Recently, the Housing and Urban-Rural Development Bureau of Fuzhou City, Jiangxi Province notified 10 typical cases of illegal construction in the city. Among them, 1 case of collusion in bidding, 1 case of illegal subcontracting, and 8 cases of lending qualifications and affiliation with individuals.

Lending qualifications, affiliated with individual cases

Notify 8 companies of lending qualifications, relevant personnel bid and won the bid, there are illegal acts of lending qualifications and subcontracting. Thereinto:

• 5 companies lent qualifications to the same 2 people - Jie Mougui and Ye Mouming
• 3 companies lent qualifications to the same 3 people - Jie Mougui, Peng Mougui, and Li Mouping
• 1 company lent qualifications to Jie Mougui and Peng Mougui.

Everyone has noticed that the same person is involved - Jie, and the 8 projects that bid and won the bid are all school projects, with primary schools being the majority, followed by kindergartens and middle schools.

1. In January 2015, Jie Mougui, Ye Mouming and other two people borrowed the qualification of Jiangxi Jin* Road and Bridge Engineering Co., Ltd. to participate in the bidding of the Yanglin Teaching Building Project in Baishe Town and won the bid.
2. In August 2016, Jie Mougui, Ye Mouming and other 2 people borrowed the qualification of Ganzhou Ningxia Construction Engineering Co., Ltd. to participate in the bidding of Taiyuan Township Slang Comprehensive Building and Hydropower Project and won the bid.
3. In January 2015, Jie Mougui, Ye Mouming and other 2 people borrowed the qualification of Jiangxi Yi* Construction Engineering Co., Ltd. to participate in the bidding for the renovation project of the school building in the center of Baishe Town and won the bid.
4. From 2015 to August 2018, Jie Mougui, Ye Mouming and other two people borrowed the qualifications of Jiangxi Tian* Construction Engineering Co., Ltd. to participate in the bidding for the comprehensive building project in Baishe Town and won the bid.
5. In August 2016, Jie Mougui, Ye Mouming and other two people borrowed the qualifications of Jiangxi Guang* Construction Co., Ltd. to participate in the bidding of the Taiyuan Township Comprehensive Building and Hydropower Project and won the bid.
6. In March 2017, Jie Mougui, Peng Mougui, and Li Mouping borrowed the qualifications of Jiangxi Nan* Construction Co., Ltd. to participate in the bidding for the construction project of Shagang student dormitory in Shishan Town and won the bid.
7. In July 2018, Jie Mougui, Peng Mougui, and Li Mouping borrowed the qualifications of Ganzhou Ming * Water Conservancy Construction Engineering Co., Ltd. to participate in the bidding of the Taiyuan Township Center Project and won the bid.
8. In July 2017, Jie Mougui, Peng Mougui and other 2 people borrowed the qualification of Jiangxi Zhong*da Construction Engineering Co., Ltd. to participate in the bidding and won the bid for the Lujia comprehensive building and retaining wall project in Taiyuan Township.

8 companies were fined a total of 454,650.9 yuan, of which 2 companies were not allowed to apply for enterprise qualification upgrades and additions within 1 year from the date of issuance of the notice, and 5 people were fined a total of 68,197.7 yuan.

Bid-rigging cases

The two companies were notified that the bidding document production machine code and the uploaded IP address were the same, and after filing a case for investigation, it was determined that the two companies' actions constituted illegal collusion in bidding.

The two companies were fined 92,746.12 yuan respectively, and the directly responsible supervisor was fined 4,637.3 yuan respectively, for a total fine of 204,041.44 yuan.

Illegal subcontracting

One company won the bid for the project, and during the construction process, it was found that the personnel in key positions did not show up to perform their duties, and there was illegal subcontracting, involving an amount of 12.6285 million yuan, and the company was fined 63,142 yuan.

In summary, a total of 790,032.04 yuan was fined in 10 cases.

1. The case of collusion in bidding between Nancheng County Construction Engineering Company and Jiangxi Provincial Construction Engineering Co., Ltd

On July 29, 2021, Nancheng County Construction Engineering Co., Ltd. and Jiangxi Fang* Construction Engineering Co., Ltd. participated in the bidding for the renovation project of Yihe Garden, the old fire brigade and Qinghuatang (Huangyuan Garden, the former dormitory of the Water Protection Bureau) in Guangchang County, Fuzhou City. In December 2021, the Housing and Urban-Rural Development Bureau of Guangchang County, Fuzhou City, filed a case and investigated the two companies, and determined that the two companies' actions constituted illegal collusion in bidding.

Result: On April 18, 2022, the Housing and Urban-Rural Development Bureau of Guangchang County, Fuzhou City, imposed a fine of RMB 92,746.12 on Jiangxi Provincial Fang* Construction Engineering Co., Ltd., a fine of RMB 4,637.3 on the directly responsible supervisors You and Luo, a fine of RMB 927,461,200 on Nancheng County Construction Engineering Company, and a fine of RMB 4,637.3 on Luo and Zeng, who were directly responsible for the construction engineering company.

2. Case of illegal subcontracting of Jiangxi Zhong* Construction Co., Ltd

In March 2021, Jiangxi Zhong* Construction Co., Ltd. won the bid for the Zixi County People's Hospital Renovation and Upgrading Project (Infection Building Construction) Project, and during the construction process, it was found that the personnel in key positions did not show up to perform their duties, and there was illegal subcontracting, involving an amount of 12.6285 million yuan.

3. Jiangxi Jin* Road and Bridge Engineering Co., Ltd. lent qualifications and affiliated individuals

In January 2015, Jie Mougui, Ye Mouming and other two people borrowed the qualification of Jiangxi Jin* Road and Bridge Engineering Co., Ltd. to participate in the bidding for the teaching building project of Yanglin Primary School in Baishe Town and won the bid.

7. Jiangxi Guang* Construction Co., Ltd. lent qualifications and affiliated individuals
