On May 30, France's Supreme Administrative Court issued a judgment to revoke legal sanctions against a doctor, who was justified in violation of the doctor-patient confidentiality agreement, and was therefore forgiven.
The female doctor, Eugénie Izard, from Toulouse, is a child psychiatrist.
She was previously sentenced to a temporary medical ban for reporting to authorities that her patient, an 8-year-old child, had been sexually abused by her parents.
Back in 2014, when Dr. Eugenie was in charge of psychiatric treatment for an 8-year-old girl, she found that her parent-child relationship was abnormal, and after verification, reported to the Children's Judge about the child's father's abuse and incestuous sexual assault of the little girl.
It is said that the ugliness of the family cannot be publicized, and the scandal of sexually assaulting the biological daughter was reported by the child's doctor, and the demon father could not swallow this breath, so he in turn accused Dr. Eugenie of interfering in the private affairs of others and violating the doctor-patient confidentiality agreement.
The demon father filed his first report with prosecutors in October 2014 and then again in March 2015 and formally prosecuted Dr. Eugenie.
As a result, Dr. Eugenie paid a terrible price, the court convicted, eugenie was sentenced to a three-month ban on practicing medicine in December 2020.
It's ridiculous to think about this verdict! As a doctor, if you find that the patient is a murderer or a victim, but you can't report it? Have to turn a blind eye and watch innocent people continue to be brutally killed? What is the reason for this?
Dr. Eugenie said she didn't regret it, she just did what a doctor should do, "we doctors have a responsibility to report to the judge responsible for child protection that we have doubts about the abuse of patients", so she is satisfied and approve of her actions.
In the end, the Supreme Administrative Court revoked the sentence imposed on Eugenie on December 10, 2020, and transferred the case to the French Medical Order Disciplinary Agency, which is specifically responsible.
"But I still risk facing charges, including interfering in other people's affairs and supporting the child's mother in confessing to abuse," Dr. Eugenie said reluctantly.
According to Le Figaro, at least 160,000 children in France fall victim to sexual violence each year, the main problem being incest.
In the principle of doctor-patient confidentiality, even if the doctor finds the clue or even has conclusive evidence, he cannot report it, otherwise he will face disciplinary punishment like Dr. Eugenie, and everyone generally believes that he really cannot sacrifice himself for others, so there is only a 5% reporting rate.
At the end of March, France's committee on sexual violence and incest against children called for the rescission of the punishment of doctors who reported them, or else it would be a vicious circle.
In fact, sexual offences have always been a major problem in French society. According to the French National Institute of Statistics and Population research in cooperation with IPSOS, by 2020, the victims of incest in France account for 10% of the total population, which means that this group is as many as 6.7 million people! What a staggering number!
Not only that, but that's more than three times the number in 2009, when 2 million people were victims of incest in France.
