On the morning of 19 January, in the government conference room of Huangcao Town, Zixing City, Tan Xiangping, chief procurator of the Zixing Municipal People's Procuratorate, served as the prosecutor, Peng Yanfei, president of the Zixing Municipal People's Court, served as the presiding judge, and the "two chiefs of the judicial procuratorate" appeared in court in accordance with legal procedures to hear Qiu X's illegal fishing case, and more than 30 people, including people's congress deputies, members of the Chinese People's Political Consultative Conference, and local people, observed the trial.
After the public security investigation was concluded, it was transferred to the procuratorial organ for review and prosecution, and after investigation and verification, the procuratorial organ found out: Qiu Moumou drove a fishing boat to the waters of Dongjiang Lake in Huangcao Town, Zixing City, to place fishing nets. The next day, Qiu went here to collect the nets and caught a large number of cockfish (scientific name Mongolian red carp). After that, Qiu contacted Hu to sell the catch, and was seized by the police at the police station on the spot, weighed on the spot, and Qiu Caught 118.9 kg of mouthfish. According to the Zixing Municipal Bureau of Agriculture and Rural Affairs, the area illegally fished by Qiu Moumou belongs to the National Aquatic Germplasm Resources Conservation Area of the Large Loach and Striped Erzhu Catfish in the Zixing Section of The Zhejiang Water, Dongjiang Lake, and the protected species in the Mongolian Red Bream Conservation Area.
During the review and prosecution, Qiu voluntarily signed an affidavit admitting guilt and accepting punishment, and voluntarily paid 10,000 yuan of ecological restoration funds. During the trial, Qiu xxx confessed to the criminal facts alleged by the prosecutor, and when the court admitted guilt and accepted punishment, the Zixing Municipal People's Court sentenced Qiu xxx to one year in prison with a suspended sentence of one year and six months in accordance with relevant laws.
In order to educate the general public to abide by discipline and the law, the Zixing Municipal People's Procuratorate communicated and consulted with the Zixing Municipal People's Court and decided to organize a circuit trial in Huangcao Town.
During the trial, the public prosecutor conducted a publicity and education on the rule of law for the defendants and the citizens who were listening to the hearing, Dongjiang Lake is the mother lake of the Zixing people, and the implementation of the ban on fishing and the withdrawal of fishing in the Dongjiang Lake Basin is a major decision made by the party committee and the government for the overall situation and for the welfare of future generations, and is of great significance to improving the ecological links of the Dongjiang Lake Basin and restoring fishery resources. In order to protect the clear water of this lake, we have made great contributions to the people of Zixing, especially the people in the reservoir area have made a lot of sacrifices, which requires all of us to further strengthen the awareness of protection and put an end to acts of destruction, and it is also more necessary for us to explore a new way of ecological priority and green development, so that the clear water of the Dongjiang Lake will produce huge ecological benefits, economic benefits and social benefits, and always maintain its vitality. Judicial organs in the handling of cases to practice the concept of restorative justice, in recent years through breeding and stocking, returning fish to the lake or paying ecological and environmental damage compensation, etc., to urge lawbreakers and criminals to repair the damaged ecology, has been to the Dongjiang Lake millions of fish fry, not only produced a greater economic value, but also produced a huge ecological value.
