Background to the promulgation of the Provisions
In 2012, the former General Administration of Quality Supervision, Inspection and Quarantine announced the provisions on the responsibility for repair and replacement of household automobile products, which was implemented since October 1, 2013, and the promulgation of the regulations filled the gap in the supervision of the three guarantees of responsibility in the domestic automobile consumer market, and since the implementation of 7 years, it has played an important role in implementing the three guarantees of responsibility for operators' automobiles, protecting the legitimate rights and interests of consumers, promoting automobile enterprises to improve the quality of products and services, and promoting the rapid development of the automobile industry.
With the rapid development of China's economy and society, this regulation has also appeared some unsuitable situations, so it is urgent to revise. There are three main reasons for the revision:
On August 16, 2019, the General Office of the State Council issued the "Opinions on Accelerating the Development of Circulation and Promoting Commercial Consumption", in which it was clearly proposed to revise the regulations on the responsibility for repairing and replacing consumer goods such as automobiles.
Second, in reality, the incident of the operator infringing on the legitimate rights and interests of consumers still cannot be well resolved, at the same time, consumers generally reflect that when returning and replacing the car, the use compensation fee paid to the seller is relatively high, and there is no compensation provision for losses such as their own vehicle registration fees and decoration costs, and the convenience of consumers enjoying the rights and interests of the three guarantees needs to be further improved.
The third original regulations can no longer meet the needs of the development of the automobile industry. With the continuous emergence of new technologies and new products, the rapid development of new energy vehicles and pickup trucks, the main components such as batteries, motors, electronic controls and pickup trucks of new energy vehicles are not included in the scope of the three guarantees, which has also had a certain impact on promoting industrial development and stimulating consumption.
Finally, the supervision of the three guarantees of automobiles needs to be further increased, on the other hand, it is also necessary to innovate the way of dispute handling and accelerate the establishment of a third-party dispute handling mechanism. The above points are the main background for the revision of the provisions of the three guarantees.

Main content and highlights
The "Provisions" clearly states that if the engine, transmission, power battery, driving drive motor or its main parts need to be replaced due to quality problems for household automobile products within 7 days from the date of the validity period of the three guarantees, consumers can choose to replace the household automobile products or return them with the car purchase invoice and the three-pack voucher.
If the steering system fails, the brake system fails, the body cracks, the fuel leakage or the power battery catches fire due to quality problems, consumers can choose to replace the household automobile products or return the household automobile products within 60 days from the date of the validity period of the three guarantees or within 3,000 kilometers of the mileage.
Wang Yong, a third-level researcher of the Quality Development Bureau of the Autonomous Region Market Supervision Bureau, said: In the 2012 version of the three-guarantee law, there is no such provision, because as a large commodity, the amount involved is large, and the use environment and method of the car are very complicated, so it is very difficult to return and exchange goods in 7 days, but the State Administration of Market Supervision has clarified the 7-day return in the new three-guarantee law, which completely solves the contradiction between consumers and car dealers.
In view of the rapid development of household electric vehicles, the "Provisions" will include the quality of special components such as power batteries and driving drive motors into the three-pack return and replacement clause, requiring producers to clearly indicate the attenuation limit of the power battery capacity of household pure electric and plug-in hybrid vehicles on the three-pack voucher for consumers to refer to when purchasing vehicles. In addition, the restrictions on the cumulative repair of the same quality problem more than 5 times or the cumulative repair time of the whole vehicle exceeding 35 days during the validity period of the three guarantees have been reduced to 4 times and 30 days.
Wang Yong said that the introduction of the "Regulations" will play a role in supervising automobile manufacturers, strengthening their quality responsibilities, paying more attention to safety and quality in the production and manufacturing process, and the future automotive aftermarket and sales links will be more standardized.
According to environmental protection requirements, in order to strictly implement the relevant provisions of the Air Pollution Prevention and Control Law, the "Provisions" incorporate the quality of pollution control devices into the three-guarantee return and replacement clause to promote enterprises to improve the quality of pollution control devices.
