Intellectual property (IP) is at the heart of addressing the global challenges facing humanity and is a powerful catalyst for growth and development, playing a key role in improving people's livelihoods and protecting the planet. World Intellectual Property Day 2024 is an opportunity to highlight the central role that IP, innovation and creativity play in achieving the Sustainable Development Goals for the benefit of all.

What is Intellectual Property?

It is the property right enjoyed by the right holder for the results of his intellectual labor, an intangible property, and the fruits of labor produced by creative intellectual labor. The scope of intellectual property rights is relatively extensive, the three common intellectual property rights mainly include trademark rights, patent rights and copyrights, and intellectual property laws and regulations mainly include the Trademark Law, the Patent Law, the Copyright Law, the Technology Contract Law, etc.

Why protect intellectual property?

For the country: innovation is the first driving force to lead development, and the protection of intellectual property rights is to protect innovation. To comprehensively promote Chinese-style modernization, we must better carry out the protection of intellectual property rights.

For enterprises: enable enterprises to exclusively enjoy the market benefits brought by intellectual property rights, avoid infringement risks, and ensure the safe operation of enterprises.

For individuals: It can mobilize the people's creative enthusiasm and initiative and promote the optimal allocation of social resources.

What are the main infringements of intellectual property rights?

unauthorized use of identical or similar trademarks, distinctive signs, patents, works and other creative achievements in production, business, advertising, publicity, performance and other activities;

Counterfeiting or unauthorized manufacture of identical or similar trademarks or distinctive signs, or selling counterfeit or unauthorized manufacturing of trademarks or distinctive signs;

disguised use of identical or similar trademarks, distinctive signs, patents, works and other creative achievements;

Unauthorized use of identical or similar trademarks, special signs, patents, works and other creative achievements in the registration of enterprises, social organizations, public institutions, private non-enterprise units, and the names of websites, domain names, place names, buildings, structures, places, etc.;

Provide convenient conditions such as venues, warehousing, transportation, mailing, and concealment for infringement;

Other infringements in violation of relevant national laws and regulations.

01 Creation achieves both quantity and quality

32,700 patents were authorized in the province, of which 27,600 were effective invention patents and 1.97 high-value invention patents per 10,000 people, an increase of 25.54% and 23.9% respectively over the same period of the previous year.

The number of valid trademark registrations was 692,600, a year-on-year increase of 10.34%, and a total of 354 geographical indication certification trademarks were registered, including 65 geographical indications for products protected by geographical indications and 86 geographical indications for agricultural products.

109,700 copyright works were registered throughout the year, a year-on-year increase of 112.76%, exceeding 100,000 for the first time. A total of 350 new varieties of forestry plants have been authorized by the state, ranking fourth in the country.

There are 178 major crop varieties approved by the state and 2,941 varieties approved by the provincial level.

02 The whole chain protection is promoted in depth

New progress has been made in judicial protection.

In 2023, with the "Kunlun" special action as the traction, 2,503 cases of infringement and counterfeiting will be cracked, an increase of 39.37% year-on-year, and the value of the case will be 7.19 billion yuan;

Coordinated the four major procuratorial functions, approved the arrest of 54 people in 41 cases of intellectual property infringement crimes, and prosecuted 134 people in 53 cases;

Giving full play to the adjudication function, 6,103 intellectual property cases of various types were accepted, and 5,802 cases were concluded;

Promoted the work of notarization business, and handled 1,130 notarization services for the protection of intellectual property rights.

New achievements have been made in administrative protection.

All departments organize and carry out administrative law enforcement and protection actions for intellectual property rights such as "Sword Network" and "Dragon Teng". 982 trademark cases were investigated and dealt with in the province, a year-on-year increase of 10.71%;

636 patent infringement cases were filed, a year-on-year increase of 274.12%, and 106 administrative cases of infringement and piracy were investigated, exceeding 100 for the first time.

The customs seized 613 batches of suspected infringing goods, involving 312,300 pieces of goods, a year-on-year increase of 10.25% and 33.64%.

New breakthroughs have been made in collaborative protection.

Promoted the implementation of the technical investigator system to achieve "zero breakthrough", and technical investigators participated in 15 cases of judicial adjudication of intellectual property rights and administrative adjudication of patent infringement disputes;

Promote the organic connection between administrative law enforcement and the judiciary, and jointly carry out judicial confirmation of administrative mediation of intellectual property disputes;

Promote online mediation, with a total of 14 mediation organizations and 55 specially invited mediators settled in the people's courts' mediation platform, and 1,914 cases have been mediated.

Successfully applied for the establishment of the Kunming Branch of the National Overseas Intellectual Property Dispute Response and Guidance Center, and continued to improve its ability to prevent and control foreign-related risks.

03 The application efficiency is becoming more and more prominent

The cultivation of geographical indications has been further deepened.

Deepening the pilot reform of the approval of the use of special geographical indications, 144 new business entities for special geographical indications have been added, with a total of 682 and an annual output value of 14.365 billion yuan.

Prepare for the construction of 3 demonstration zones for the promotion of rural revitalization by geographical indications in the province, and support 20 household standard enterprises to implement the "Geographical Indications Application Promotion Project" project, driving thousands of rural households to increase their income.

Strive for special funds to support 28 industries such as Zhaotong apples and Pu'er coffee to implement the "Geographical Indication Agricultural Products Protection Project" project.

The construction of the Muding bean curd and Baoshan small grain coffee national geographical indication product protection demonstration zone is progressing in an orderly manner.

Shangri-La matsutake and Yangbi walnut were selected into the second batch of national geographical indications to promote the use of key contact guidance list, with a total of 8 in the province. Four cases, including Pu'er Coffee, Pu'er Tea, Wenshan Panax notoginseng and Xuanwei Ham, were selected as the second batch of typical cases of geographical indications helping rural revitalization.

Regional brand building was further expanded.

20 trademark brands such as "Yunnan Baiyao", 6 regional trademark brands such as "Jianshui Purple Pottery", and 20 trademark brand guidance stations such as "Baoshan Small Grain Coffee Brand Guidance Station" were included in the first batch of "Thousands of Enterprises and Hundred Cities" trademark brand value enhancement actions of the State Intellectual Property Office.

Accelerate the cultivation of "time-honored" brands, and the Ministry of Commerce has identified 6 brands including "Kunyao" as the third batch of "China time-honored brands".

Build a regional public brand of "Yunnan Mixian", and carry out the traceability of the origin of "Yunnan Mixian" and green food certification.

"Black goat on the cloud" was selected as the leading breed of agriculture in China in 2023, and more than 150,000 breeding sheep have been promoted in Yunnan Province and 21 provinces (autonomous regions and municipalities), with comprehensive economic benefits of 30 billion yuan, and a total of 15,000 poor households have been driven to increase their income and become rich.

The Yunnan special area of the National Geographical Indication Agricultural Products Exhibition and Experience Hall will be built in the National Agricultural Exhibition Center, and the agricultural products with geographical indications will be displayed and sold online and offline.

The transfer and transformation mechanism has been further improved.

Yunnan Province has received special support from the national patent transformation and has been identified as the province for patent transformation awards and subsidies in 2023. During the year, 2,330 patents were transferred and 2,333 were transferred.

139 patent and trademark pledge financings amounted to 1.522 billion yuan, doubling the amount, which were 2.6 times and 2.2 times that of 2022, respectively. The province's first intellectual property securitization project, "The 1st Intellectual Property Asset-backed Special Plan of the 14th Bureau of Hydropower and Hydropower", was issued on the Shenzhen Stock Exchange. 50 patents won the Yunnan Provincial Patent Award.

More than 200,000 intellectual property achievements have been launched on the China-South Asia and Southeast Asia International Technology Transfer Transaction Network Platform, and more than 100 effective technology docking services have been realized.

Colleges and universities in the province have actively carried out the "100 schools and 1,000" high-value patent transformation action.

The pilot demonstration work is further diversified.

There are 14 new national intellectual property demonstration enterprises and 113 advantageous enterprises, and the province has a total of 279 national intellectual property advantages and demonstration enterprises.

The construction of key cities for intellectual property operation in Kunming has been progressing in an orderly manner. 1 pilot city and 3 pilot demonstration counties for the construction of a strong national intellectual property city have been added.

5 provincial-level demonstration counties, 5 demonstration parks, and 130 demonstration enterprises were assessed for promoting high-quality development by intellectual property rights. Organize 60 demonstration enterprises with intellectual property advantages and 21 specialized and new "little giant" enterprises to carry out the first batch of pilot projects for the implementation of international standards for intellectual property rights for innovation management.

Carry out the creation of copyright demonstrations, identify 5 provincial-level demonstration units and 2 demonstration parks (bases), and recommend 9 demonstration units and parks (bases) to the National Copyright Administration.

04 Continuous improvement of service capabilities

The public service system is constantly improving.

15 provincial departments jointly issued the "Implementation Opinions of Yunnan Province on Accelerating the High-quality Development of the Intellectual Property Service Industry" to create a good environment for the development of the intellectual property service industry.

We have accelerated the construction of public intellectual property outlets, adding 8 new trademark business acceptance windows, with a total of 18 establishments, 21 new provincial-level intellectual property information service outlets, with a total of 47 filings, and 14 new copyright service workstations, with a total of 52 built, to achieve "three full coverage" in all states (cities).

Strengthen the identification and construction of export bases for intellectual property services, cultivate new entities for the export of intellectual property services, and promote the upgrading of intellectual property services. Kunming was included in the national pilot project for the construction of a standardized city for intellectual property public services, and the Kunming National High-tech Industrial Development Zone was selected as a pilot zone for the high-quality agglomeration and development of the national intellectual property service industry.

The Kunming Intellectual Property Protection Center accepted 1,572 patent pre-examination applications throughout the year, and 852 were authorized, improving the efficiency of patent authorization. The "Yunnan Copyright Works Registration System" has added a blockchain timestamp storage function to further strengthen the credibility of the work registration work.

The talent base has been continuously consolidated.

73 provincial-level intellectual property leading talents, high-level talents, and practical talents have been identified, and a total of 281 people have been identified.

Do a good job in the evaluation of intellectual property titles, and strengthen the construction of technical personnel in the field of intellectual property rights (economic majors). To promote the popularization of intellectual property education, Dali University and Jinqiao College of Kunming University of Science and Technology have set up intellectual property majors, with 268 students, and 15 new pilot schools for intellectual property education in primary and secondary schools, with a total of 104 schools.

The province has held various trainings on administrative law enforcement protection of intellectual property rights, seed industry protection, and intellectual property trial business, with more than 20,000 participants.
