But suddenly one day, the parents of the former school students suddenly went to the school to find the princess, and what happened in the original school gradually resurfaced...

Event procedure

In January 2004, a female middle school student (2nd grade of middle school, 14 years old) in the center of Ulsan Metropolitan Area pressed a wrong number when contacting her friend, and called a men's college in Miyang City, and the temptation of male high school students to say "your voice is very good" and "This is fate, Heaven let us hear each other's voices". Then pretend to be friends with each other, and directly invite the girl to come out and meet her friends.

A few days later, the 13-year-old sister and 16-year-old cousin went to Miyang, and the male students of Miyang introduced them to the leader of the "Miyang Union", a bad group composed of three schools in Miyang.

The chief took 10 men and dragged them to a humble hotel and beat them up, taking turns.

After getting the handle of the girl (photos during the violence process, real name, school class, residence address, etc.), the blackmail was sent to the Internet, repeated threats, in the hotel, in the "sauna", in the bus where the university sports were not, in the park. Rough play with tools, take turns having relationships, rob money and belongings, and suffer for up to a year.

The female student was sent to the gynecology department because of her physical abnormalities after being insulted by rough tools (sexual aids), and in August she could not stand the mental aspect and committed suicide by taking sleeping pills. After falling into a coma, the mother called the police after seeing that her daughter's condition was abnormal.

On 7 December 2004, after taking control of 41 male students, the police applied for arrest warrants against 17 of them, the main suspect and 24 of the other suspects.

Violations of the human rights of victims

Arrest warrants were issued on 11 December for 12 of the suspects on charges of "suspected special rape".

During the investigation, the police found that two middle school students in Changwon City were also suspected of being forcibly violently assaulted by 20 people in the same way. There should be more than so many victims in every way!" The cry. After further detailed investigation, the number of perpetrators rose to 70.

On May 17 of the following year, although various suspicious points were investigated, only 41 suspects and 3 victims were issued, and the rest of the evidence was good and could not be confirmed." " notice.

Later, the police received the testimony of the victim and continued to investigate the perpetrator's family's threatening behavior against the victim's three female students in the course of the investigation of the incident.

Violations of the human rights of the victims of this incident

The Ulsan Southern Police Station has been investigated for "not protecting female middle school students in the first place" during the search, and it has been determined!

On the afternoon of the seventh day of the investigation, the perpetrator's family within the police station used various ways to coerce the police officers who investigated the incident at the police station!

During the police investigation, the victim's request for a female police officer to investigate all aspects of his body was ignored, and in this investigation and confrontation, the perpetrator was excited to threaten and even insult the victim on the spot.

Moreover, some local police officers have a rude attitude towards the victims, saying that the victims are "the shame of Miyang" and other insulting "tyrannical statements" have been confirmed and judged.

The local police, after confirming the appearance of the perpetrators, asked many male high school students, including the perpetrators, to stand in a horizontal row and asked the female middle school students to confirm one by one face to face, and asked the perpetrators on the spot to ask "Is there him?" "Did he insert it?" Didn't he insert it? " and other issues. The victim does not feel protected at all, but instead feels a great sense of shame and fear of retribution.

On 13 December, the National Human Rights Commission conducted an investigation into human rights violations in the course of the investigation into the incident, searched for evidence of the victims' improper investigations, and all 29 testimonies so far have been exhorted improvements and guidance on methods. However, the effect was not obvious, and repeated spot checks were issued to the investigation process at any time. Finally, during a meeting with journalists from the Ministry of Women of the Republic of Korea, the facts of the police's foul language and behavior and inadequate protection of victims were revealed.

After this incident, in order to prevent another human rights violation, the Department of Education's long-term response plan to deal with sexual assault and sex education was announced in front of the media, and the local Ulsan women's group and people from all walks of life formed the "Group Atrocity Incident Special Countermeasure Committee" to protest and visit the southern police station in Ulsan to promote a thorough investigation of the truth.

Later, the Southern Police Department of Ulsan acknowledged the atrocities and atrocities against the victims. The Commissioner of Police publicly apologized. On the 14th, the Ulsan Police Agency confirmed the issue of the investigation of the police's violation of the victim's human rights and the fullness of the Ministry of Protection. The chief of police is punished, the person in charge of the case (section chief), the relevant cadres are punished, and the principal responsible person in the case is punished (dissuaded).

During the investigation, it was found that 8 days after major media reported the incident, at about 5 a.m. in the karaoke in Ulsan City, four police officers used the victim's real name to publicly complain about "real trouble" and "too shameful" while drinking in karaoke in Ulsan City, which directly led to the flow of personal information from the victims.

The police admitted that the statements of the despised victims were facts, and after the disciplinary committee's deliberations on the relevant police, they publicly issued a revision of the initial announcement of the Ulsan Police Agency, changing the youngest sister (13 years old) who was only beaten in the face to 3 people who were all repeatedly violated. The ruling party set up a fact-finding mission to send another investigation to Ulsan.

On the 13th of the same month, the Southern Police Station of Ulsan and the Miyang Police Department jointly processed the true and false information of the victims circulating on the Internet, as well as the true and false pictures. When the announcement of the investigation and punishment of the institutions that leaked out the real information was published, the online reaction was very fierce. The victims whose photographs were published were greatly injured. Police impose penalties on those who publish real photos and falsify photo information.

On December 16, the Supreme Prosecutor's Office sent the Ulsan District Prosecutor's Office to investigate human rights abuses at the Southern Police Station in Ulsan. The Ulsan District Prosecutor's Office formed a special search team, and the leader of the search team said that "it is as if it were a normal case without discrimination, but everything had to be reconfirmed" for the purpose of investigating the contents of the police human rights violation case and making it public.

In the hasty investigation of the case, it was finally decided that the police compensated the victim for damages for the illegal act of losing personal information such as the victim's residence, family, school, etc., but on the issue of human rights violations during the search, the evidence was insufficient because the scale of the violation could not be confirmed

Victims after the investigation of the incident

For the victims, the most serious physical and mental injuries are the great impact in South Korea after the incident was exposed, and the rough law enforcement such as face-to-face confrontation with the perpetrators, including the male police in order to investigate the detailed interrogation incident, the process must be ashamed and describe the details in detail.

The procuratorate's prosecutorial team did the same, in the name of investigating reconfirmation. Such atrocities were carried out not once or twice but during long-term interrogations, and the victim said: "It is very unacceptable to be interrogated again and again like a prisoner, as if I were helping the perpetrator's side." ”

When the victim is slightly vague in his response to the interrogation because of fatigue, he will be asked, "What you answer is different from your sister's answer, is what you say true?" ”

I was also asked, "Why haven't other people been violated, and why are you?" "If you have encountered such a thing because of something else, why would you still have Miyang?" Why, exactly? "Victims are often asked these biased questions.

The victims moved to Seoul after a exhausting investigation and were hospitalized on 3 January 2005 for psychiatric treatment, where the doctor diagnosed him as "having a strong suicidal urge coupled with a strong fear of the outside world and not being able to leave the hospital for treatment." "Symptoms are stress disorder after excessive sadness, depression, external phobia, autism, anorexia, etc.

Her wish is that "everything that has happened so far will just disappear after a good night's sleep." "Can't forget anything?" I'm going to slowly forget all this. ”

After continuing to be bullied in all schools in Miyang And Ulsan Metropolitan City, schools and society in Seoul ran away from home after being treated coldly.

The male students who were involved in the perpetrators were not subjected to special punishments, not even recorded previous convictions, and all returned to ordinary lives. (MBC TV broadcast real-life situations on June 16, 2007.) )

In March 2005, the victim was still receiving psychiatric treatment in Seoul, the father and the relatives of the perpetrator agreed to settle in court after discussing the amount of compensation, the victim's family asked to sign the letter of agreement every day, from morning to night, and the victim's relatives also persuaded her to sign the letter of agreement, she said: "I never thought of reconciliation, but my aunt and father wanted me to reconcile, because the perpetrator hated us, we were very poor, we left this place, and finally reconciled, but after the reconciliation, the attitude of the other family changed rapidly, but it was even more ridiculed." Insult, if I can go back to that time, I will never reconcile, never sign! ”

Her father received 50 million won (290,000 yuan at September 27, 2014, about 410,000 yuan in 2005) and spent 15 million won to rent a house in Ulsan, and the rest was divided among relatives who persuaded the victims to reconcile.

The victim was treated for psychiatric treatment at the hospital, and his physician, Professor Kim Wai-joon of Yonsei University, said: "She was taken advantage of by the world. "Protection is far from enough." and so on to harshly criticize this society. He observed that when he was discharged from the hospital, her father had been severely poisoned by alcohol because of long-term drinking, and the person was not very sober. Repeated persuasion because the guardian has his responsibility, no matter how much protection is necessary. Nor could it prevent my father from forcibly leaving the hospital.

Ulsan city was no longer able to live, no school was willing to accept her transfer application, and finally transferred to a university in Seoul with the help of a lawyer, but within a month, the mother of the perpetrator who was taken in by the juvenile management center rushed to the school to let her sign her child's punishment reduction letter at the juvenile management office, forcing her to the toilet to pester.

She was known to the whole school about the violent sexual assault before she transferred to the school, and was hit hard again, with another episode of depression, accompanied by vomiting, anorexia and other symptoms, and told her mother that she wanted a place where no one knew about her.

On the other hand, with regard to the punishment of the perpetrators, the Ulsan Local Procuratorate took 20 of them as the target of punishment, in order to treat the physical and mental health of the adolescents, 10 perpetrators were not simply punished, and the 10 perpetrators prosecuted by the procuratorate were sent to the Juvenile Department of the Busan Local Family Court, and finally decided that the 5 perpetrators were taken in by the Juvenile Department, and the others were not punished and released.

None of the students who were perpetrators were punished by criminal punishment! The previous crime was not paid, and it returned to society.

MBC Media's column said: "The perpetrators of sexual assault have not changed anything back to ordinary life, there are so many cases of murdered women, in South Korea is a country where prisoners of sexual crimes can live with dignity, judging from the results of the sexual violence case of miyang female middle school students, this is really like a sex offender's paradise!" ”
