According to the website of the Shanghai Municipal Bureau of Market Supervision, the food branch of Shanghai Deda Western Food Co., Ltd. (hereinafter referred to as "Deda Western Food") was recently fined 12,000 yuan for "producing and operating unlabeled prepackaged foods and food additives", and the penalty authority was Shanghai Huangpu District Market Supervision and Administration Bureau, and the administrative punishment decision was No. 012021000719 [2021] of the Shanghai Municipal Supervision and Yellow Division.

According to the decision, on June 3, 2021, law enforcement officers from the Huangpu District Market Supervision and Administration Bureau inspected the Deda Western Food Branch at No. 28 Xinqiao Road, Shanghai. During the inspection, the ceiling of the second floor operation room dripped water, the refrigerator was frosted, the refrigerator door had black mold spots, and flies were found in the unpacking area. The company was found to have a box of "Doppola two-color chocolate rolls 800 grams" placed in the refrigerator of the company's mounting room, and its label read "Production date 2019-04-29 Shelf life (to) 2021-04-29".
Law enforcement officers found a box of lactose (coffee flavor) at the operating table in the company's operation room, and the outer box was not marked with the date of production and shelf life. Law enforcement officers inspected the company's finished product factory inspection report, found the most recent report time is May 25, 2021, did not check the inspection report after that date, and after preliminary investigation, the company has not inspected the food produced since May 26, 2021. The company's food additives inspection records were not found at the scene.
It is understood that on November 8, 2020, Deda Western Food Branch purchased a box of "Doppola two-color chocolate rolls" (net content: 800 grams, production date: 2019-04-29, shelf life 2021-04-29, hereinafter referred to as "chocolate rolls") from Shanghai ** Trading Co., Ltd. at a price of 420 yuan per box, stored in the refrigerator between the mounting flowers. From November 8, 2020 to December 31, 2020, the company used the above chocolate rolls as decorations for the research and development of new product specimens, and the above chocolate rolls have not been used after the failure of research and development. Up to the time of the case, the Deda Western Food Branch had not conspicuously marked the chocolate rolls that had exceeded their shelf life, nor had they been stored separately in a clearly marked place to be destroyed. On June 22, 2021, the company destroyed the chocolate roll involved in the case.
The Huangpu District Market Supervision and Administration Bureau pointed out that the production date and shelf life of a box of boletose (coffee flavor) stored in the operation room of Deda Western Food Branch were not marked with the production date and shelf life, and the behavior of not labeling on the prepackaging bag in the box violated the provisions of Article 34 (11) of the Food Safety Law of the People's Republic of China and constituted the production and operation of unlabeled prepackaged food.
The second floor operation room ceiling drips, the refrigerator frost, the refrigerator door has black mold spots, and there are flies in the unpacking area. Violation of the provisions of items (1) and (2) of the first paragraph of Article 33 of the Food Safety Law of the People's Republic of China constitutes an act that does not meet the requirements in the process of food production and operation.
Since May 26, 2021, the company has not carried out the inspection of microbiological items for the food it produces, and the behavior of the food leaving the factory without issuing a finished product (factory) inspection report violates the provisions of Article 52 of the Food Safety Law of the People's Republic of China, constituting the failure of the food producer to inspect the food produced in accordance with the regulations; the failure to establish the purchase inspection record of food additives as required violates the provisions of the second paragraph of Article 50 of the Food Safety Law of the People's Republic of China.
Failure to conspicuously label the "Doppola two-color chocolate roll" that has exceeded its shelf life, nor to store it separately in a clearly marked place and take measures such as destruction, violates the provisions of Article 29, Paragraph 1 of the Regulations on the Implementation of the Food Safety Law of the People's Republic of China, and constitutes the failure of food producers and traders to label or store spoiled, expired or recycled food in accordance with regulations.
In summary, the Huangpu District Market Supervision and Administration Bureau ordered deuterta Western Food Branch to immediately correct and punish as follows: first, warning; second, fine of 12,000 yuan.
