A woman prescribes medicine from her hometown on the grounds of a gynecological illness and then brings her to Beijing to open a clinic in a rental house, resulting in the death of a patient after infusing an infusion of anti-inflammatory drugs. Defendant Guo Mou, more than 50 years old, was prosecuted by the procuratorate on suspicion of illegally practicing medicine. On July 12, 2021, in the rental house of Zhugangzi Village, Changyang Town, Fangshan District, Guo injected Ceftriaxone sodium intravenously into Mr. Feng, causing Mr. Feng to suddenly go into shock and die after being rescued ineffectively.
After judicial appraisal, the victim, Mr. Feng, met the criteria for an allergic reaction to a drug that occurred during intravenous infusion of ceftriaxone sodium, resulting in multi-organ dysfunction and death. On July 13, 2021, Guo was criminally detained on suspicion of illegally practicing medicine, and was immediately arrested with the approval of the Fangshan Procuratorate. On January 5, 2022, the case was heard at the Fangshan Court.
After Mr. Feng was injured in his foot while working at the construction site, he became inflamed and found Guo mou to see a doctor. Guo mou gave Mr. Feng an anti-inflammatory drug for four days - cefuroxime. Later, cefuroxime was out of stock, Guo replaced Mr. Feng's medicine with ceftriaxone sodium, just a few minutes after changing the medicine, Mr. Feng could not do it.
Guo Mou said that he had studied some common sense of medical treatment with his father-in-law in his hometown, and had never systematically studied clinical medicine or obtained a doctor's qualification certificate. In June 2021, Guo brought some medicines from his hometown to Beijing, rented a room in Zhugangzi Village, Changyang, Fangshan District, and began to treat people. The neighbors and villagers in the village had a headache and brain fever, so she prescribed some medicine, gave a drip, and made some money from it. Guo mou explained that her medical treatment was all based on experience. In her consciousness, cefuroxime and ceftriaxone sodium are both cephalosporin anti-inflammatory drugs, and Mr. Feng is not allergic to cefuroxime, and there is no problem with ceftriaxone sodium.
The patient's first aid knowledge after drug allergy, Guo Mou does not understand. When Mr. Feng had a drug allergic reaction, Guo was helpless. In 2007, Guo was dealt with by the public security organs for illegally practicing medicine. After the incident. The police seized hundreds of bottles of injectable drugs at his place of residence.
The prosecution believes that Guo Mou's illegal practice of medicine without obtaining a doctor's qualification, resulting in the death of the patient, and his behavior violates the first paragraph of article 336 of the Criminal Law, and he should be investigated for criminal responsibility for the crime of illegal medical practice, and recommends that he be sentenced to fixed-term imprisonment of 10 to 12 years and a fine. Yang Jun of the emergency department of Beijing Chaoyang Hospital said that each type of drug has very strict requirements and obvious differences in the use of drugs, which is the research results of medical experts over the years, and non-professionals cannot distinguish the fundamental differences. Once the medication is improper and the rescue is not timely, the patient's life is in danger at any time. As of press time, the case had not yet been pronounced.
