The case of Mr. Luo moumou suspected of producing and selling toxic and harmful food was investigated by the Mazhang Branch of the Zhanjiang Municipal Public Security Bureau, and on November 15, he was transferred to the People's Procuratorate of Mazhang District of Zhanjiang City for prosecution and accepted.

According to the indictment, after review, it was ascertained that at the end of March 2021, in order to increase the sales of herbal tea, defendant Luo Moumou privately bought acetaminophen, chlorpheniramine, dexamethasone, erythromycin and other drugs and ground them into powders and mixed them together to add to the treatment of "cold" herbal tea.

On April 13, the Zhanjiang Mazhang District Market Supervision and Administration Bureau commissioned the testing company to conduct a sampling inspection of the herbal tea produced and sold by the herbal tea shop operated by Mr. Luo, and after testing, the content of "acetaminophen" was detected in the herbal tea as 0.566mg/kg, which did not meet the standards for the Zhanjiang Mazhang District Market Supervision and Administration Bureau to approve its food business license.

The People's Procuratorate of Mazhang District of Zhanjiang City held that the defendant Luo X, in violation of the national food safety management regulations, mixed Western medicine acetaminophen and other non-food raw materials into the herbal tea produced and sold, violated article 38 of the Food Safety Law, violated the provisions of article 144 of the Criminal Law, the facts of the crime were clear, the evidence was credible and sufficient, and he should be investigated for criminal responsibility for the crime of producing and selling toxic and harmful substances.

The prosecutor said that after the case, because Luo X voluntarily surrendered, truthfully confessed his crime, it was voluntary surrender, according to the relevant laws and regulations, it can be leniently treated, and it is recommended that the sentence be sentenced to 6 months in prison, a suspended sentence can be applied, and a fine is now filed.
