Basic facts of the case
In 2023, at the distribution box directly above the 9th and 10th steps of the stairwell on the first floor of the inn operated by the defendant Lu, due to the long-term current imbalance, the phase contact of the leakage circuit breaker A in the distribution box failed, resulting in a high temperature igniting the surrounding combustibles, and the fire spread. The fire accident caused a total of 9 deaths, 1 serious injury, 1 minor injury, many of the rescued people inhaled smoke to varying degrees, slight abrasions, direct economic losses of 12,684,959.3 yuan.
After the trial, it was ascertained that the defendant in this case, Lu, built a house in violation of regulations, built a house with more than one floor, added a fourth floor to a house that could only be built with three floors, did not rectify and demolish it after being ordered to rectify, and operated an inn in a self-built house with only one staircase access, and in the course of operation, as the manager of the inn, he did not formulate a fire safety system and was equipped with imperfect fire-fighting facilities and equipment, and was not equipped with necessary safety facilities and passages such as emergency response, evacuation and escape. At the time of the accident, there was no staff on duty in the inn, and the smoke alarm purchased online did not sound an alarm, and Lu did not use a fire extinguisher at the scene of the fire at the first time but used a white cloth to extinguish the fire. Lu was negligent in the management of the business premises and failed to perform the duties of the person responsible for fire safety. The above-mentioned violations of laws and regulations were the direct cause of the inability of personnel to escape safely at the time of the accident, and the circumstances were particularly heinous, and the defendant Lu X was primarily responsible for the accident.
Court decision
After trial, the Liping County People's Court held that the defendant Lu, as the operator of the inn, violated the provisions of the "Work Safety Law of the People's Republic of China" by causing major casualties during the operation of the inn, resulting in the death of 9 people, serious injuries to 1 person, and minor injuries to 1 person, and his conduct constituted the crime of major liability accidents. It complies with the provisions of Article 7 of the Interpretation of the Supreme People's Court and the Supreme People's Procuratorate on Several Issues Concerning the Application of Law in Handling Criminal Cases Endangering Production Safety. Therefore, Lu was sentenced to five years in prison.
