Deputy Wang Yan: It is recommended to increase annual leave according to the length of service, and the upper limit is increased from 15 days to 20 days

The Paper learned that during this year's meeting, Wang Yan, a deputy to the National People's Congress and director of the Import and Export Department of Yantai Yaqi Auto Parts Co., Ltd., submitted a "Proposal on Increasing the Number of Paid Annual Leave Days According to Length of Service." Among them, it is proposed to amend the third article of the current Regulations on Paid Annual Leave for Employees, specifically: employees who have worked for 1 year shall have 5 days of annual leave; from the second year onwards, the annual leave shall be increased by 1 day for every 2 years of cumulative working time; and the maximum number of days of annual leave enjoyed by employees shall be 20 days.

According to reports, China's "Regulations on Paid Annual Leave for Employees" came into force on January 1, 2008. The regulations stipulate: Employees who have worked for 1 year but less than 10 years shall take 5 days of annual leave; those who have completed 10 years and less than 20 years shall take 10 days of annual leave; and those who have completed 20 years shall take 15 days of annual leave.

Wang Yan held that the number of annual leave days stipulated in the above regulations was in line with the level of China's economic and social development at that time. However, in the past 12 years, with the economic development of our country, all aspects of social life have undergone tremendous changes, and the number of days stipulated in the regulations has not fully adapted to the current social needs.

She believes that the number of paid vacation days for employees currently stipulated in China has a big gap compared with other countries in the world, and with the comprehensive construction of a well-off society in 2020, people's pursuit of a better life is growing, and the number of vacation days that the people should have more to match.

"Under the existing rules, the number of paid leave days enjoyed by 1 year of service and 9 years of service is the same, and the number of paid vacation days enjoyed for 10 years and 19 years of service is the same." Wang Yan believes that as an important treatment of leave benefits, the age gap of 8 years of employee treatment is exactly the same, many grass-roots workers put forward this provision is unreasonable, but also contrary to the whole society advocate labor, respect for labor spirit.

She pointed out that most of the employees with less than 10 years of service are between the ages of 25 and 35, during which most people have to complete life events such as marriage and children, and the demand for vacation is relatively large. In addition, with the improvement of people's living standards, the demand for leisure entertainment and cultural tourism is growing, and the number of holiday trips has reached a new high. Young people under the age of 35 prefer personalized travel methods such as independent travel and net red punching, but because the number of annual leave days is too small, 5 days of annual leave, in addition to emergency consumption, it is difficult to meet the needs of long-distance travel. Middle-aged people over the age of 40 consider the needs of the whole family to vacation together, and prefer the way of "accumulating holidays to concentrate on leisure", and this group also hopes to have more "free and flexible paid leave" to facilitate their own disposal.

What are the benefits of increasing the number of paid vacation days? Wang Yan believes that the vacation can alleviate the pressure caused by the long-term tense work of employees, and put into production work in a better state after returning to work, effectively improving work efficiency.

"Judging from the current implementation of paid leave, private private enterprises and individual industrial and commercial households have not fully implemented or even no annual leave system at all, although employees taking less or no paid leave will bring some short-term benefits to employers and enterprises, but in the long run, the negative impact on employees' physical and mental health and work efficiency will offset this short-term benefit." In the long run, the gains outweigh the losses. In her view, good labor security and more vacation benefits are of great significance for enterprises, especially private enterprises, to attract and retain high-quality talents, enhance competitiveness, and maintain long-term healthy development.

Secondly, increasing the number of paid vacation days is conducive to promoting the benign development of tourism. Wang Yan pointed out that because only long consecutive vacations such as the Eleventh and Spring Festival are suitable for travel, the people of the whole country have concentrated on vacations and travel in groups, which has brought huge supply pressure to civil aviation, railways, highways, urban construction, commerce, scenic spots, accommodation and other departments, resulting in a decline in service quality and poor tourist experience. Through the appropriate increase and effective implementation of the number of paid vacation days, the cultivation of a well-off vacation lifestyle for the whole people, people freely choose the time and place of travel, objectively can play a role in diverting the concentrated tourist source in a short period of time from space and time. This will not only alleviate the huge pressure of the tourism departments during the holidays that they "can't eat", but also solve the problem of "not having enough to eat" in the tourism departments because of the small number of tourists, so as to promote the full use of tourism resources and achieve the effective allocation of resources.

"Having the right leave is good for the country, businesses and individuals, and it's a win-win move." Wang Yan suggested that the provisions on the number of annual leave days in article 3 of the current "Regulations on Paid Annual Leave for Employees" be revised, the number of paid annual leave days should be increased according to the length of service, and the upper limit of annual leave days should be changed to 20 days.

At the same time, she proposed to increase the publicity of the laws and policies of paid annual leave for employees, strengthen the construction of the employer's vacation supporting system, actively promote the post multi-functional worker and ab corner system, and constantly improve the employee leave guarantee system, so that the work is continuous and orderly.

In addition, the labor and social security department strengthens supervision over the implementation of the paid leave system, urges employers to perform their statutory obligations to implement the paid annual leave system for employees, introduces incentive policies, rewards units that have implemented well, and promptly investigates and punishes illegal acts found in accordance with the law.
