A man in Shanxi Province who counterfeited WutaiShan's specialty "Tai mushroom sauce" was sentenced to one and a half years in prison

Taiyuan, March 15 (Xinhua) -- On the occasion of the "March 15" International Consumer Rights Protection Day, the Shanxi Provincial High People's Court released three typical cases to warn businesses that disregard consumers' lives and health. Among them, a man sold ordinary mushroom sauce counterfeit Wutai Mountain specialty Taiwan mushroom sauce, and was finally sentenced to one year and six months in prison, suspended for two years, and fined 100,000 yuan.

Between September 2016 and May 2018, defendant Bai purchased the mushroom sauce he produced from Ma somewhere in Yishui County, Shandong Province, and at the same time contacted Wang Mou, a hebei person, to make a label of "Xiao Ma Ge Brand Wutai Mountain Mushroom Sauce" and mailed it to Ma, who pasted the processed mushroom sauce on the label of "Xiao Ma Ge Brand Wutai Mountain Mushroom Sauce". Defendant Bai sold most of the "Xiao Ma Ge Brand Wutai Mountain Mushroom Sauce", and the remaining unsold part was voluntarily handed over to the public security organs.

According to the inspection of Beijing Zhongke Institute of Optical Analysis and Chemical Technology, the particle structure characteristics of the "Xiaoma Ge Brand Wutai Tai Mushroom Sauce" involved in the case are obviously different from those of Taiwan mushroom and shiitake mushroom, and the similarity with apricot abalone mushroom is extremely high. According to the experimental data, it was judged that the ingredient of the "Xiao Ma Ge Brand Wutai Tai Mushroom Sauce" was apricot abalone mushroom.

As of the time of the incident, defendant Bai mou used mushroom sauce to label and package, impersonated Taiwan mushroom sauce for sale, with a total amount of 162453 yuan and an illegal profit of 11,788 yuan.

At trial, the court held that defendant Bai violated the national product quality management regulations, provided trademarks to manufacturers, acquired mushroom sauce that had been labeled and packaged, and pretended to be Taiwan mushroom sauce for sale, using false as real, and the sales amount was 162453 yuan, and his behavior had constituted the crime of producing and selling fake and shoddy products.

The court convicted defendant Bai X of the crime of producing and selling counterfeit and shoddy products in accordance with law, sentenced him to fixed-term imprisonment of one year and six months, suspended for two years, and fined him 100,000 yuan, prohibiting defendant Bai X from engaging in food production, sales and related activities during the probationary period of probation, and the illegal gains of 11,788 yuan were recovered in accordance with law and handed over to the state treasury.

Tai mushroom is a wild and rare ingredient unique to Wutai Mountain, and the mushroom sauce cooked with Tai Mushroom is called Tai Mushroom Sauce, which is a regional specialty food of Wutai Mountain.
