
On October 18th, the "Second China International Collective Copyright Management Summit Forum" was successfully held in Hangzhou, guided by the National Copyright Administration, sponsored by the China Audio-visual Copyright Collective Management Association (hereinafter referred to as the Music Collective Management Association), and co-organized by the China Music Copyright Association, the China Text Copyright Association, the China Photographic Copyright Association and the China Film Copyright Association.
Yu Cike, director of the Copyright Administration Bureau of the Central Propaganda Department, attended the forum and delivered a speech, Shen Yajie, deputy director of the Policy and Regulation Research Office of the Central Propaganda Department, Geng Huiru, assistant judge of the Third Civil Division of the Supreme People's Court, Guo Biao, president of the Greater China region of the International Association of Phonograms and chief representative of China, Kong Ming, secretary general of the China Cultural and Entertainment Industry Association, Zhou Yaping, acting director general of the China Audiovisual Copyright Collective Management Association, Liu Ping, acting director general of the China Music Copyright Association, Zhang Hongbo, director general of the Chinese Character Copyright Association, and Lin Tao, director general of the China Photographic Copyright Association Shi Wenxia, Deputy Secretary-General of the China Film Copyright Association, attended the forum, and Anita Huss-Ekerhult, Consultant of the Copyright Management Department of the World Intellectual Property Organization (WIPO), Lauri Rechardt, Chief Legal Officer of the International Federation of the Phonographic Industry (IFPI), and Wang Qian, Professor of the Law School of East China University of Political Science and Law, attended the forum by video and delivered speeches. Song Jian, President of the Intellectual Property Division of the Former Adjudication Committee of the Higher People's Court of Jiangsu Province, Chen Wei, Judge of the Third Civil Division of the Higher People's Court of Zhejiang Province, Lin Xiuqin, Professor of the Law School of Xiamen University, Li Tao, Researcher of the Intellectual Property Research Center of the Central University of Finance and Economics, Zhao Zhi'an, Professor of the School of Music and Recording Arts of the Communication University of China, Liu Xin, Senior Vice President of Taihe Music Group, Zhou Jiaqi, Partner Lawyer of Hubei Zhonglihe Law Firm, and Zhou Yaping, Liu Ping and Zhang Hongbo delivered speeches on issues related to collective management at the forum. Nearly 100 guests from government administration departments, music rights holders, karaoke practitioners, Internet platform enterprises, experts and scholars from some universities, law firms, news media, and social figures concerned about copyright protection attended the forum.
In his speech at the opening ceremony of the forum, Director Yu Cike said that the copyright collective management system has become an important part of the national intellectual property power strategy and the copyright system system with Chinese characteristics, and in such a situation, the development of China's copyright collective management system must adhere to the original mission, and put it into the political position and overall work of building a socialist intellectual property power to look, think and plan. He stressed that collective copyright management organizations should not degenerate or deviate in the process of development, and always maintain the institutional nature of the collective copyright management system with Chinese characteristics.
Ms. Anita Huss-Ekerhult, Consultant, Division of Collective Management, WIPO, offered innovative ideas on the new development of global copyright collective management organizations in a video speech, shared WIPO's work and experience in promoting the development of collective management of copyright in various countries in the world, and hoped to strengthen international copyright protection and cooperation. Judge Chen Wei shared the experience of the Zhejiang Provincial Higher People's Court in handling the judicial response to the batch rights protection in the field of karaoke, and proposed that the way to solve the problem through collective management of copyright is the way to solve the problem. In his video speech, Professor Wang Qian explained the legal issues of the right to remuneration for broadcasting and performance of phonograms, and proposed that the most feasible choice for realizing the right to remuneration for phonograms through copyright collective management organizations is the most feasible path. In her keynote speech on "The Implementation of the Outline for the Construction of an Intellectual Property Powerhouse and the Improvement of the Collective Copyright Management System", Professor Lin Xiuqin elaborated that the state has elevated the development and improvement of collective management organizations to the height of promoting the construction of an intellectual property power, and further put forward suggestions for improvement and development. Mr. Zhou Yaping, combined with the actual work of the Music Collection Association, made in-depth sharing on the application of the rules for collective management of karaoke copyright disputes, pointed out the problems, and proposed solutions.
Song Jian, former President of the Intellectual Property Division of the Jiangsu Provincial High Court, put forward solutions to the progress and rethinking of the trial of cases involving collective management of copyright in music and television works involving karaoke; Mr. Zhang Hongbo shared the history of the Association and its achievements in recent years, and made suggestions on the revision of the Regulations on the Collective Management of Copyright; Dr. Li Tao interpreted the institutional innovation of collective management of copyright outside the region and its enlightenment to China; In his video lecture on "International Judicial Practices Related to public performances and broadcasting rights in phonograms", Mr. Laurie Reichard expressed his desire to strengthen cooperation in the international phonographic industry, shared international cases of strengthening collective management of copyright, and also analyzed the situation of collective management organizations.
In the section of "Innovation of Copyright Collective Management System to Promote Industrial Development", Mr. Liu Ping introduced in detail the music copyright integration service system developed by the Music Authors Association; Professor Zhao Zhi'an interpreted the innovative mechanism of the collective management mechanism and proposed the solution idea of building the development of the music industry; Mr. Liu Xin introduced the current situation of music copyright use in the online live broadcasting industry and proposed solutions to related problems; Mr. Zhou Jiaqi shared the improvement and suggestions of collective management organizations in copyright litigation.
The forum also held the theme activities of the Music Collection Association to implement the requirements of the "Notice on Regulating the Order of the Copyright Market in the Karaoke Field" of the two ministries and commissions, cooperate with representatives of 100 entertainment industry associations and sign contracts, and award the "Karaoke Music Copyright Contribution Award" to the top ten music rights holders.
