It was found that from May 2020 to the time of the crime, defendant Guo X, who went beyond the scope of the business license to produce, process, and sell duck cooked food without authorization, in order to prevent the corruption and deterioration of the duck products he operated, and obtain more economic benefits, illegally added sodium nitrite during the processing process and sold to unspecified consumer objects in the society, with sales of about RMB 16,202 and illegal profits of about RMB8,340.
According to the law, Guo Moumou violated the national food safety management regulations by adding toxic and harmful non-food raw materials to the food produced and sold, and his behavior has constituted the crime of producing and selling toxic and harmful food. Defendant Guo X added toxic and harmful non-food raw materials to the food produced or sold, which has the characteristics of unspecific consumption objects and the continuity of the damage consequences, harming the social public interest, and while bearing criminal liability in accordance with law, it shall also bear corresponding civil liability.
On March 3, 2021, the Weihai Economic and Technological Development Zone Procuratorate performed the pre-litigation announcement procedure. On April 7, the procuratorate filed a criminal attached civil public interest lawsuit with the Weihai Economic and Technological Development Zone People's Court on suspicion of producing and selling toxic and harmful food. The court adopted all of the procuratorial organs' indictment opinions and rendered the above-mentioned judgments in accordance with law.
