In order to further play the supporting role of special property maintenance funds in the fire safety management of property communities, recently, Xuzhou Housing Expropriation and Real Estate Security Management Center issued a notice in accordance with the "Regulations on Fire Safety Management of Residential Property in Jiangsu Province", "Xuzhou Residential Property Management Regulations", "Xuzhou Residential Special Maintenance Fund Management Measures" and other relevant regulations, clarifying the scope of use of maintenance funds in the fire safety management of property communities, the subject of application, and the relevant requirements for effectively performing their duties and strengthening fire emergency guidance and supervision.
The Municipal Housing Insurance Center clarifies that the maintenance funds can be used for the maintenance, renewal and transformation of fire-fighting facilities and equipment beyond the warranty period and the responsibility of the property service contract, as well as the repair of safety and precautionary facilities (including parking places and charging facilities for electric bicycles). The application of maintenance funds shall follow the principles of convenience and speed, openness and transparency, and consistency between beneficiaries and bearers. All owners benefit from the priority use of overall maintenance funds, unit owners can benefit from the priority use of elevator fire protection special maintenance funds.
For property communities that have established owners' committees (PMCs), owners' committees (PMCs) can be used as applicants for maintenance funds, and for property communities and community residents' committees that have not established owners' committees (PMCs), they can be used as applicants for maintenance funds. Property management service enterprises shall assist the applicant in handling matters related to the use of maintenance funds. After the occurrence of an emergency, the applicant does not perform the application duties in accordance with the regulations, under the guidance of the property management department, the sub-district office (town people's Government) organizes maintenance on behalf of the applicant, and the relevant expenses are paid from the maintenance funds.
The county (city, district) property management department should support the maintenance funds for the maintenance, updating, transformation and rebuilding of fire protection facilities and equipment. If there is a functional failure after the expiration of the warranty period of fire-fighting facilities and equipment, and there is a major fire hazard in the property management area, the property service enterprise shall take emergency preventive measures in advance, and promptly report to the fire and rescue agency, the sub-district office (town people's government), the property management department and other departments responsible for the supervision and management of production safety, and may start the emergency procedures for the use of maintenance funds at the same time, without the vote of the relevant owners.
