Today (16th), Xue Zhiqian composed a "limerick poem", responding positively to the problem of "stealing photos", saying, "This heart is bright, and what can I say".
According to the Weibo, Xue Zhiqian believes that some netizens' accusations of stealing photography are "plugging faces", and the film's creator "Benzun" expressed his gratitude for his film reviews. "This heart is bright" is his final statement.
Is Xue Zhiqian's behavior a theft?
At noon today, CCTV released a video saying that industry insiders said that mainland law stipulates that without the permission of the right holder, no one is allowed to make audio or video recordings of the film during the viewing period. To put it simply, when the dragon mark is lit up, we can no longer take out our mobile phones to shoot. When we buy movie tickets, we buy a single movie experience service, not that we can shoot movie content after buying movie tickets.
Lawyer Zhou Zhaocheng, who is certified as a lawyer at Beijing Anjian Law Firm, posted on Weibo that piracy refers to filming, recording, videotaping and other acts of works created by others without the permission of copyright owners, performers or other rights holders, and using these materials for public dissemination, commercial use or other purposes that infringe on the rights and interests of others. At the same time, the "Film Industry Promotion Law" clearly stipulates that without the permission of the right holder, no one may make audio or video recordings of the film being screened. Therefore, such unauthorized shooting, audio and video recording is an infringement of the intellectual property rights and privacy rights of others, and is illegal, and should bear corresponding legal responsibility.
As for whether Xue Zhiqian's behavior constitutes piracy, lawyer Zhou Zhaocheng believes that it needs to be judged on a case-by-case basis. He said that if Xue Zhiqian filmed other people's works without permission and used these materials for public dissemination, commercial exploitation or other purposes that infringed on the rights and interests of others, then such behavior could constitute piracy. However, if Xue Zhiqian's filming is only for personal viewing or commemoration, and has no purpose of dissemination or commercial use, then such behavior will not usually be considered as piracy.
However, some fans believe that Xue Zhiqian was invited to watch, and if the filming is permitted, it is not a pirated filming.
