"Teacher Wang, Ala has been leaking upstairs, can you help me?"

"Director Wang, my ex-husband won't let me see the child, what should I do?"

"Teacher Xiaoxia, I read the advertisement saying that it is discounted, how can I calculate the money wrong? I'm going to complain about them! ”

……

Wang Lixia is one of the 17,340 people's mediators in Shanghai, and has been engaged in people's mediation for 13 years, from a white-collar worker in a foreign company to a "little uncle" in the mouth of residents. From being confused about mediation work, he has grown into the vice president of the Shanghai Yangpu District People's Mediation Association, the director of the Yangpu Bingzhirong Legal Service Center, and the establishment of the "Wang Lixia Mediation Studio" named after himself, Wang Lixia has witnessed the changes and development of people's mediation work.

Recently, a reporter from Labor Daily walked into the Yangpu District People's Mediation Association, apprenticed with Wang Lixia, a mediator, and felt the ups and downs of mediation work with her.

White-collar workers of foreign companies have become young "old uncles"

At half past eight in the morning, the first thing Wang Lixia did when he arrived at the office was to open the smart mediation platform to see if there was any information on pending cases. "After the establishment of the Yangpu District Non-litigation Dispute Resolution Center, our 'Bingzhirong' Legal Service Center has also been incorporated into the smart mediation platform, where parties can submit mediation applications online if necessary, and consumer disputes, marriage and family disputes, and doctor-patient disputes will be pushed to us." Wang Lixia said.

On January 1, 2011, the People's Mediation Law of the People's Republic of China was officially implemented, and Wang Lixia became a people's mediator in that year. "In order to take care of my family, I resigned from a foreign company and transformed into a grassroots community worker, only to find out that there were so many disputes in the community, so I began to study law on my own, devote myself to mediation, and become an 'old lady' of the post-80s." Wang Lixia said that now she and her team members have to accept and mediate about 600 or 700 conflicts every month, and are busy "putting out fires" and resolving disputes.

Among Wang Lixia's parties, there are anxious brides whose wedding banquets were canceled due to the epidemic but had no way to get refunds, doctors and patients who had fierce disputes, workers who were laid off by the company, and young couples who were caught in the vortex of divorce...... "In the past, there were mainly neighborhood disputes, but now mediation is becoming more and more professional, including medical disputes, consumer disputes, property disputes, traffic accident disputes, intellectual property disputes, labor disputes and other categories. "The free and fast mediation work has been recognized by more and more people, and many cases that were originally to be "seen in court" have been resolved before litigation.

On May 1, 2021, the "Regulations of Shanghai Municipality on Promoting Diversified Conflict and Dispute Resolution" was officially implemented, further building a "grand mediation" pattern. At present, the city's 16 districts have fully established a non-litigation dispute resolution center, Shanghai has also pioneered the "dispute resolution" platform, the first batch of more than 6,700 mediation organizations settled, as long as the public submits an application with the application, the conflict and dispute will be automatically matched with the mediation organization, generally a working day, there will be a mediator "order".

"There are two new cases today, and we will first communicate with the parties on the phone to discuss the specific facts of the case and make an appointment for mediation." Wang Lixia opened his notebook, wrote down key points while listening, and sorted out the context of the case. "Unlike working in a foreign company at that time, now I work every day to deal with the people, whether it is a trivial matter between the neighbors or a housework that is difficult to be decided, we must take the trouble to listen patiently and find out the crux of the problem." Wang Lixia said that the general mediator needs to complete the mediation work within 30-60 days, and the desk preparation is very crucial. "Once the case is straightened out, mediation is the first step towards success."

Three magic weapons of mediation work: the law of reason

"Is there any magic weapon for mediation?" Facing the reporter's inquiry, Wang Lixia said with a smile: "Of course there is, and it is simple to say, it is the three words 'reasonable law', but in each case, we have to think carefully about how to use it." ”

"Mediation according to law, moving people with emotion, and persuading people to resolve disputes with reason" is the principle of people's mediation work, full of warmth in feelings, fairness in reason, justice in law, more than 10 years of mediation work to Wang Lixia's biggest feeling is that only by understanding the law, understanding the policy, and understanding the people's feelings, can we resolve disputes and do a good job in the work of the masses.

Wang Lixia talked to reporters about a thorny dispute. "A young couple divorced, after the two parties separated, the woman went back to her mother-in-law's house to visit her 4-year-old daughter, but the husband just didn't open the door, and the police had no choice. The parties are not divorced, and it is difficult to obtain judicial relief for marital visitation rights, what do you do if you deal with this case? Seeing the reporter thinking hard, Wang Lixia went on to say that the key point of this case is the divorce dispute, and the husband and wife are determined to divorce, so don't mention the children first, and solve the divorce problem first.

Wang Lixia asked the man out to communicate on the grounds of mediating the divorce. "Court litigation for divorce is time-consuming and labor-intensive, but through mediation, you can save time and money." Under her persuasion, the man accepted the mediation divorce, and Wang Lixia brought up the issue of the child's visitation rights, and the two parties signed an agreement to let the woman pick up the child at a fixed time every weekend.

"The case is not over yet." Wang Lixia said that she later received a call from the woman, "My husband repented, and he said that his in-laws would not let me pick up the child." Wang Lixia immediately called the man again to do ideological work. The child is yours, you are a big man, don't use your grandparents as an excuse......" The next day, Wang Lixia accompanied the woman to pick up the child, and in the evening accompanied her to send the child back.

Wang Lixia's patience and kindness deeply touched the two parties, and finally, under her coordination, the two parties gave up the lawsuit and took the agreement drafted by Wang Lixia to the Civil Affairs Bureau to go through the divorce procedures. The whole mediation process not only solves the family disputes of the parties, but also avoids the burden of litigation between the two parties, and relieves the pressure of the court.

There are more and more professional and professional "bride uncles".

In 2023, Shanghai People's Mediation and Social Mediation organizations will accept a total of 692,000 disputes and successfully mediate 468,000 cases, a record high. Shanghai's "old ladies and uncles" have made tremendous contributions to resolving social contradictions and maintaining social stability.

"As the number of contradictions increases, becoming more and more diversified, complex, and diversified, the 'old lady' can't mess with the paste, just apply red potion on both sides to level it out." Wang Lixia said that in the past ten years of her practice, more and more young people and professionals have joined the team of mediators, and the people's mediators have become more professional, professional and younger.

According to data from the Municipal Bureau of Justice, 82% of the 17,340 people's mediators in Shanghai are of working age; Among the people of working age, 86% have a college degree or above, including 296 master's and 22 doctorates; Among the retired mediators, there are also a considerable proportion of judges, prosecutors and other highly educated professionals.

"A few days ago, the first People's Mediator Skills Competition in Shanghai was launched, which is really good news." Wang Lixia said: The work of people's mediators has been recognized and valued more and more, and their hearts have become more energetic. "Our professional skills and business level have been improved, so that we can better serve the people."
