What is Intellectual Property?

Intellectual property, also known as the right to intellectual property, refers to "the exclusive rights enjoyed by the right holder in accordance with the law on the results created by its intellectual labor and the marks and reputation in business activities", also known as the right to intellectual achievements. The Civil Code of the People's Republic of China stipulates that civil subjects enjoy intellectual property rights in accordance with the law. Intellectual property rights are the exclusive rights enjoyed by the right holder in accordance with the law in respect of works, inventions, utility models, designs, trademarks, geographical indications, trade secrets, layout designs of integrated circuits, new varieties of plants, and other subject matter prescribed by law.

The Origin of IP Day

On the basis of a proposal by the People's Republic of China and Algeria in 1999, the World Intellectual Property Organization (WIPO) adopted a resolution at its 35th session of the General Assembly in 2000 to designate April 26 as "World Intellectual Property Day" from 2001 onwards. April 26 is the date of entry into force of the Convention Establishing the World Intellectual Property Organization (WIPO Convention). The establishment of World Intellectual Property Day aims to establish a worldwide awareness of respect for knowledge, advocating science and protecting intellectual property rights, and to create a legal environment that encourages intellectual innovation and the protection of intellectual property rights.

What is National IP Awareness Week?

The National Intellectual Property Publicity Week, formerly known as the National Intellectual Property Protection Publicity Week, generally begins on April 20 every year and ends on April 26, the World Intellectual Property Day, for a week. The theme for 2024 is "Transformation and Application of Intellectual Property for High-quality Development".

Types of Intellectual Property

The intellectual property rights we usually talk about mainly include patent rights, trademark rights, copyright rights (i.e., copyrights), trade secret rights, and other intellectual property rights include the exclusive right to layout design of integrated circuits, plant variety protection, geographical indications of origin, etc. As society progresses, new forms of intellectual property continue to emerge.

Characteristics of intellectual property

(4) As an important part of modern civil and commercial law, the intellectual property legal system is of great significance to improving China's legal system and building a country under the rule of law.

How ordinary people can benefit from IP

For the general public, the intellectual property system can bring them at least the following benefits:

(1) Encourage and promote innovation, accelerate the development of society, and promote people to create more brilliant intellectual achievements in science, technology, culture, art, etc., in production practices and scientific experiments, and accelerate the development process of human society, thereby ultimately benefiting human society.

(2) Improving the quality of goods and services and improving people's lives, such as the protection of trademark rights, will prompt business operators to improve the quality of the goods they produce or the services they provide, and the ultimate beneficiaries are still consumers.
