It is understood that on August 9 this year, 73-year-old Mr. Fan went to the bank to handle business and found that there was an expenditure of 6,000 yuan in the bank statement. After several investigations, Sun Zi Xiaotian admitted that the money was recharged by him to the online game.
Xiao Tian is not yet 15 years old this year and is a first-year high school student. More than two years ago, his family gave Xiao Tian a mobile phone to assist in Xi, during which he began to use other people's accounts to log in to his mobile phone to play online games, in order to beautify the characters in the game, Xiao Tian used his grandfather's bank card and password to recharge the game and buy skins and other equipment.
According to the bank statements and recharge records obtained by Mr. Fan, since November 2021, in just two years, Xiaotian has successively recharged online games such as Fifth Personality, Light and Encounter, and Harry Potter with a total amount of more than 93,000 yuan, and the payees are all well-known domestic portal game providers, registered in Hangzhou, Zhejiang Province.
After the incident, Mr. Fan's daughter communicated with the customer service of the "parental care platform" set up by the game provider many times, but the other party only agreed to refund 20,000 yuan on the grounds that the game account involved in the lawsuit had multiple sales transactions, multiple provinces (regions), multi-device logins and recharges, and other abnormal situations. On December 6, Mr. Fan did not accept the refund amount proposed by the other party, and on December 6, Mr. Fan came to the city's first elderly consumer rights protection workstation set up by the Wuxi Consumer Rights Protection Committee in Liangxi District Consumer Protection Committee to seek help.

According to Article 19 of the Civil Code:
"Minors over the age of 8 are persons with limited capacity for civil conduct, and are represented by their legally-designated representatives, or with the consent and recognition of their legally-designated representatives, in carrying out civil juristic acts; ”
In this dispute, Xiaotian recharged more than 93,000 yuan to the game platform, such a huge amount of money is obviously incompatible with his age and intelligence. In the case of no recognition by the legal representative, the act is an invalid civil act, and the legal representative has the right to request a refund from the platform.
Since the respondent is located in Hangzhou, the Liangxi District Consumer Protection Committee decided to activate the working mechanism of the Yangtze River Delta Consumer Rights Protection Alliance and contact the Zhejiang Provincial Consumer Rights Protection Committee for assistance after preliminary communication with the respondent's customer service department.
On December 13, 2023, the two parties to the dispute conducted on-site mediation at the Zhejiang Provincial Consumer Protection Commission, and finally the relevant person in charge of the online game company reached a settlement agreement with Ms. Fan, and the online game company refunded 76,000 yuan, which was fulfilled within one week.
