Three types of key cases are subject to review of the necessity of detention

Beijing, 8 Jul (Xinhua) -- The Supreme People's Procuratorate recently announced that since 1 July, the Supreme People's Procuratorate has organized a special activity to review the necessity of detention in procuratorial organs across the country for a period of six months. The special activities mainly aim at the prominent problems in practice, such as the excessive detention rate of misdemeanor cases, the arrest of crimes, the end of one detention, and the production and operation of cases involving private enterprises due to unnecessary detention, as well as the problems behind detention that do not meet the needs of high-quality economic and social development, such as the use of detention instead of investigation, the substitution of detention for punishment, the false placement of social risk standards, and the formalization of the review of the necessity of detention, etc., and determine the selection of three types of key cases to carry out a full-process, full-coverage review of the necessity of detention.

The three types of key cases selected for special activities include cases of detention in which the statutory sentence is less than three years in prison, cases in which crimes involving the operation of private enterprises are being handled, and cases in which criminal suspects, defendants, their legally-designated representatives, close relatives, or defenders submit applications for review of the necessity of detention.

According to the unified deployment, local procuratorial organs need to combine the actual situation, clarify the leading departments and division of responsibilities, formulate a detailed implementation plan, and sort out and investigate the above three types of cases before July 1 to find out the bottom number. In pending detention cases, a review of the necessity of detention is to be carried out ex officio.
