Case-guided reconciliation method, that is, multiple parties search for similar effective cases, determine the direction of adjudication that can be referenced, and promote reconciliation by explaining cases.
The 8 cases were all disputes arising from the fraudulent use of ID cards to register and establish enterprises, and the settlement work was carried out as soon as the litigation procedure was entered, and the undertaking judge searched the cases, summarized and sorted them out, and communicated with the mediator to determine the direction of settlement. After that, the conciliator contacts the administrative counterpart and the administrative agency to determine the settlement intention and plan based on the case analysis, and through the effective cases and explanations, both parties recognize and reach the settlement intention.
With the joint efforts of the judge and the mediator, the eight cases were substantively resolved, and the parties shook hands and were very satisfied, and expressed their gratitude to the judge and the mediator on the spot.
The Zhifu District People's Court will "supervision is support, support is supervision" throughout the administrative trial work, give full play to the functional role of administrative trial in promoting administration according to law, and in view of the key area of impersonation registration, which has a high litigation rate, after researching, judging and analyzing the relevant cases, through the government-court linkage mechanism, implement the "point-to-point" linkage model, consult with the judicial bureau and the administrative organs involved, and issue judicial recommendations to the administrative organs involved. The administrative authorities involved in the latter case optimized identity verification and further improved the enterprise registration review process. So far in 2023, the number of litigation cases caused by impersonation registration has decreased by 70% year-on-year.
Since the beginning of this year, the administrative tribunal has successively used the working methods of explaining the law and reasoning, looking at and hearing questions, and guiding and conciliating cases to successfully resolve 20 administrative disputes, achieving the effect of closing the case and achieving a win-win situation.
