Chapter III Fire safety responsibilities of the work departments of the people's governments at or above the county level

Article 12: The relevant departments of people's governments at the county level or above shall, in accordance with the principle of who is in charge and who is responsible, perform the following duties within the scope of their respective duties:

(1) According to the characteristics of the industry and the system, fire safety content shall be included in the industry's safety production laws and policies, planning plans and emergency plans, so as to improve the level of fire safety management.

(2) Supervise and urge the relevant units of the industry and the system to implement the fire safety responsibility system in accordance with the law, establish a fire safety management system, determine full-time (part-time) fire safety management personnel, and implement fire protection funds; carry out targeted fire safety inspection and management to eliminate fire hazards; strengthen fire protection publicity, education and training, organize emergency drills every year, and improve the fire safety awareness of industry employees.

(3) Other fire safety duties provided for by laws, regulations and rules.

Article 13 Departments with administrative examination and approval functions shall strictly examine and approve the statutory conditions related to fire safety in the examination and approval matters in accordance with the law, and those who do not meet the statutory conditions shall not be issued with relevant licenses or approved to start. Units that have been approved in accordance with law and no longer have fire safety conditions shall be dealt with in accordance with law.

(1) The public security organs are responsible for the supervision and management of fire protection work, and guide and urge organs, groups, enterprises, institutions and other units to perform fire protection duties. In accordance with the law, the implementation of fire protection design review and fire protection acceptance of construction projects, the implementation of fire supervision and inspection, the organization of targeted fire safety special governance, the implementation of fire administrative punishment. Organize and direct fire fighting, undertake or participate in major disasters and other emergency rescue work focusing on saving people's lives. Organize or participate in the investigation and handling of fire accidents in accordance with the law, and handle cases of fire crimes and fire protection accidents. Organize and carry out fire publicity, education and training and emergency evacuation drills.

(B) the education department is responsible for the management of schools and kindergartens in the industry fire safety. Guide the school fire safety education and publicity work, and incorporate fire safety education into the overall arrangement of school safety education activities.

(3) The civil affairs departments are responsible for fire safety in the industry under the approval or management of civil affairs service institutions such as social welfare, support for persons living in extreme poverty, aid management, protection of minors, marriage, funeral, disaster relief material reserves, martyrs' memorials, military retirement, preferential care hospitals, glorious homes, and elderly care institutions.

(4) The human resources and social security department is responsible for the fire safety of the industry in the approval or management of vocational training institutions and technical colleges. Do a good job of full-time government firefighters and enterprise full-time firefighters participating in work-related injury insurance in accordance with the law. Incorporate fire protection laws and regulations and fire protection knowledge into the training and vocational training of civil servants.

(7) The transportation department is responsible for supervising and urging the relevant units to implement the main responsibility for fire safety and the relevant fire protection work system in the management of passenger stations, ports, wharves and means of transportation in accordance with the law.

(8) The cultural department is responsible for the fire safety work of the industry in the approval or management of cultural and entertainment venues, and guides and supervises the performance of fire safety duties by cultural units such as public libraries, cultural centers (stations), and theaters.

(9) The health and family planning department is responsible for the fire safety of the industry in the examination and approval or management of medical and health institutions and family planning technical service institutions.

(10) The administrative department for industry and commerce is responsible for supervising and managing the quality of fire protection products in the circulation field in accordance with the law, and investigating and dealing with illegal acts in the quality of fire protection products in the circulation field.

(11) The quality and technical supervision department is responsible for supervising and urging the special equipment production units to strengthen the fire safety management in the production process of special equipment in accordance with the law, and should fully consider the fire safety factors when organizing the formulation of special equipment products and use standards, meet the relevant fire safety performance and requirements, and actively promote the application of new fire protection technologies in special equipment products. In accordance with the division of responsibilities, the quality of fire products shall be supervised and managed, and the quality of fire products shall be investigated and punished in accordance with the law. Do a good job in the formulation and revision of fire safety-related standards, and be responsible for the supervision and management of fire-related product quality certification.

(12) The departments of press, publication, radio, film and television are responsible for guiding the fire safety management of press, publication, radio, film and television establishments, and assisting in the supervision and management of the fire safety of printing industry and online audio-visual program service establishments. Urge the news media to issue targeted fire safety tips, and carry out fire protection publicity and education for the society.

(13) The production safety supervision and management department shall strictly implement the relevant administrative examination and approval in accordance with the law, and shall not issue the relevant production safety license if it does not meet the statutory conditions.

Article 14 Departments with administrative or public service functions shall provide support and guarantee for fire protection work in combination with the responsibilities of their own departments.

(A) the development and reform departments shall incorporate fire protection work into the national economic and social development of the medium and long-term planning. Local development and reform departments shall include the construction of public fire protection facilities in the local fixed asset investment plan.

(2) The science and technology department is responsible for incorporating the progress of fire science and technology into the scientific and technological development plan and the central financial science and technology plan (special projects, funds, etc.) and organizing the implementation. Organize and guide major scientific and technological research, basic research and applied research on fire safety, and work with relevant departments to promote the transformation and application of fire scientific research achievements. Incorporate fire protection knowledge into the content of popular science education.

(3) The department of industry and information technology is responsible for guiding and supervising the fire safety management of the communications industry, the construction of communication facilities, and the production and sale of civil explosives. Responsible for the industry planning and layout of the production and storage of hazardous chemicals according to their duties. The fire protection industry will be included in the emergency industry with planning, deployment and development.

(4) The judicial administrative departments are responsible for guiding and supervising the fire safety management of the prison system and the judicial administrative system's compulsory isolation centers for drug rehabilitation. Incorporate fire protection laws and regulations into the content of popular legal education.

(E) the financial sector is responsible for the budget management of fire protection funds in accordance with the regulations.

(6) The commerce department is responsible for guiding and supervising the fire safety management of the commerce and trade industry.

(7) The real estate management department is responsible for guiding and urging property service enterprises to do a good job in the maintenance and management of the common fire protection facilities in the residential community in accordance with the contract, and guiding the owners to use the special maintenance funds for the maintenance and renovation of the common fire protection facilities in the residential community in accordance with the relevant regulations.

(8) The electric power management department shall supervise and inspect the implementation of electric power laws and administrative regulations by electric power enterprises and users in accordance with the law, and urge enterprises to strictly abide by the national fire protection technical standards and implement the main responsibilities of enterprises。 Promote the use of advanced fire prevention technology and facilities, and guide users to standardize electricity consumption.

(9) The gas management department is responsible for strengthening the supervision and management of urban gas safety, urging gas operators to guide users to use gas safely, and regularly conducting safety inspections and eliminating hidden dangers of gas facilities, formulating emergency plans for gas safety accidents in conjunction with relevant departments, and investigating and punishing gas operators and gas users and other parties in accordance with the law.

(10) The civil air defense department shall be responsible for supervising and inspecting the maintenance and management of civil air defense projects.

(11) The cultural relics department is responsible for the fire safety management of cultural relics protection units, world cultural heritage and museums.

(12) Sports, religious affairs, food and other departments are responsible for strengthening fire safety management of sports venues, religious activity venues, and grain reserves, and guiding the standardized management of fire safety.

(13) Banking, securities, insurance and other financial regulatory agencies are responsible for supervising and urging banking financial institutions, securities institutions, insurance institutions and service outlets, and dispatched agencies to implement fire safety management. Insurance regulators are responsible for guiding insurance companies to carry out fire public liability insurance business, and encouraging insurance institutions to play the functions of fire risk assessment and control and fire accident prevention.

(14) Departments of agriculture, water conservancy, transportation and other departments shall include public fire protection facilities such as fire water sources and fire truck passages into relevant infrastructure construction projects.

(15) Internet information and communications management departments shall guide websites, mobile Internet media, and so forth to carry out public interest fire safety publicity.

(16) The meteorological, water conservancy, and earthquake departments shall promptly notify the public security and fire departments of the early warning information of major disasters and accidents.

(17) The unit responsible for the maintenance and management of public fire-fighting facilities shall maintain the integrity and effectiveness of public fire-fighting facilities such as fire water supply, fire communications, and fire truck passages.
