On September 19, seven departments of Xiong'an New Area jointly issued the "Interim Measures for the Management of Online Taxi Reservation Services in Xiong'an New Area" (hereinafter referred to as the "Measures"), proposing that the "Measures" are formulated to better meet the diversified travel needs of the public, promote the integrated development of the taxi industry and the Internet, standardize the online taxi reservation business services, and ensure operational safety and the legitimate rights and interests of passengers.
The online taxi reservation business license is valid for 4 years
The "Measures" proposes that the validity period of the online taxi reservation business license is 4 years, calculated from the date of issuance of the license.
30 days before the expiration of the validity period of the business license, the operator of the online ride-hailing platform may submit an application to the administrative examination and approval department of Xiong'an New Area for the extension of the validity period of the business license; If the online car-hailing platform operator meets the licensing requirements, the administrative examination and approval management department of the Xiong'an New Area shall make a decision to approve the extension of the validity period of the business license.
Online car-hailing platform operators registered within the scope of the Xiong'an New Area shall obtain the corresponding "Online Taxi Reservation Business License" and apply to the Hebei Provincial Communications Department for the filing of Internet information services before they can carry out relevant business.
Where an online ride-hailing platform operator suspends or terminates its operations, it shall make a written report to the transportation management department of the Xiong'an New Area 30 days in advance, explain the relevant situation, notify the owner and driver of the vehicle providing the service, and make an announcement to the public.
Vehicles that meet 9 conditions can only engage in online ride-hailing business
The Measures stipulate that vehicles that intend to engage in online car-hailing business in Xiong'an New Area shall meet the following nine conditions:
The owner of the vehicle registered with the public security organ in Xiong'an New Area is a passenger car with 7 seats or less for an enterprise or an individual, the vehicle is registered without mortgage, and the vehicle has no unprocessed traffic accident and traffic violation records within the validity period of the inspection;
The nature of the use of the vehicle is registered as "reserved taxi passenger transport";
The vehicle is a new energy vehicle with a wheelbase of not less than 2650 mm, and the registration date indicated on the vehicle driving license is less than 3 years from the date of application;
Installation in line with the relevant provisions of the state, Hebei Province and Xiong'an New Area with driving record function of the vehicle satellite positioning device, emergency alarm device, as well as with solid-state storage, wireless transmission, inside and outside the vehicle image monitoring function of the driving recorder device;
The technical performance of the vehicle meets the requirements of relevant standards for operational safety;
If a vehicle registered in the name of an individual applies for an "Online Taxi Reservation Transportation Certificate", the vehicle owner shall obtain an "Online Taxi Reservation Driver's License" and other online car-hailing vehicles that are not registered under his name;
If the vehicle registered in the name of the enterprise applies for the "Online Taxi Transportation Certificate", the vehicle shall be the actual capital contribution of the applicant enterprise and registered in the name of the invested enterprise;
It is not allowed to install cruising taxi operating equipment such as dome lights and empty license plates in violation of regulations, and it is not allowed to install facilities and equipment with similar functions such as dome lights and empty license plates, and the appearance color and logo of the vehicle shall not be the same or similar to that of cruising taxis in Xiong'an New Area;
Other conditions stipulated by laws, regulations and rules.
When the service life of online car-hailing reaches 8 years, it will be withdrawn from operation
The "Measures" proposes that the starting date of the validity period of the "Online Taxi Transportation Certificate" is the date of issuance, and the expiration date is the corresponding date of 8 years from the date of registration indicated in the vehicle driving license.
When the mileage of online car-hailing reaches 600,000 kilometers, it will be forcibly scrapped. When the mileage does not reach 600,000 kilometers but the service life reaches 8 years, the online car-hailing operation will be withdrawn.
Small and micro non-operating passenger vehicles registered as reserved for passenger transport shall be scrapped in accordance with the scrapping standards for online car-hailing. Other small and micro passenger vehicles registered as reserved for taxi passenger transport shall be scrapped in accordance with the standards for the scrapping of such types of operating passenger vehicles and the standards for the scrapping of online car-hailing.
In order to engage in business, a driver must meet at least 6 conditions
The Measures propose that drivers who intend to engage in online car-hailing business in Xiong'an New Area should meet six conditions:
Have not reached the statutory retirement age and are in good health; Have more than 3 years of actual driving experience and meet the requirements of the motor vehicle driver's license; No record of traffic accidents, dangerous driving, drug abuse, driving after drinking, no violent crime, and no record of 12 points in the last 3 consecutive scoring cycles; Qualified in the qualification examination; There is no record of being revoked as a taxi driver within 5 years before the date of application; Other conditions stipulated by laws and regulations.
Drivers who intend to engage in online car-hailing services in the Xiong'an New Area shall submit an application to the administrative examination and approval management department of the Xiong'an New Area and submit materials that meet the requirements. Applicants who pass the examination are required to take the qualification examination.
Drivers who have obtained the "Online Taxi Reservation Driver's License" shall be registered with the transportation management department of Xiong'an New Area before they can engage in online car-hailing services. The registration is valid for 3 years.
Xiong'an New Area's "Online Taxi Driver's License" and "Cruise Taxi Driver's License" are mutually recognized. Before the expiration of the validity period of the original certificate, the driver can go to the window of the Administrative Licensing Service Center of Xiong'an New Area to change his qualifications, drive a cruise taxi across classes or book a taxi online. However, before handling the registration of online car-hailing drivers, the registration of cruise taxi drivers shall be cancelled first.
Drivers deliberately detour and face a penalty of between 50 and 200 yuan
The Measures emphasize that the credit records of online ride-hailing operators and drivers will be released to the public.
The Measures propose that the transportation management department of Xiong'an New Area should strengthen the supervision of the online car-hailing market, regularly organize and carry out online car-hailing service quality and reputation assessments, establish credit records of online car-hailing platform operators and drivers, and promptly announce them to the public.
If an online car-hailing driver violates the Measures in any of the three circumstances, in accordance with the provisions of the Interim Measures for the Administration of Online Taxi Booking Business Services, the transportation management department and the price management department where the service is located shall order corrections in accordance with their duties, and impose a fine of not less than 50 yuan but not more than 200 yuan for each violation:
Dumping passengers on the way or deliberately taking a detour; Illegal charges; Retaliate against passengers who report or complain about the quality of their services or make unsatisfactory evaluations of their services.
The Measures specify that information on administrative penalties imposed on online ride-hailing drivers shall be included in the credit records of the drivers and online ride-hailing platform companies.
