The European Union approves the use of the active substance potassium sorbate

On 21 May 2021, the European Commission published Regulation (EU) 2021/807 amending Regulation (EU) No. 528/2012 of the European Parliament and of the Council to include potassium sorbate as an active substance in annex I thereto.

Pursuant to Article 7(2) of Regulation (EU) No. 1062/2014, the Commission on Biocide Products adopted the opinion of the European Chemicals Agency (IB) on 4 December 2014 and considered the conclusions of the competent authorities. As the assessment by the competent authorities was completed on 20 October 2010, the application for approval of potassium sorbate was reviewed in accordance with Directive 98/8/EC of the European Parliament and of the Council, as described in Article 90(2) of Regulation (EU) No. 528/2012, the Authority considers that biocidal products of product type 8 (PT8) containing potassium sorbate are expected to meet the requirements of Article 5 of Directive 98/8/EC. Therefore, potassium sorbate is approved by the European Commission Implementing Regulation (EU) 2015/1729 as the active substance for biocide products of PT8.

In addition, potassium sorbate is still included in the systematic inspection work programme for all existing active substances used in product type 6 (PT6). In accordance with the opinion of 4 December 2014, the Authority also considers that potassium sorbate meets the criteria of Annex I to Regulation No. 528/2012 (EU) because potassium sorbate is assessed on the basis of an active substance file that has been accepted in accordance with Article 11(1) of Directive 98/8/EC and that potassium sorbate should be included in Category 6 of Annex I to Regulation (EU) No. 528/2012.

Article 89(3) of Regulation (EU) No. 528/2012 contains transitional measures for the approval of existing active substances contained in the work plan for the systematic inspection of existing active substances in accordance with this Regulation. For potassium sorbate for product type 6, the approval date of the regulation is February 1, 2023 to allow sufficient time to submit an authorization application in accordance with Article 89(3) 2 of the Regulation.

This regulation enters into force on the twentieth day after its publication in the Official Journal of the European Union.
