Criminal Law of the People's Republic of China

Article 118: [Crime of sabotage of electrical equipment, crime of sabotage of inflammable and explosive equipment] Whoever destroys electricity, gas or other flammable or explosive equipment, endangers public safety, and has not caused serious consequences, shall be sentenced to fixed-term imprisonment of not less than three years but not more than ten years.

Article 119: [Crimes of sabotage of means of transportation, crimes of sabotage of transportation facilities, crimes of sabotage of electrical equipment, and crimes of sabotage of inflammable and explosive equipment] Whoever destroys means of transportation, transportation facilities, electrical equipment, gas equipment, or inflammable or explosive equipment, causing serious consequences, shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment, or death.

Whoever commits the crime in the preceding paragraph by negligence shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years;

Work Safety Law of the People's Republic of China

Article 36 The design, manufacture, installation, use, testing, maintenance, transformation and scrapping of safety equipment shall conform to national or industry standards. Production and business operation units must carry out regular maintenance and maintenance of safety equipment, and regularly inspect to ensure normal operation. Maintenance, maintenance, and testing shall be recorded and signed by relevant personnel. Production and business operation entities shall not shut down or destroy monitoring, alarm, protection, and life-saving equipment and facilities directly related to production safety, or tamper with, conceal, or destroy their relevant data and information.

If the production and business operation units in the catering and other industries use gas, they shall install combustible gas alarm devices and ensure their normal use.

Article 99 Where a production or business operation entity commits any of the following acts, it shall be ordered to make corrections within a specified period of time and shall be fined not more than 50,000 yuan; if it fails to make corrections within the time limit, it shall be fined not less than 50,000 yuan but not more than 200,000 yuan, and its directly responsible managers and other directly responsible personnel shall be fined not less than 10,000 yuan but not more than 20,000 yuan; if the circumstances are serious, it shall be ordered to suspend production and business for rectification; if a crime is constituted, criminal responsibility shall be investigated in accordance with the relevant provisions of the Criminal Law:

(8) Production and business operation units in catering and other industries use gas without installing combustible gas alarm devices.

Law of the People's Republic of China on the Protection of Oil and Gas Pipelines

Article 8 No unit or individual shall carry out any act that endangers the safety of pipelines. Any unit or individual has the right to report any act endangering pipeline safety to the department in charge of pipeline protection of the local people's government at or above the county level or other relevant departments. Departments receiving reports shall promptly handle them within the scope of their duties.

Article 28 The following acts that endanger pipeline safety are prohibited:

(1) Opening or closing pipeline valves without authorization;

(2) Damaging pipelines by means of moving, cutting, punching, smashing, or dismantling;

(3) moving, damaging, or altering pipeline signs;

(4) Driving heavy vehicles on patrol roads above buried pipelines;

(5) Walking or placing heavy objects on ground pipeline lines, overhead pipeline lines and pipe bridges.

Article 50 Where a pipeline enterprise commits any of the following acts, the department of the local people's government at or above the county level in charge of pipeline protection shall order it to make corrections within a specified period of time; if it fails to make corrections within the time limit, it shall be fined not less than 20,000 yuan but not more than 100,000 yuan; and the person in charge who is directly responsible and other persons who are directly responsible shall be punished:

(1) Failing to patrol, inspect and maintain pipelines in accordance with the provisions of this Law;

(2) Failing to update, transform, or stop using pipelines that do not meet the requirements for safe use in a timely manner;

(3) Failing to set up, repair or update relevant pipeline signs in accordance with the provisions of this Law;

(4) Failing to submit the pipeline completion survey drawings to the department of the people's government in charge of pipeline protection work for the record in accordance with the provisions of this Law;

(5) Failing to formulate the enterprise's pipeline accident emergency plan, or failing to report the enterprise's pipeline accident emergency plan to the people's government's department in charge of pipeline protection for the record;

(6) In the event of a pipeline accident, effective measures are not taken to eliminate or mitigate the hazards of the accident;

(7) Failing to take necessary safety protection measures for pipelines that have been stopped, sealed, or scrapped.

Where pipeline enterprises violate the provisions of this Law and at the same time violate other laws such as construction project quality management, production safety, and fire protection, they shall be punished in accordance with the provisions of other laws.

Where pipeline enterprises cause harm to the lawful rights and interests of others, they shall bear civil liability in accordance with law.

Article 56 Where a local people's government at or above the county level and its department in charge of pipeline protection work or other relevant departments violates the provisions of this Law by failing to promptly organize the elimination of potential external pipeline safety hazards that should be eliminated, failing to investigate and deal with acts endangering pipeline safety after discovering them or failing to investigate and deal with them in accordance with law after receiving reports of acts endangering pipeline safety, or engaging in other acts that do not perform their duties in accordance with the provisions of this Law, the organ at the higher level shall order them to make corrections and impose sanctions on the person in charge and other persons directly responsible in accordance with law.

Fire Protection Law of the People's Republic of China

Article 27 The product standards for electrical products and gas appliances shall meet the requirements of fire safety.

The installation and use of electrical products and gas appliances, as well as the design, laying, maintenance and testing of lines and pipelines, must comply with fire protection technical standards and management regulations.

Article 66 Where the installation and use of electrical products and gas appliances and the design, laying, maintenance and testing of electrical appliances and pipelines and their wiring and pipelines do not conform to the technical standards and management regulations for fire protection, they shall be ordered to make corrections within a specified period of time; if they fail to make corrections within the time limit, they shall be ordered to stop using them and may be fined not less than 1,000 yuan but not more than 5,000 yuan.

Regulations on the Administration of Urban Gas

Article 5 The competent department of construction under the State Council shall be responsible for the management of gas throughout the country。 The gas administration department of the local people's government at or above the county level shall be responsible for the gas management within its administrative area. Other relevant departments of the people's governments at or above the county level shall, in accordance with the provisions of these Regulations and other relevant laws and regulations, be responsible for the management of gas within the scope of their respective duties。

Article 28 Gas users and relevant units and individuals shall not engage in the following acts:

(1) Unauthorized operation of public gas valves;

(2) Using gas pipelines as load-bearing supports or grounding leads;

(3) Installing and using gas-burning appliances that do not meet the requirements of the gas source;

(4) Installing, modifying, or dismantling indoor gas facilities and gas metering devices without authorization;

(5) Using and storing gas in places that do not have safe conditions;

(6) Misappropriation of gas;

(7) Changing the use of gas or switching to gas supply.

Article 33 The gas administration department of the local people's government at or above the county level shall, in conjunction with the urban and rural planning and other relevant departments, delineate the scope of protection of gas facilities in accordance with the relevant national standards and regulations, and announce it to the public。

Within the scope of protection of gas facilities, it is forbidden to engage in the following activities that endanger the safety of gas facilities:

(1) Constructing buildings, structures or other facilities that occupy underground gas pipelines;

(2) Carrying out blasting, soil extraction, or other operations, or using open flames;

(3) Dumping or discharging corrosive substances;

(4) Placing flammable or explosive dangerous goods or planting deep-rooted plants;

(5) Other activities that endanger the safety of gas facilities.

Article 34 Within the scope of protection of gas facilities, if the relevant units engage in activities that may affect the safety of gas facilities, such as laying pipelines, piling, jacking, excavation, drilling, etc., they shall jointly formulate a protection plan for gas facilities with gas operators and take corresponding safety protection measures。

Article 35 Gas operators shall, in accordance with the relevant national engineering construction standards and regulations on production safety management, set up protective devices and safety warning signs for gas facilities such as anti-corrosion, insulation, lightning protection, pressure reduction, and isolation, and conduct regular inspections, inspections, repairs and maintenance to ensure the safe operation of gas facilities。

Article 39 The gas administration department shall, in conjunction with relevant departments, formulate an emergency plan for gas safety accidents, establish a statistical analysis system for gas accidents, and regularly report the results of accident handling。

Gas operators shall formulate emergency plans for gas safety accidents in their units, allocate emergency personnel and necessary emergency equipment and equipment, and organize regular drills.

Article 40 Any unit or individual shall immediately inform the gas operator of a gas safety accident or a hidden danger of a gas safety accident, or report it to the gas management department, public security organs, fire departments and other relevant departments and units.

Article 41 Gas operators shall establish and improve the gas safety assessment and risk management system, and shall take measures to eliminate potential gas safety accidents in a timely manner if they are discovered。

The gas management department and other relevant departments and units shall, in accordance with their respective duties, supervise and inspect the safety status of gas operation and gas use, and if they find hidden dangers of gas safety accidents, they shall notify gas operators and gas users to take timely measures to eliminate hidden dangers;

Article 42 After a gas safety accident occurs, the gas operator shall immediately activate the emergency plan for the gas safety accident of the unit and organize rescue and emergency repair.

After the occurrence of a gas safety accident, the gas management department, the production safety supervision and management department, the fire department of the public security organ and other relevant departments and units shall, in accordance with their respective responsibilities, immediately take measures to prevent the expansion of the accident, and start the emergency plan for the gas safety accident according to the relevant situation.

Article 51 Whoever, in violation of the provisions of these Regulations, destroys, dismantles or moves gas facilities without authorization, or alters municipal gas facilities without authorization, shall be ordered by the gas management department to make corrections within a specified period of time, restore the original state or take other remedial measures, and impose a fine of not less than 50,000 yuan but not more than 100,000 yuan on the unit, and a fine of not less than 5,000 yuan but not more than 50,000 yuan on the individual;

In violation of the provisions of these Regulations, damage, cover, alter, unauthorized removal or removal of gas facilities safety warning signs, the gas management department shall order correction within a time limit, restore the original state, and may be fined less than 5,000 yuan.

Article 52 Where the provisions of these Regulations are violated by the existence of underground gas pipelines and other important gas facilities within the scope of the construction of a construction project, and the construction unit fails to jointly formulate a protection plan for the gas facilities together with the construction unit and the pipeline gas operator, or the construction unit or the construction unit fails to take corresponding safety protection measures, the gas management department shall order it to make corrections and impose a fine of not less than 10,000 yuan but not more than 100,000 yuan;

Regulations on Fire Safety Management of High-rise Civil Buildings

(Decree No. 5 of the Ministry of Emergency Management)

Article 17 The installation, use, and pipeline laying, maintenance and testing of gas appliances in high-rise civil buildings shall comply with fire protection technical standards and management regulations。 It is forbidden to install, modify or dismantle gas equipment and appliances without authorization in violation of the regulations on the safe use of gas.

The use of gas in high-rise civil buildings shall be in the form of pipeline gas supply。 It is forbidden to use liquefied petroleum gas in the underground part of high-rise civil buildings.

Regulations on Fire Safety Management of Organs, Groups, Enterprises and Institutions
