1. Laws

1. Government Procurement Law

The Government Procurement Law of the People's Republic of China is a law enacted in order to regulate government procurement, improve the efficiency of the use of government procurement funds, safeguard national interests and social public interests, protect the legitimate rights and interests of government procurement parties, and promote the construction of a clean government.

Adopted at the 28th Session of the Standing Committee of the Ninth National People's Congress on June 29, 2002. Amended in accordance with the Decision on Amending the Insurance Law of the People's Republic of China and Other Five Laws at the 10th Meeting of the Standing Committee of the Twelfth National People's Congress on August 31, 2014. On July 15, 2022, the Government Procurement Law of the People's Republic of China (Draft Revisions for Solicitation of Comments) was again released to the public for comments.

II. Administrative Regulations

2. Regulations for the Implementation of the Government Procurement Law

The "Regulations for the Implementation of the Government Procurement Law of the People's Republic of China" was adopted at the 75th executive meeting of the State Council on December 31, 2014, and came into force on March 1, 2015.

3. Regulations on Guaranteeing Payment of Funds for Small and Medium-sized Enterprises

The Regulations on Guaranteeing the Payment of Small and Medium-sized Enterprises are formulated in accordance with the Law of the People's Republic of China on the Promotion of Small and Medium-sized Enterprises and other laws to promote the timely payment of small and medium-sized enterprises by government agencies, institutions and large enterprises, safeguard the legitimate rights and interests of small and medium-sized enterprises, and optimize the business environment.

On 5 July 2020, the State Council of the People's Republic of China promulgated the Regulations on Guaranteeing Payment of Funds to Small and Medium-sized Enterprises (SMEs) (No. 728), which came into force on 1 September 2020.

On April 18, 2024, the Ministry of Industry and Information Technology (MIIT) publicly solicited opinions on the Regulations on Guaranteeing Payment of Small and Medium-sized Enterprises (Draft Amendments for Solicitation of Comments).

4. Measures for the Administration of Non-bidding Procurement Methods in Government Procurement (Decree No. 74 of the Ministry of Finance)

The Measures for the Administration of Non-bidding Procurement Methods in Government Procurement were deliberated and adopted by the Ministry of Finance on October 28, 2013, and promulgated by Decree No. 74 of the Ministry of Finance of the People's Republic of China on December 19, 2013. The Measures are divided into 62 articles in 7 chapters of General Provisions, General Provisions, Competitive Negotiation, Single-Source Procurement, Inquiry, Legal Liability, and Supplementary Provisions, which came into force on February 1, 2014.

5. Administrative Measures for Bidding and Bidding for Government Procurement of Goods and Services (Decree No. 87 of the Ministry of Finance)

The Administrative Measures for Bidding and Bidding for Government Procurement of Goods and Services is a departmental regulation revised by the Ministry of Finance on July 11, 2017 and deliberated and approved by the Ministry of Finance, promulgated by Decree No. 87 of the Ministry of Finance, and implemented on October 1, 2017.

6. Measures for Questioning and Complaining about Government Procurement (Decree No. 94 of the Ministry of Finance)

On December 26, 2017, the Ministry of Finance of the People's Republic of China promulgated the Measures for Questioning and Complaining about Government Procurement through Decree No. 94. The Measures are divided into 6 chapters and 45 articles, including General Provisions, Submission and Response to Questions, Complaint Initiation, Complaint Handling, Legal Liability, and Supplementary Provisions, which will come into force on March 1, 2018. On August 11, 2004, the Ministry of Finance promulgated the Measures for Handling Complaints of Government Procurement Suppliers (Decree No. 20 of the Ministry of Finance) to repeal.

7. Administrative Measures for the Publication of Government Procurement Information (Decree No. 101 of the Ministry of Finance)

These Measures are drafted on the basis of the "Government Procurement Law of the People's Republic of China", the "Regulations for the Implementation of the Government Procurement Law of the People's Republic of China" and other relevant laws and administrative regulations, so as to regulate the release of government procurement information and increase the transparency of government procurement, and take effect on March 1, 2020.

8. Administrative Measures for Government Procurement of Services (Decree No. 102 of the Ministry of Finance)

The Measures for the Administration of Government Procurement of Services are measures formulated for the implementation of the relevant work arrangements for the reform of government procurement of services. The Measures were promulgated by the Ministry of Finance on January 3, 2020 and came into force on March 1, 2020.
