Ma Junwen, who was active at the demonstration scene during the Hong Kong legislative amendment storm and called himself "Captain America of the Second Generation," called out the slogan of "Hong Kong independence" during several demonstrations and media interviews last year. The District Court today convicted him of one count of inciting others to divide the country. He will have to be remanded until 11 November for sentencing, during which time the court will obtain a report from a psychologist.
In sentencing, the judge pointed out that whether the defendant took actual action to split the country was not the key to the case, because the defendant was accused of inciting others to split the country, and even if no one responded to the action, it did not mean that there was no intention to incite. The judge held that the defendant repeatedly shouted slogans and interviewed on different occasions, reflecting that the defendant's slogan was not a "fake big void", but a sincere statement of political position and voice, and then hoped that others would agree.
Defendant Ma Junwen, 30, reported unemployment and was convicted of inciting others to split the country. The Court alleged that between 15 August and 12 November 2020, he was involved in 20 different incidents in which he incited others in Hong Kong to organize, plan, carry out or participate in acts aimed at splitting the country and undermining national unity, whether or not by force or threat of force, that is, the separation of the Hong Kong Special Administrative Region from the People's Republic of China, or illegally changing the legal status of the Hong Kong Special Administrative Region.
