On August 2, 2017, at the end of April, Beijing issued a trial opinion to regulate and encourage the development of shared bicycles, and the contradiction between the random parking and littering of shared bicycles in subway stations, popular business districts and traffic arteries that have been criticized by citizens is gradually alleviating. However, because the above opinions do not clarify whether shared bicycles can be parked in the community, there are no norms and rules for the current community parking problem, after the evening peak, a large number of citizens ride shared bicycles into the community, which has a serious impact on the security and management order of the community.

Recently, the reporter visited a number of communities in Chaoyang District and found that most property companies have issued a "ban on sharing bicycles" in order to strengthen management. However, in the process of implementation, the measure has not had sufficient legal basis, which has led to resistance and dissatisfaction among some shared bicycle users. How to manage the shared bicycles in the community has become a common problem faced by properties, residents and operators.
At 8 p.m., the reporter saw in the affordable housing community near the East Fifth Ring Road that a large number of owners rode shared bicycles into the community and stacked the cars in the middle of the street garden aisle and the entrance of the unit building. Previously, in front of Building 6 of the community, three-wheeled electric vehicles, motorcycles and private bicycles had been stacked. Some broken sofas and decoration waste have not been cleaned up, and after the shared bicycles are parked here, the traffic space of the citizens has become more limited. At 9 p.m., a taxi dropped off guests in front of the building, just two meters to the east, the right side of the car crashed into a small blue car, the driver master got out of the car to check, and then had no choice but to leave.
According to Mr. Li, a disabled person in the building, when he drove an electric wheelchair to take the barrier-free passage, he found that there were 3 small yellow cars in the passage, but he could not get down to move the car. Eventually, he waited in place for half an hour to catch up with an enthusiastic young man who had just left the night shift, and then returned home.
In the Ganlu Qingyuan on Chaoyang Road, Ms. Chen, a resident, also has objections to the parking of shared bicycles in the community. She said that every evening, the community piles up nearly 100 shared bicycles. When she takes out the garbage at night, she must turn on the flashlight or she will tripped over the shared bicycle.
Shared bicycles impact the management order of the community, prompting community managers to intervene in control. Outside the east gate of the No. 8 courtyard of Yaojiayuan Dongli, the reporter saw the notice of "sharing bicycles are prohibited".
The security guard in front of the door told reporters that the number of shared bicycles in the community is so large that the parking chaos has reached the point of "no matter what it does not work." When sharing bicycles is not prohibited, the elderly who do not ride a bicycle feel that the car is in the way, and begin to kick the car and push the car, but the young people feel that it is convenient to ride to home, and the two parties have contradictions. Later, the security guard moved the bicycle outside the community every night, giving up the public space. "But the young man is even less dry, I just moved out, he moved back, quarreled several times, almost started."
Later, due to the more complaints from the owners, the property leaders decided to ban the community from sharing bicycles. As soon as the notice came out, most of the owners responded, and everyone consciously parked the car outside the courtyard, and the security guard helped to swing the car. However, there are still 20% of the owners, who belong to the "dead or alive do not obey the management". When the reporter interviewed, he personally saw someone riding a bicycle into the community, and when the security guard came forward to block it, the other party scolded back: "What right do you have to stop the car, are you supposed to manage it, are you a policeman?" ”
The security guard admitted that the impact of the conflict with the owner was very bad. Therefore, when he encounters people who do not listen to advice, they are waiting for the other party to go home, and then he silently pushes the car outside the door. "Although it is not my job to manage the car, it is not okay to manage it now, no matter what it is, in short, it will not end well."
At present, how do communities deal with shared bicycles? The reporter took Chaoyang Joy City as the center, randomly visited 10 communities within 2 kilometers of the surrounding area and found that in addition to the 3 communities such as Fuhua Homestead, Ganlu Qingyuan and Yacheng Yili, which were not banned from sharing bicycles, the remaining 7 communities such as Chaoyang Garden, Chaoyang Yazhu, Swan Bay, and Yaojiayuan Xili No. 2 Courtyard all posted the prohibition notice made by the property. A security guard in the No. 7 courtyard of Yaojiayuan Dongli revealed that the hospital has just been banned, which is late, and "other communities have already done this."
Mr. Li, a trainer in the property management industry, told reporters that in the past six months, many property managers have discussed whether to prevent shared bicycles from entering the community. At the beginning, everyone had concerns, thinking that there was no policy support and the property had no law enforcement power, but in the past month, the community has gradually become a consensus to ban shared bicycles. Mr. Li said that in the Baihuan Home Community where he lived, because there was no car separation, the owner had an opinion. After the appearance of shared bicycles, the green space and aisles in front of the building and the aisles are full of cars, and there are also cars in the corridors." Mr. Li believes that "in order to take care of the interests of the majority, the property should intervene when it is time to intervene".
Although the draft opinion does not explicitly stipulate whether shared bicycles can enter the community, the reporter found that shared bicycle companies prohibit users from using cars in the community. This move is clearly reflected in the user guide content of Mobike, Little Yellow Bike, Little Blue Bike and Cool Bike. So why do people still violate the rules of use and ignore the security guards and insist on riding the car home?
A property owner who lives in Tiantongyuan said on Weibo that the community she lives in is very large, and there is a "last kilometer" travel difficulty problem inside the community. And the lighting of the community is not good, cycling to the night road, you can go home quickly.
A number of security guards told reporters that the owner insisted on cycling home, more because he wanted to take a few steps less, and he was worried that the car was parked outside the community and it was inconvenient for him to find a car in the morning. There is also a reason that the community is a high incidence of bad behaviors such as encroaching on shared bicycles and giving private locks to the car. On the afternoon of June 12, the reporter reported to a security guard in the courtyard of Yaojiayuan Xili That there were citizens riding bicycles to play with children in the garden of the community, and after the security guards pushed the car away, the reporter saw that the number plate of the small yellow car had been removed, and the two-dimensional code was also smeared.
Some insiders told reporters that the "car ban order" of the above-mentioned community is a spontaneous act and has not been supported by the legal and administrative levels, but in the context of the disorder of sharing bicycles in the community, it is a "transitional method".
Chen Fengshan, an expert on owner rights protection, believes that if the administrative organ prohibits shared bicycles from entering the community, then the property company's implementation of the "car ban order" is beyond reproach. However, the government has not yet stipulated it, so when the property "bans the car" on its own, it must avoid the "one-size-fits-all" approach. He introduced that in the current context, in the community where there is no industry committee, the property can take the lead in "banning cars". But the community with the industry committee is worth exploring. If the owner raises objections to the car ban, the property should suspend the measure and notify the property committee of the opinion. In accordance with the rules of procedure and the customs of community autonomy, the property committee will widely absorb the opinions of the owners and seek support and understanding by voting or posting publicity.
Li Junhui, a special researcher at the Intellectual Property Research Center of China University of Political Science and Law, believes that the government is not suitable for regulating whether shared bicycles can be used in the community, because the public space in the community belongs to the owners. How to use the public space should be decided by the owner. However, although the government's guidance cannot be "killed with a stick", the basic parking rules still have to be there. In this way, districts, counties, streets, and communities have the basis to formulate management rules and balance the relationship between all parties.
In response to the controversy caused by the "ban order" in the community, Li Junhui suggested that the conditional community can negotiate with the owner to open up an area dedicated to parking shared bicycles, "users park at night, ride the car away in the morning, and the land can restore its function during the day." In addition, for communities or streets that are unable to manage shared bicycles, they can actively cooperate with shared bicycle companies to let the operation and maintenance personnel clear the cars in time.
Li Junhui said frankly that although the development of shared bicycles benefits people's livelihood, citizens are encouraged to travel with low carbon. However, as a company, the vehicle operator is still using public resources free of charge and carrying out business activities. "Some brands blindly invest in cars, seize the market, and avoid urban management problems." He suggested that shared bicycle companies should make more efforts to guide the areas where vehicle parking contradictions are concentrated through technology and manpower. The community environment is good, the user's cycling experience is good, and ultimately it is also a good thing for the enterprise.
