traffic safety throughout the country. The traffic management departments of the public security organs of the local people's governments at or above the county level shall be responsible for the management of road traffic safety within their respective administrative areas.

The transportation and construction management departments of the people's governments at or above the county level shall be responsible for the relevant road traffic work in accordance with their respective duties.

Article 6 The people's governments at all levels shall regularly conduct road traffic safety education to raise citizens' awareness of road traffic safety.

When performing their duties, the traffic management departments of public security organs and their traffic police shall strengthen the publicity of road traffic safety laws and regulations, and abide by road traffic safety laws and regulations in an exemplary manner.

Government organs, military units, enterprises, public institutions, social organizations and other organizations shall conduct road traffic safety education for the personnel of their units.

Administrative departments for education and schools shall include road traffic safety education in the content of legal education.

Press, publishing, radio, television and other relevant units have the obligation to carry out road traffic safety education.

Article 7 For road traffic safety management, scientific research shall be strengthened, and advanced management methods, technologies and equipment shall be promoted and used.

Chapter 2 Vehicles and Drivers

Section 1 Motor vehicles and non-motor vehicles

Article 8 The State implements a registration system for motor vehicles. Motor vehicles can only be driven on the road after being registered by the traffic management department of the public security organ. If a motor vehicle that has not yet been registered needs to be temporarily on the road, it shall obtain a temporary license plate.

Article 9 To apply for motor vehicle registration, the following certificates and vouchers shall be submitted:

(1) The identity certificate of the owner of the motor vehicle;

(2) Proof of the origin of the motor vehicle;

(3) The factory qualification certificate of the motor vehicle or the import certificate of the imported motor vehicle;

(4) The tax payment certificate or tax exemption certificate of the vehicle acquisition tax;

(5) Other certificates and vouchers that laws and administrative regulations provide shall be submitted at the time of motor vehicle registration.

The traffic management department of the public security organ shall, within five working days from the date of acceptance of the application, complete the review of motor vehicle registration, and meet the conditions specified in the preceding paragraph, shall issue a motor vehicle registration certificate, license plate and driving license; Where the requirements of the preceding paragraph are not met, the reasons for not registering shall be explained to the applicant.

No unit or individual other than the traffic management department of the public security organ shall issue a motor vehicle number plate or require a motor vehicle to hang other license plates, except as otherwise provided in this Law.

The styles of motor vehicle registration certificates, license plates, and driving licenses shall be prescribed and supervised by the public security department of the State Council.

Article 10 Motor vehicles approved for registration shall comply with the national safety technical standards for motor vehicles. When applying for the registration of a motor vehicle, it shall undergo a safety and technical inspection of the motor vehicle. However, if the new vehicle type produced by the enterprise certified by the national department in charge of motor vehicle products in accordance with the national safety technical standards for motor vehicles, the new car of the model is exempted from the safety technical inspection if it meets the national safety technical standards for motor vehicles when it leaves the factory and obtains the inspection certificate.

Article 11 When driving a motor vehicle on the road, the motor vehicle number plate shall be hung, the inspection mark and the insurance mark shall be placed, and the motor vehicle driving license shall be carried with the vehicle.

The number plate of the motor vehicle shall be hung in accordance with the provisions and kept clear and complete, and shall not be deliberately covered or defaced.

No unit or individual may confiscate or detain a motor vehicle license plate.

Article 12: In any of the following circumstances, corresponding registration shall be handled:

(1) The ownership of the motor vehicle has been transferred;

(2) The content of the motor vehicle registration is changed;

(3) The motor vehicle is used as collateral;

(4) The motor vehicle is scrapped.

Article 13 For motor vehicles on the road after registration, safety and technical inspections shall be carried out regularly in accordance with the provisions of laws and administrative regulations, according to different circumstances such as the purpose of the vehicle, the number of passengers and goods carried, and the service life. For those who provide a motor vehicle driving license and a compulsory insurance policy for motor vehicle third-party liability, the motor vehicle safety technical inspection agency shall inspect it, and no other conditions shall be attached to any unit. For those that meet the national safety technical standards for motor vehicles, the traffic management department of the public security organ shall issue an inspection mark.

Socialize the safety and technical inspection of motor vehicles. The specific measures shall be formulated by the State Council.

Where the safety and technical inspection of motor vehicles is socialized, no unit shall require motor vehicles to go to designated places for inspection.

The traffic management department of the public security organ and the motor vehicle safety technical inspection agency shall not require the motor vehicle to be repaired and maintained at the designated place.

Motor vehicle safety and technical inspection institutions shall strictly implement the charging standards approved by the price department of the State Council when collecting fees for motor vehicle inspection.

Article 14 The State implements a compulsory scrapping system for motor vehicles, and stipulates different scrapping standards according to the safety and technical conditions of motor vehicles and different uses.

Motor vehicles that should be scrapped must be deregistered in a timely manner.

Motor vehicles that meet the scrapping standards are not allowed to drive on the road. Scrapped large passengers, trucks and other commercial vehicles shall be dismantled under the supervision of the traffic management department of the public security organ.

Article 15: Police cars, fire trucks, ambulances, and engineering rescue vehicles shall, in accordance with regulations, spray sign patterns, and install sirens and sign lamps. Other motor vehicles shall not spray, install or use the signs and patterns, alarms or sign lamps that are special to or similar to the above-mentioned vehicles.

Police cars, fire trucks, ambulances, and engineering rescue vehicles shall be used in strict accordance with the prescribed purposes and conditions.

Special vehicles for highway supervision and inspection shall, in accordance with the provisions of the Highway Law, set up uniform signs and warning lights.

Article 16: No unit or individual may engage in the following conduct:

(1) assembling a motor vehicle or changing the registered structure, structure or characteristics of a motor vehicle without authorization;

(2) Changing the motor vehicle model, engine number, frame number, or vehicle identification number;

(3) Forging, altering, or using forged or altered motor vehicle registration certificates, license plates, driving licenses, inspection marks, or insurance marks;

(4) The use of registration certificates, license plates, driving licenses, inspection marks, and insurance marks of other motor vehicles.

Article 17 The State implements a compulsory third-party liability insurance system for motor vehicles and establishes a social assistance fund for road traffic accidents. The specific measures shall be formulated by the State Council.

18th shall be registered in accordance with the law of non-motor vehicles, after registration by the traffic management department of the public security organs, can be on the road.

The types of non-motor vehicles that shall be registered in accordance with the law shall be prescribed by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government in accordance with the actual local conditions.

The dimensions, mass, brakes, bells and night reflective devices of non-motor vehicles shall comply with the safety technical standards for non-motor vehicles.

Section 2 Motor Vehicle Drivers

Article 19 A motor vehicle driver's license shall be obtained in accordance with law when driving a motor vehicle.

To apply for a motor vehicle driver's license, the driving permit conditions stipulated by the public security department of the State Council shall be met; After passing the examination, the traffic management department of the public security organ will issue a motor vehicle driving license of the corresponding category.

Holders of foreign motor vehicle driver's licenses may be issued with Chinese motor vehicle driver's licenses if they meet the driving permit requirements stipulated by the public security department of the State Council and pass the examination by the traffic management department of the public security organ.

The driver shall drive the motor vehicle in accordance with the permitted driving type indicated on the driver's license; When driving a motor vehicle, you should carry your motor vehicle driver's license with you.

No unit or individual other than the traffic management department of the public security organ shall confiscate or detain the driver's license of the motor vehicle.

20th motor vehicle driving training socialization, by the competent departments of transportation of driving training schools, driving training courses for the record, and driving training activities to strengthen supervision, including special tractor driving training schools, driving training courses by the agricultural (agricultural machinery) departments to implement supervision and management.

Driving training schools and driving training classes shall, in strict accordance with the relevant provisions of the state, train students on road traffic safety laws, regulations, and driving skills to ensure the quality of training.

No state organ or competent department for driving training and testing shall organize or participate in the organization of driving training schools or driving training courses.

Article 21 Before driving a motor vehicle on the road, the driver shall carefully inspect the safety and technical performance of the motor vehicle; Do not drive motor vehicles with potential safety hazards such as incomplete safety facilities or parts that do not meet technical standards.

Article 22 Motor vehicle drivers shall abide by the provisions of road traffic safety laws and regulations, and drive safely and civilly in accordance with the operating specifications.

Those who drink alcohol, take psychotropic or narcotic drugs controlled by the state, or suffer from diseases that impede the safe driving of motor vehicles, or are overly tired and affect safe driving, shall not drive motor vehicles.

No one shall force, instigate, or condone a driver to drive a motor vehicle in violation of road traffic safety laws, regulations, and requirements for safe driving of motor vehicles.

Article 23 The traffic management department of the public security organ shall, in accordance with the provisions of laws and administrative regulations, regularly verify the motor vehicle driver's license.

Article 24 The traffic management department of the public security organ shall implement a cumulative demerit system for the violation of road traffic safety laws and regulations by motor vehicle drivers, in addition to giving administrative penalties in accordance with law. The traffic management department of the public security organ shall detain the motor vehicle driver's license for the motor vehicle driver whose accumulated demerit points reach the specified score, educate them on road traffic safety laws and regulations, and re-examine; Those who pass the examination shall be issued with a motor vehicle driver's license.

For motor vehicle drivers who comply with road traffic safety laws and regulations and do not accumulate demerit points within one year, the verification period of the motor vehicle driver's license may be extended. The specific measures shall be formulated by the public security department of the State Council.

Chapter III Road Passage Conditions

Article 25 Uniform road traffic signals shall be implemented throughout the country.

Traffic signals include traffic lights, traffic signs, traffic markings, and the command of traffic police.

The setting of traffic lights, traffic signs, and traffic markings shall comply with the requirements and national standards for road traffic safety and smoothness, and be kept clear, eye-catching, accurate, and intact.

According to the needs of traffic, road traffic signals shall be added, replaced, and updated in a timely manner. Additional, replacement, and renewal of restrictive road traffic signals shall be announced to the public in advance and widely publicized.

Article 26 Traffic lights consist of red, green and yellow lights. A red light means no traffic, a green light means permission to pass, and a yellow light means a warning.

Article 27 At the intersection of the railway and the road level, warning lights, warning signs or safety protection facilities shall be set up. Unguarded railway crossings shall be set up at a certain distance from the crossing.

Article 28 No unit or individual may set up, move, occupy or damage traffic lights, traffic signs or traffic markings without authorization.

Trees or other plants planted on both sides of the road and on the separation zone, billboards, pipelines, etc., shall be kept at a necessary distance from traffic facilities, and street lights, traffic lights, and traffic signs shall not be obstructed, and safe sight distances shall not be obstructed, and traffic shall not be affected.

Article 29 The planning, design and construction of roads, parking lots and road supporting facilities shall comply with the requirements of road traffic safety and smoothness, and shall be adjusted in a timely manner according to traffic demand.

If the traffic management department of the public security organ finds that there are frequent traffic accidents on the road that has been put into use, or that there are serious traffic safety hazards in parking lots and road supporting facilities, it shall promptly report to the local people's government, and put forward suggestions for preventing traffic accidents and eliminating hidden dangers, and the local people's government shall make a decision on handling it in a timely manner.

Article 30 Where roads are damaged, such as collapses, potholes, water damage, or uplifts, or traffic lights, traffic signs, traffic markings, or other traffic facilities, the maintenance department or management department of the road or traffic facilities shall set up warning signs and repair them in a timely manner.

If the traffic management department of the public security organ discovers that the circumstances described in the preceding paragraph endanger traffic safety and has not yet set up warning signs, it shall promptly take safety measures to divert traffic, and notify the maintenance department or management department of the road or traffic facilities.

Article 31 Without permission, no unit or individual may occupy a road to engage in non-traffic activities.

Article 32 The consent of the competent road department shall be obtained in advance for the occupation or excavation of roads, or the erection or addition of pipeline facilities across or across roads; If traffic safety is affected, the consent of the traffic management department of the public security organ shall also be obtained.

The construction operation unit shall carry out the construction work in the approved road section and time, and set up obvious safety warning signs at a safe distance from the direction of the incoming vehicle at the construction site, and take protective measures; After the completion of the construction operation, the obstacles on the road should be quickly removed, the potential safety hazards should be eliminated, and the traffic management department of the road department and the public security organ shall pass the acceptance and meet the traffic requirements before resuming traffic.

For construction roads that have not interrupted traffic, the traffic management department of the public security organ shall strengthen traffic safety supervision and inspection and maintain road traffic order.

33rd new, reconstructed, expanded public buildings, commercial blocks, residential areas, large (medium) buildings, etc., shall be equipped with additional parking lots; If the parking space is insufficient, it shall be reconstructed or expanded in a timely manner; The parking lot that has been put into use shall not be stopped or used for other purposes without authorization.

Within the scope of urban roads, without affecting the passage of pedestrians and vehicles, the relevant government departments may allocate parking spaces.

Article 34: Where there are no pedestrian crossing facilities on the road in front of schools, kindergartens, hospitals, or nursing homes, pedestrian crossing lines shall be drawn and reminder signs shall be set up.

The sidewalks of the main roads of the city shall be set up in accordance with the plan. The setting of blind lanes shall conform to national standards.

Chapter IV Road Traffic Regulations

Section 1: Ordinary Provisions

Article 35 Motor vehicles and non-motor vehicles shall pass on the right side.

Article 36 Where roads are divided into motorized lanes, non-motorized lanes and sidewalks according to road conditions and traffic needs, motor vehicles, non-motorized vehicles and pedestrians shall be separated from each other. If there is no division of motorized lanes, non-motorized lanes and sidewalks, motor vehicles pass in the middle of the road, and non-motorized vehicles and pedestrians pass on both sides of the road.

Article 37 Where a road is set up with a special lane, only the specified vehicles are allowed to pass in the special lane, and other vehicles are not allowed to enter the special lane.

Article 38 Vehicles and pedestrians shall pass in accordance with traffic signals; In the event of on-site command by traffic police, traffic shall be in accordance with the command of traffic police; On roads where there are no traffic signals, traffic should be carried out in accordance with the principle of ensuring safety and smoothness.

Article 39 According to the specific conditions of roads and traffic flows, the traffic management department of the public security organs may take measures such as diversion, restriction and prohibition of traffic for motor vehicles, non-motor vehicles and pedestrians. In the event of large-scale mass activities, large-scale construction, etc., it is necessary to take measures to restrict traffic, or to make decisions directly related to the public's road traffic activities, it shall be announced to the public in advance.

Article 40 In the event of a natural disaster, adverse weather conditions or major traffic accidents and other circumstances that seriously affect traffic safety, and it is difficult to ensure traffic safety by taking other measures, the traffic management department of the public security organ may implement traffic control.

Article 41 Other specific provisions on road traffic shall be formulated by the State Council.

Section 2 Provisions on the passage of motor vehicles

Article 42 Motor vehicles driving on the road shall not exceed the maximum speed indicated by the speed limit sign. On roads where there are no speed limit signs, you should maintain a safe speed.

When driving at night or on road sections prone to danger, as well as in meteorological conditions such as dust, hail, rain, snow, fog, and ice, you should reduce your driving speed.

Article 43 For motor vehicles driving in the same lane, the vehicle behind shall maintain a safe distance sufficient from the vehicle in front to take emergency braking measures. In any of the following circumstances, overtaking is not allowed:

(1) The vehicle in front is making a left turn, making a U-turn, or overtaking;

(2) There is a possibility of meeting with the opposite car;

(3) The vehicle in front is a police car, fire truck, ambulance, or engineering rescue vehicle performing an emergency mission;

(4) There are no overtaking conditions for passing through railway crossings, intersections, narrow bridges, curves, steep slopes, tunnels, pedestrian crossings, and sections with large traffic flow in urban areas.

Article 44 When a motor vehicle passes through an intersection, it shall pass in accordance with traffic lights, traffic signs, traffic markings or the command of the traffic police; When passing through an intersection that does not have traffic lights, traffic signs, traffic markings, or traffic police commands, slow down and give way to pedestrians and vehicles with priority.

Article 45 When a motor vehicle encounters a vehicle in front of it stopping and waiting in line or driving slowly, it shall not take the road to overtake or occupy the opposite lane, and shall not intersperse the waiting vehicle.

In the section of the road with reduced lanes, at the intersection, or at the intersection without traffic lights, traffic signs, traffic markings or traffic police command, when encountering a stop and queue or slow driving, motor vehicles shall pass alternately.

Article 46 When a motor vehicle passes through a railway crossing, it shall pass in accordance with the traffic signal or the command of the management personnel; If there is no traffic signal or management personnel, they shall slow down or stop, and pass after confirming safety.

Article 47 When a motor vehicle passes through a pedestrian crossing, it shall slow down; If a pedestrian is crossing a crosswalk, he or she should stop and give way.

When a motor vehicle passes on a road without a traffic signal, it should avoid a pedestrian crossing the road.

Article 48 The load of a motor vehicle shall conform to the approved load weight, and it is strictly forbidden to overload; The length, width and height of the load shall not violate the loading requirements, and the load shall not be spilled or scattered.

If a motor vehicle carries an item that cannot be disintegrated beyond the limit, affecting traffic safety, it shall drive in accordance with the time, route and speed designated by the traffic management department of the public security organ, and hang obvious signs. The carriage of non-dismantling items that exceed the limit on the highway shall be carried out in accordance with the provisions of the Highway Law.

Motor vehicles carrying explosives, flammable and explosive chemicals, highly toxic, radioactive and other dangerous goods shall, with the approval of the public security organs, drive at the designated time, route and speed, hang warning signs and take necessary safety measures.

Article 49 Motor vehicles shall not carry more than the approved number of passengers, and passenger motor vehicles shall not carry goods in violation of regulations.

Article 50 Freight motor vehicles are prohibited from carrying passengers.

If a freight motor vehicle needs to carry operators, safety measures shall be set up to protect the operators.

Article 51 When a motor vehicle is moving, the driver and passengers shall use seat belts in accordance with regulations, and motorcycle drivers and passengers shall wear safety helmets in accordance with regulations.

Article 52 When a motor vehicle breaks down on the road and it is necessary to stop for troubleshooting, the driver shall immediately turn on the hazard warning flashing lights and move the motor vehicle to a place that does not obstruct traffic. If it is difficult to move, the hazard warning flashing lights should be continuously turned on, and measures such as setting warning signs in the direction of incoming vehicles should be taken to expand the warning distance, and the police should be called quickly if necessary.

Article 53: Police cars, fire trucks, ambulances, and engineering rescue vehicles may use sirens and marker lamps when performing emergency tasks; On the premise of ensuring safety, other vehicles and pedestrians should give way without being restricted by driving routes, driving directions, driving speeds, and signal lights.

Police cars, fire trucks, ambulances, and engineering rescue vehicles shall not use sirens, sign lamps and lanterns when they are not performing emergency tasks, and shall not enjoy the right of way on the road as provided for in the preceding paragraph.

Article 54 When road maintenance vehicles and engineering operation vehicles carry out operations, their driving routes and directions are not restricted by traffic signs and markings without affecting the passage of passing vehicles, and passing vehicles and personnel shall pay attention to avoidance.

Sprinkler trucks, sweepers and other motor vehicles shall operate in accordance with safety operation standards; In the case of not affecting the passage of other vehicles, it can be exempted from the restriction of vehicle lane separation, but it is not allowed to drive in the opposite direction.

Article 55 Tractors are prohibited from passing on expressways and roads in the central urban areas of large and medium-sized cities. Other roads that prohibit tractors from passing shall be prescribed by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government in accordance with the actual local conditions.

On roads where tractors are allowed to pass, tractors may be engaged in freight transport, but they may not be used to carry people.

Article 56: Motor vehicles shall be parked at designated locations. It is forbidden to park motor vehicles on the sidewalk; However, parking spaces designated in accordance with the provisions of Article 33 of this Law are excluded.

Temporary parking on the road shall not obstruct the passage of other vehicles and pedestrians.

Section 3 Provisions on the passage of non-motorized vehicles

Article 57 Driving a non-motorized vehicle on the road shall comply with the relevant traffic safety regulations. Non-motorized vehicles shall drive in non-motorized lanes; On roads where there are no non-motorized lanes, you should drive on the right side of the roadway.

Article 58: When motorized wheelchairs and electric bicycles for persons with disabilities are driving in non-motorized lanes, the maximum speed must not exceed 15 kilometers per hour.

Article 59 Non-motorized vehicles shall be parked at designated locations. If there is no parking place, the parking of non-motor vehicles shall not obstruct the passage of other vehicles and pedestrians.

Article 60 Tame livestock shall be used to drive an animal-powered vehicle; When driving an animal-powered vehicle across the road, the driver should get out of the vehicle and pull the livestock; When the driver leaves the vehicle, he shall keep the animal on a leash.

Section 4 Regulations on the passage of pedestrians and passengers

Article 61: Pedestrians shall walk on sidewalks, and if there is no sidewalk, walk on the side of the road.

Article 62: Pedestrians passing through intersections or crossing roads shall take crosswalks or crossing facilities; When crossing a pedestrian crossing with a traffic signal, you should follow the instructions of the traffic signal; When crossing an intersection without traffic lights or pedestrian crossings, or crossing a road on a section without crossing facilities, it is necessary to confirm that it is safe to do so.

Article 63 Pedestrians shall not cross or sit on road isolation facilities, and shall not pickpocket, forcibly stop or carry out other acts that impede road traffic safety.

Article 64: Preschool children, persons with mental illness, or persons with intellectual disabilities who are unable to recognize or control their own behavior shall be led by their guardians, persons entrusted by their guardians, or persons with management or protection duties for them.

Blind people passing on the road shall use blind canes or other means of guiding the blind, and vehicles shall avoid blind people.

Article 65 When pedestrians pass through railway crossings, they shall pass in accordance with traffic signals or the command of management personnel; If there is no traffic signal and management personnel, they should pass quickly after confirming that no train is coming.

Article 66 Passengers shall not carry flammable, explosive or other dangerous goods, shall not throw objects outside the vehicle, and shall not have any behavior that affects the driver's safe driving.

Section 5 Special Provisions for Expressways

Article 67 Pedestrians, non-motorized vehicles, tractors, wheeled special mechanical vehicles, articulated passenger cars, full-trailer trailers and other motor vehicles designed for maximum speeds of less than 70 kilometers per hour shall not enter the expressway. The maximum speed indicated by highway speed limit signs shall not exceed 120 kilometers per hour.

Article 68 When a motor vehicle breaks down on a highway, it shall be handled in accordance with the relevant provisions of Article 52 of this Law; However, warning signs should be set up 150 meters away from the direction of the breakdown vehicle, and the occupants of the vehicle should quickly move to the right shoulder or emergency lane, and quickly call the police.

If a motor vehicle breaks down or has a traffic accident on the highway and cannot drive normally, it shall be towed and towed by a rescue vehicle or wrecker.

Article 69: No unit or individual may intercept or inspect vehicles on highways, except for the people's police of public security organs lawfully performing emergency official duties.

Chapter V Handling of Traffic Accidents

Article 70 In the event of a traffic accident on the road, the driver of the vehicle shall immediately stop the vehicle to protect the scene; If personal injury or death is caused, the driver of the vehicle shall immediately rescue the injured person and promptly report to the traffic police on duty or the traffic management department of the public security organ. Where the scene is changed due to the rescue of injured persons, the location shall be indicated. Passengers, drivers of passing vehicles, and passing pedestrians shall assist.

If a traffic accident occurs on the road and no personal injury or death is caused, and the parties have no dispute about the facts and causes, they may immediately evacuate the scene, resume traffic, and negotiate to deal with the compensation for damages on their own; If they do not evacuate the scene immediately, they shall promptly report to the traffic police on duty or the traffic management department of the public security organ.

Where a traffic accident occurs on the road and only minor property damage is caused, and the basic facts are clear, the parties shall first evacuate the scene and then negotiate and handle it.

Article 71 Where a vehicle escapes after a traffic accident, the witnesses at the scene of the accident and other persons with knowledge of the accident shall report to the traffic management department of the public security organ or the traffic police. If the report is true, the traffic management department of the public security organ shall give a reward.

Article 72 After receiving the traffic accident report, the traffic management department of the public security organ shall immediately dispatch the traffic police to the scene, first organize the rescue of the injured, and take measures to restore traffic as soon as possible.

Traffic police shall conduct inquests and inspections at the scene of traffic accidents and collect evidence; The accident vehicle may be detained for the purpose of collecting evidence, but it shall be properly kept for verification.

For the physical and mental conditions of the parties and other professional examinations, the traffic management department of the public security organs shall entrust a special agency to conduct an appraisal. The evaluation conclusion shall be signed by the evaluator.

Article 73 The traffic management department of the public security organ shall, on the basis of the inquest, inspection and investigation of the traffic accident scene and the relevant inspection and appraisal conclusions, make a traffic accident identification document in a timely manner as evidence for handling the traffic accident. The traffic accident determination document shall clearly state the basic facts of the traffic accident, the causes and the responsibilities of the parties, and serve them on the parties.

Article 74 In the case of a dispute over compensation for damages caused by a traffic accident, the parties may request mediation by the traffic management department of the public security organ, or may directly file a civil lawsuit with the people's court.

After mediation by the traffic management department of the public security organ, if the parties fail to reach an agreement or do not perform after the mediation agreement takes effect, the parties may file a civil lawsuit with the people's court.

Article 75: Medical establishments shall promptly rescue persons injured in traffic accidents, and shall not delay treatment because rescue expenses are not paid in a timely manner. If the vehicle involved in the accident participates in the compulsory third-party liability insurance of the motor vehicle, the insurance company shall pay the rescue expenses within the liability limit; If the rescue expenses exceed the liability limit, and those who do not participate in the compulsory third-party liability insurance of motor vehicles or escape after the accident, the road traffic accident social assistance fund shall pay part or all of the rescue expenses in advance, and the road traffic accident social assistance fund management agency shall have the right to recover from the person responsible for the traffic accident.

Article 76 Where a traffic accident involving a motor vehicle causes personal injury or death or property damage, the insurance company shall compensate within the limits of the compulsory third-party liability insurance liability of the motor vehicle; The insufficient part shall be liable for compensation in accordance with the following provisions:

(1) In the event of a traffic accident between motor vehicles, the party at fault shall be liable for compensation; Where both parties are at fault, responsibility is to be shared in proportion to their respective faults.

(2) In the event of a traffic accident between a motor vehicle and a non-motor vehicle driver or pedestrian, and the non-motor vehicle driver or pedestrian is not at fault, the motor vehicle shall be liable for compensation; If there is evidence to prove that the driver or pedestrian of the non-motor vehicle is at fault, the liability of the motor vehicle party shall be appropriately reduced according to the degree of fault; If the motor vehicle party is not at fault, it shall bear no more than 10% of the liability for compensation.

If the loss of a traffic accident is caused by a non-motor vehicle driver or pedestrian intentionally colliding with a motor vehicle, the motor vehicle party shall not be liable for compensation.

Article 77 If an accident occurs when a vehicle is passing outside the road, and the traffic management department of the public security organ receives a report, it shall be handled with reference to the relevant provisions of this Law.

Chapter VI: Law Enforcement Oversight

Article 78 The traffic management department of the public security organ shall strengthen the management of the traffic police, improve the quality of the traffic police, and improve the level of road traffic management.

The traffic management department of the public security organ shall conduct training and assessment of the legal system and traffic safety management of the traffic police. Traffic police officers who fail to pass the assessment shall not be allowed to perform their duties.

Article 79 The traffic management departments of public security organs and their traffic police shall simplify the handling procedures in accordance with the statutory powers and procedures in the implementation of road traffic safety management, so as to be fair, strict, civilized and efficient.

Article 80: When performing their duties, traffic police shall dress in accordance with regulations, wear people's police symbols, hold people's police identification cards, maintain a strict appearance, behave in a dignified manner, and conduct in a standardized manner.

Article 81 The cost of production for the issuance of licenses and licenses in accordance with this Law shall be strictly implemented in accordance with the fee standards approved by the price department under the State Council and all shall be handed over to the State Treasury.

Article 82 The traffic management department of the public security organ shall implement the administrative penalty of the fine in accordance with the provisions of the relevant laws and administrative regulations, and the decision to impose a fine shall be separated from the collection of the fine; All fines collected and unlawful gains confiscated in accordance with law shall be turned over to the state treasury.

Article 83 Traffic police officers investigating and handling road traffic safety violations and traffic accidents shall recuse themselves in any of the following circumstances:

(1) is a party to the case or a close relative of a party;

(2) The person or their close relatives have an interest in the case;

(3) Have other relationships with the parties to the case, which might impact the fair handling of the case.

Article 84 The administrative law enforcement activities of the traffic management departments of the public security organs and their traffic police shall be subject to the supervision of the administrative supervision organs in accordance with law.

The supervision department of the public security organs shall supervise the implementation of laws, regulations and discipline by the traffic management departments of the public security organs and their traffic police in accordance with the law.

The traffic management department of the higher level public security organs shall supervise the law enforcement activities of the traffic management departments of the lower level public security organs.

Article 85 The traffic management departments of public security organs and their traffic police shall consciously accept the supervision of society and citizens in the performance of their duties.

All units and individuals have the right to report and accuse the traffic management departments of the public security organs and their traffic police for not strictly enforcing the law and violating laws and disciplines. Organs that receive reports or accusations shall promptly investigate and handle them on the basis of their duties.

Article 86 No unit shall issue or disguised fines to the traffic management department of the public security organs; The traffic management department of the public security organ shall not use the amount of the fine as the standard for evaluating the traffic police.

The traffic management department of the public security organ and its traffic police have the right to refuse to carry out the instructions that exceed the provisions of laws and regulations, and at the same time report to the higher authorities.

Chapter VII: Legal Responsibility

Article 87 The traffic management departments of public security organs and their traffic police shall promptly correct road traffic safety violations.

The traffic management department of the public security organ and its traffic police shall punish road traffic safety violations on the basis of the facts and the relevant provisions of this Law. If the circumstances are minor and do not affect road traffic, the illegal act shall be pointed out, and a verbal warning shall be given before release.

Article 88 The types of punishments for road traffic safety violations include: warnings, fines, suspension or revocation of motor vehicle driving licenses, and detention.

Article 89 Pedestrians, passengers, or non-motorized vehicle drivers who violate road traffic safety laws and regulations on road traffic shall be given a warning or fined not less than 5 yuan but not more than 50 yuan; If the driver of a non-motor vehicle refuses to accept the fine and punishment, his non-motor vehicle may be detained.

Article 90 A driver of a motor vehicle who violates the provisions of road traffic safety laws and regulations on road traffic shall be given a warning or fined not less than 20 yuan but not more than 200 yuan. Where this Law provides otherwise, punishment is to be given in accordance with the provisions.

Article 91 Whoever drives a motor vehicle after drinking alcohol shall have his motor vehicle driver's license suspended for six months and shall be fined not less than 1,000 yuan but not more than 2,000 yuan. Those who are punished for driving a motor vehicle after drinking alcohol and drive a motor vehicle after drinking alcohol again are to be detained for up to 10 days, fined between 1,000 and 2,000 RMB, and have their motor vehicle driver's license revoked.

If a person drives a motor vehicle while intoxicated, the traffic management department of the public security organ shall restrain him until he sobers up, revoke the motor vehicle driver's license, and pursue criminal responsibility in accordance with law; A motor vehicle driver's license may not be re-obtained within five years.

Anyone who drives a commercial motor vehicle after drinking alcohol shall be detained for 15 days, fined 5,000 yuan, have his motor vehicle driver's license revoked, and shall not re-obtain a motor vehicle driver's license for five years.

Anyone who drives a motor vehicle while intoxicated shall be restrained by the traffic management department of the public security organ until he sobers up, and the driver's license of the motor vehicle shall be revoked, and criminal responsibility shall be investigated in accordance with law; A motor vehicle driver's license shall not be re-obtained within ten years, and after the motor vehicle driver's license is re-obtained, a motor vehicle shall not be driven.

If a major traffic accident occurs after drinking alcohol or driving a motor vehicle while intoxicated, and a crime is constituted, criminal responsibility shall be investigated in accordance with law, and the motor vehicle driver's license shall be revoked by the traffic management department of the public security organ, and the motor vehicle driver's license shall not be re-obtained for life.

Article 92 Where a highway passenger vehicle carries more passengers than the rated occupants, a fine of not less than 200 yuan but not more than 500 yuan shall be imposed; Anyone who exceeds 20% of the rated occupancy or carries goods in violation of regulations shall be fined not less than 500 yuan but not more than 2,000 yuan.

If the freight motor vehicle exceeds the approved load weight, a fine of not less than 200 yuan but not more than 500 yuan shall be imposed; Anyone who exceeds 30% of the approved load weight or carries passengers in violation of regulations shall be fined not less than 500 yuan but not more than 2,000 yuan.

If there is any act in the preceding two paragraphs, the traffic management department of the public security organ shall detain the motor vehicle until the illegal state is eliminated.

Where the vehicles of transport units have the circumstances provided for in paragraphs 1 and 2 of this article, and they do not change after punishment, the person in charge who is directly responsible shall be fined not less than 2,000 yuan but not more than 5,000 yuan.

Article 93 Those who violate the provisions of road traffic safety laws and regulations on the parking and temporary parking of motor vehicles may be pointed out and given a verbal warning to leave immediately.

Where the driver of a motor vehicle is not at the scene or refuses to leave immediately despite being at the scene, obstructing the passage of other vehicles or pedestrians, a fine of not less than 20 yuan but not more than 200 yuan shall be imposed, and the motor vehicle may be towed to a place that does not obstruct traffic or a place designated by the traffic management department of the public security organ for parking. The traffic management department of the public security organ shall not charge the party for the tow, and shall promptly inform the party of the parking location.

If the motor vehicle is damaged due to the incorrect method of towing, it shall bear the liability for compensation in accordance with the law.

Article 94 Where a motor vehicle safety technical inspection institution charges fees in excess of the fee standards approved by the price department under the State Council, the overcharged fee shall be refunded and the price department shall impose a penalty in accordance with the relevant provisions of the Price Law of the People's Republic of China.

If the motor vehicle safety technical inspection agency does not conduct the inspection in accordance with the national safety technical standards for motor vehicles and issues false inspection results, the traffic management department of the public security organ shall impose a fine of not less than five times but not more than ten times the inspection fee, and revoke its inspection qualification in accordance with the law; where a crime is constituted, criminal responsibility is pursued in accordance with law.

Article 95 Where a motor vehicle driving on the road does not hang a motor vehicle number plate, does not place an inspection mark or insurance mark, or does not carry a driving license or driver's license with the vehicle, the traffic management department of the public security organ shall detain the motor vehicle, notify the party concerned to provide the corresponding license plate or sign or go through the corresponding formalities, and may be punished in accordance with the provisions of Article 90 of this Law. Where the parties provide the corresponding licenses or signs or go through the corresponding formalities, the motor vehicles shall be returned in a timely manner.

Those who intentionally cover up, deface, or do not follow the provisions to install motor vehicle number plates shall be punished in accordance with the provisions of Article 90 of this Law.

Article 96 Anyone who forges, alters, or uses a forged or altered motor vehicle registration certificate, license plate, driving license, or driver's license shall be confiscated by the traffic management department of the public security organ, and the motor vehicle shall be detained for not more than 15 days and shall be fined not less than 2,000 yuan but not more than 5,000 yuan; where a crime is constituted, criminal responsibility is pursued in accordance with law.

Anyone who forges, alters, or uses forged or altered inspection marks or insurance marks shall be confiscated by the traffic management department of the public security organ, and the motor vehicle shall be detained for up to 10 days and fined not less than 1,000 yuan but not more than 3,000 yuan; where a crime is constituted, criminal responsibility is pursued in accordance with law.

Anyone who uses the motor vehicle registration certificate, number plate, driving license, inspection mark, or insurance mark of another vehicle shall be confiscated by the traffic management department of the public security organ, and the motor vehicle shall be detained, and a fine of not less than 2,000 yuan but not more than 5,000 yuan shall be imposed.

Where the parties provide corresponding legal certificates or complete the corresponding formalities, the motor vehicle shall be returned in a timely manner.

Article 97 Illegal installation of sirens, signs and lamps shall be forcibly removed by the traffic management department of the public security organ, confiscated, and fined not less than 200 yuan but not more than 2,000 yuan.

Article 98 Where the owner or manager of a motor vehicle fails to take out compulsory third-party liability insurance for motor vehicles in accordance with the provisions of the State, the traffic management department of the public security organ shall detain the vehicle until it has been insured in accordance with the regulations, and shall impose a fine of twice the amount of the insurance premium that should be paid in accordance with the minimum liability limit for insurance in accordance with the regulations.

All fines paid in accordance with the preceding paragraph shall be included in the road traffic accident social assistance fund. The specific measures shall be formulated by the State Council.

Article 99 Any person who commits any of the following acts shall be fined not less than 200 yuan but not more than 2,000 yuan by the traffic management department of the public security organ:

(1) Driving a motor vehicle without obtaining a motor vehicle driver's license, having a motor vehicle driver's license revoked, or driving a motor vehicle while the driver's license has been suspended;

(2) Leaving a motor vehicle to be driven by a person who has not obtained a motor vehicle driver's license or whose motor vehicle driver's license has been revoked or temporarily detained;

(3) Fleeing after causing a traffic accident does not constitute a crime;

(4) The motor vehicle is driving more than 50 percent of the speed limit;

(5) Forcing a motor vehicle driver to drive a motor vehicle in violation of road traffic safety laws, regulations, or requirements for safe driving of motor vehicles, causing a traffic accident, which does not constitute a crime;

(6) Forcibly passing in violation of traffic control regulations and not listening to dissuasion;

(7) Intentionally destroying, moving, or altering transportation facilities, causing harmful consequences, but it does not constitute a crime;

(8) Illegally intercepting or detaining motor vehicles, and refusing to heed dissuasion, causing serious traffic obstruction or relatively large property losses.

Where the perpetrator has any of the circumstances in items (2) or (4) of the preceding paragraph, the motor vehicle driver's license may be revoked concurrently; In any of the circumstances in items 1, 3, 5 through 8, they may be detained concurrently for up to 15 days.

Article 100 Anyone who drives an assembled motor vehicle or a motor vehicle that has reached the scrapping standard on the road, the traffic management department of the public security organ shall confiscate it and forcibly scrap it.

Drivers who drive the motor vehicles listed in the preceding paragraph on the road shall be fined not less than 200 yuan but not more than 2,000 yuan, and their motor vehicle driver's license shall be revoked.

Where a motor vehicle that has reached the scrapping standard is sold, the illegal gains shall be confiscated, a fine equal to the sales amount shall be imposed, and the motor vehicle shall be disposed of in accordance with the provisions of the first paragraph of this article.

Article 101 Where a major traffic accident occurs in violation of the provisions of road traffic safety laws and regulations, and a crime is constituted, criminal responsibility shall be investigated in accordance with law, and the motor vehicle driver's license shall be revoked by the traffic management department of the public security organ.

If a person escapes after causing a traffic accident, the traffic management department of the public security organ shall revoke the motor vehicle driver's license, and shall not re-obtain the motor vehicle driver's license for life.

Article 102 A professional transport unit that bears primary or full responsibility for two or more major traffic accidents within six months shall be ordered by the traffic management department of the public security organ to eliminate potential safety hazards, and motor vehicles that fail to eliminate potential safety hazards shall be prohibited from driving on the road.

Article 103 If the competent department of motor vehicle products of the State fails to strictly examine in accordance with the national safety technical standards for motor vehicles and permits the unqualified motor vehicle models to be put into production, the responsible person in charge and other directly responsible personnel shall be given administrative sanctions of demotion or dismissal.

If a motor vehicle manufacturer does not implement the national safety technical standards for motor vehicles or does not strictly carry out the quality inspection of motor vehicle finished products, resulting in the sale of unqualified motor vehicles, the quality and technical supervision department shall impose penalties in accordance with the relevant provisions of the Product Quality Law of the People's Republic of China.

Unauthorized production or sale of motor vehicle models produced without the permission of the competent department of motor vehicle products shall confiscate the finished products and accessories of motor vehicles illegally produced or sold, and may be fined not less than three times but not more than five times the value of the illegal products; Where there is a business license, the business license shall be revoked by the administrative department for industry and commerce, and if there is no business license, it shall be sealed.

Anyone who produces or sells assembled motor vehicles or manufactures or sells motor vehicles that have been modified without authorization shall be punished in accordance with the provisions of paragraph 3 of this article.

Where there are any illegal acts listed in paragraphs 2, 3, or 4 of this article, and the production or sale of motor vehicles that do not meet the national safety technical standards for motor vehicles, and a crime is constituted, criminal responsibility is to be pursued in accordance with law.

Article 104 Whoever, without approval, excavates a road, occupies a road for construction, or engages in other activities that affect road traffic safety, shall be ordered by the competent department of roads to stop the illegal act and restore the original state, and may be fined in accordance with law; Where losses are caused to passing persons, vehicles and other property, they shall be liable for compensation in accordance with law.

Where there is an act in the preceding paragraph that affects road traffic safety activities, the traffic management department of the public security organ may order the illegal act to be stopped and traffic to be restored quickly.

Article 105 Where there is damage to a road during construction work or on a road, warning signs or protective measures are not set up in a timely manner, or traffic lights, traffic signs or traffic markings should be set up but not set up, or traffic lights, traffic signs and traffic markings should be changed in a timely manner but not changed in a timely manner, resulting in losses to passing personnel, vehicles and other property, the unit with relevant duties shall be liable for compensation in accordance with law.

Article 106: Where trees or other plants are planted on both sides of the road or on the separation zone, or billboards or pipelines are set up, blocking street lights, traffic lights, or traffic signs, and obstructing a safe visual distance, the traffic management department of the public security organ shall order the perpetrator to remove the obstruction; and where enforcement is refused, a fine of between 200 and 2,000 RMB is to be given, and the obstruction is to be forcibly removed, and the necessary costs are to be borne by the perpetrator.

Article 107 Where a road traffic offender is given a warning or fined not more than 200 yuan, the traffic police may make an administrative penalty decision on the spot and issue an administrative penalty decision.

The administrative punishment decision shall clearly indicate the facts of the party's violation, the basis for the administrative punishment, the content, time, and place of the punishment, and the name of the punishment organ, and shall be signed or sealed by the law enforcement personnel.

Article 108: Within 15 days of receiving the administrative penalty decision for fines, the parties shall pay the fine at the designated bank.

Where the parties have no objection to fines for pedestrians, passengers, and non-motorized vehicle drivers, the fines may be collected on the spot.

Fines shall be issued with receipts uniformly issued by the finance departments of provinces, autonomous regions, and municipalities directly under the Central Government; If the fine receipt issued by the financial department is not issued, the party concerned has the right to refuse to pay the fine.

Article 109: Where parties fail to perform on an administrative punishment decision within the time limit, the administrative organ that made the administrative punishment decision may employ the following measures:

(1) Where fines are not paid when due, an additional fine of 3% of the amount of the fine is to be imposed for each day;

(2) Apply to the people's court for compulsory enforcement.

Article 110 Where a traffic police officer performing his duties believes that a road traffic offender should be punished by temporarily withholding or revoking a motor vehicle driver's license, he may first detain the driver's license and transfer the case to the traffic management department of the public security organ within 24 hours.

Road traffic offenders shall be dealt with within 15 days at the traffic management department of the public security organ. If the disposition is not accepted within the time limit without a legitimate reason, the motor vehicle driver's license shall be revoked.

If the traffic management department of the public security organ temporarily detains or revows the driver's license of a motor vehicle, it shall issue an administrative penalty decision.

Article 111: Administrative punishments for detention in violation of the provisions of this Law are to be adjudicated by the county or municipal public security bureau, public security sub-bureau, or public security organ equivalent to the county level.

Article 112 If a motor vehicle or non-motor vehicle is detained by the traffic management department of a public security organ, it shall issue a certificate on the spot and inform the parties concerned to go to the traffic management department of the public security organ for treatment within the prescribed time limit.

The traffic management department of the public security organ shall properly keep the impounded vehicle and shall not use it.

If they do not come to accept the treatment within the time limit, and they still do not come to accept the treatment within three months after the announcement, the impounded vehicle shall be dealt with in accordance with the law.

Article 113: The period for temporarily seizing a motor vehicle driver's license is calculated from the date on which the penalty decision takes effect; Where a motor vehicle driver's license is detained before the penalty decision takes effect, the period of temporary detention is to be reduced by one day for each day of detention.

The time limit for re-applying for a motor vehicle driver's license after the revocation of the motor vehicle driver's license shall be handled in accordance with the provisions on the administration of motor vehicle driver's licenses.

Article 114 The traffic management department of the public security organ may, on the basis of the traffic technical monitoring records, punish the owner or manager of the motor vehicle who violates the law in accordance with law. Where the driver can be determined, punishment may be given in accordance with law in accordance with the provisions of this Law.

Article 115 Where a traffic police officer commits any of the following acts, he shall be given an administrative sanction in accordance with law:

(1) Issuing motor vehicle registration certificates, license plates, driving licenses, and inspection marks for motor vehicles that do not meet the statutory requirements;

(B) approval does not meet the statutory requirements of motor vehicles installation, the use of police cars, fire trucks, ambulances, engineering rescue vehicles of alarms, sign lamps, spraying sign patterns;

(3) Issuing motor vehicle driver's licenses to persons who do not meet the requirements for driving permits, have not taken the test, or have failed to pass the test;

(4) Failure to implement a system for separating the decision to impose fines from the collection of fines, or failing to follow provisions to hand over all fees collected in accordance with law, fines collected, and confiscated unlawful gains to the state treasury;

(5) Holding or participating in business activities such as driving schools or driving training classes, motor vehicle repair shops or paid parking lots;

(6) Taking advantage of one's position to accept property from others or seek other benefits;

(7) Illegally detaining vehicles, motor vehicle driving licenses, driver's licenses, or vehicle number plates;

(8) Using a vehicle detained in accordance with law;

(9) Collecting fines on the spot, not issuing receipts for fines, or not truthfully filling in the amount of fines;

(10) Twisting the law for personal gain or unfairly handling traffic accidents;

(11) Deliberately making things difficult or delaying the application for motor vehicle license plates;

(12) Using sirens or marker lamps other than when performing emergency tasks;

(13) Intercepting or inspecting vehicles in normal operation in violation of regulations;

(14) Intercepting a passenger vehicle other than when performing emergency official duties;

(15) Failure to perform legally-prescribed duties.

If the traffic management department of the public security organ has one of the acts listed in the preceding paragraph, the person in charge who is directly responsible and other persons who are directly responsible shall be given corresponding administrative sanctions.

Article 116 Where a traffic police officer is given an administrative sanction in accordance with the provisions of Article 115 of this Law, he may be suspended from performing his duties before a decision on the administrative sanction is made; If necessary, they may be confined.

In accordance with the provisions of Article 115 of this Law, traffic police officers who receive an administrative sanction of demotion or removal may be dismissed.

Where traffic police officers are dismissed or dismissed, their ranks shall be revoked; Traffic police officers who have received an administrative sanction of removal or less shall have their rank reduced.

Article 117 Where a traffic police officer illegally takes possession of public property, solicits or accepts bribes, or abuses his power or neglects his duties, which constitutes a crime, he shall be investigated for criminal responsibility in accordance with law.

Article 118 Where the traffic management department of a public security organ and its traffic police commit any of the acts listed in Article 115 of this Law and cause losses to the parties, they shall be liable for compensation in accordance with law.

Chapter VIII: Supplementary Provisions

Article 119:The following terms in this Law have the following meanings:

(1) "Road" refers to highways, urban roads, and places that allow the passage of social motor vehicles although they are within the jurisdiction of the unit, including squares, public parking lots, and other places used for public passage.

(2) "Vehicle" refers to motor vehicles and non-motor vehicles.

(3) "Motor vehicle" refers to a wheeled vehicle that is driven or towed by a power unit and driven on the road for personnel or for transporting goods and carrying out special engineering operations.

(4) "Non-motorized vehicles" refers to vehicles that are driven by human or animal power and driven on the road, as well as motorized wheelchairs, electric bicycles and other means of transportation for the disabled that are driven by power units but are designed to meet the relevant national standards in terms of maximum speed, empty mass and dimensions.

(5) "Traffic accident" refers to an incident in which a vehicle is injured or injured or property damaged due to fault or accident on the road.

Article 120: The relevant departments of the Chinese People's Liberation Army and Chinese Chinese People's Armed Police Forces are responsible for the work of the People's Liberation Army and the People's Armed Police Force on the registration plates of motor vehicles, the inspection of motor vehicles on the pipeline Chinese, and the evaluation of motor vehicle drivers.

Article 121 For tractors driving on the road, the competent department of agriculture (agricultural machinery) shall exercise the management functions and powers of the traffic management department of the public security organ as provided for in Article 8, Article 9, Article 13, Article 19 and Article 23 of this Law.

The competent department of agriculture (agricultural machinery) shall exercise its powers in accordance with the provisions of the preceding paragraph, shall comply with the relevant provisions of this law, and accept the supervision of the traffic management department of the public security organ; Where provisions are violated, legal responsibility shall be pursued in accordance with the relevant provisions of this Law.

The motor vehicle license plate issued by the competent department of agriculture (agricultural machinery) before the implementation of this Law shall continue to be valid after the implementation of this Law.

Article 122 The State shall implement unified management of the road traffic safety of foreign motor vehicles entering the country.

Article 123: The standing committees of the people's congresses of provinces, autonomous regions, and municipalities directly under the Central Government may, on the basis of the actual conditions in their respective regions, provide specific enforcement standards within the range of fines provided for in this Law.

Article 124: This Law shall take effect on May 1, 2004.
