The battle for copyright protection has begun, involving millions of articles

The New York Daily News and seven other newspapers sued Microsoft and OpenAI on Tuesday, alleging that the tech giants illegally obtained millions of copyrighted articles to create their cutting-edge generative AI products, including OpenAI's ChatGPT and Microsoft's Copilot. Several news organizations, such as the New York Daily News and the Chicago Tribune, also published stories on the front page of their news pages about their lawsuit against Microsoft and OpenAI.

The lawsuit alleges that the news organization's information was plagiarized. While news organizations spend billions of dollars sending real people to the real places to report on real events in the real world, the two tech companies are stealing their stories for free to create "products that deliver news."

Frank Pine, executive editor-in-chief of MediaNews, said: "We cannot allow OpenAI and Microsoft to continue to steal our work and build their own businesses at our expense. OpenAI and Microsoft's misappropriation of news content has undermined the news industry's business model. These companies are building AI products, apparently to replace news publishers by repurposing our news content and delivering it to users. He then added: "They don't want to pay for content, and without that content they simply don't have a product, which is not reasonable and unfair." ”

Microsoft declined to comment on the allegations in the lawsuit Tuesday morning. OpenAI said Tuesday morning that it was "very cautious" in its product and design process in support of News Corp. An OpenAI spokesperson said: "We are actively building constructive partnerships and dialogues with many news organizations around the world to explore opportunities, discuss issues, and provide solutions. We see great potential for AI tools like ChatGPT to deepen the relationship between publishers and readers and enhance the news experience. ”

It is understood that this is not the first time OpenAI has been sued recently, on April 29, the Austrian non-profit organization European Center for Digital Rights announced that the organization has filed a complaint with the Austrian data protection authority, requesting an investigation into OpenAI, arguing that the artificial intelligence chat tool ChatGPT developed by the company violates relevant EU regulations.

News organizations strive to maintain business models

In the age of the internet, news organizations have struggled to build sustainable business models. And the new generative AI only requires a lot of data extracted from the internet, and the lawsuit alleges that Microsoft and OpenAI are undermining news organizations' business models by "retweeting" their content.

Microsoft and OpenAI responded in February to a similar lawsuit filed by The New York Times in December, saying that claims that generative AI threatens journalism are "pure fiction." The companies argue that "it is perfectly legal to use copyrighted content as part of a technological process that creates a new and different product." ”

The legal principle of "fair use" is at the heart of the Trained Generative AI controversy. This principle allows for the legal reproduction of clips from some books, movies, and songs. Microsoft and OpenAI have previously argued in the New York Times case that it is legal for them to use copyrighted material to train artificial intelligence.

Goldman Sachs said it's unclear whether generative AI apps will copy more text than fair use allows.

The lawsuit shows that the output of Microsoft and OpenAI's products copied parts of the newspaper article verbatim. The lawsuit cites the alleged copyright infringement of a Mercury News article about the Oroville Dam spillway collapse, in which four consecutive sentences, plus another sentence and some wording, are copied verbatim, and no information is provided about the author, title, copyright, etc. of the works.

To add insult to injury, the lawsuit alleges that ChatGPT also fabricated fake articles that could affect the reputation of news organizations, including a fake article about the Denver Post touting smoking as a treatment for asthma, and a fake article about the Chicago Tribune that recommended a baby recliner product that had been recalled earlier because it was linked to a child's death.
