Overseas Chinese private housing became public housing

From Sun Wenqiao's expression, the reporter learned that his grandfather Jin Dongri was an American overseas Chinese in the early years, and in 1935, Jin Dongri built a garden house on the land of Yuyuan Road. After 1938, after living here, after graduating from Shanghai Hujiang University, Jin Dongri went to the University of Michigan in the United States for further study.

Sun Wenqiao told East Real Estate: "According to the government's letter and reply, this property has been taken over by the government as a public housing in 1953. During the Cultural Revolution, rebels raided everything in their homes. Speaking of this, Sun Wenqiao's expression became solemn: "My grandfather died during the Cultural Revolution. ”

At present, Sun Wenqiao's grandmother and mother are still in the United States, with the gradual increase of age, the elderly more and more want to return to their hometown to find their roots, before there have been several attempts to get back the property, helpless only because of the public housing and complaints have no way. Sun Wenqiao also came back to retrieve the property at the behest of the old man.

"Zhou Lianhua, a former Hujiang alumnus, has always wanted to come to the mainland to see his grandfather's former residence, but now it has become a public house, and it is really difficult to explain to him, so he has to drag it out." Sun Wenqiao said helplessly.

A long road to rights protection

As a problem left over from history, Sun Wenqiao's road to rights protection has been extremely arduous. The reporter learned that Sun Wenqiao has embarked on the road of rights protection since 2012, and he has found the relevant unit that copied their home during the "Cultural Revolution", which said that the house has now been handed over to the Real Estate Bureau. However, Sun Wenqiao found the Real Estate Bureau, and the Real Estate Bureau told Sun Wenqiao that the house was already a public house, and the property rights belonged to the relevant church, and it was necessary to communicate with the church. Sun Wenqiao wrote to the church again, but has not received a response so far.

In this regard, the relevant unit issued a certificate of his private property for Sun Wenqiao, but it was not accepted.

Sun Wenqiao questioned East Real Estate: "Our private house was entrusted by the government at that time, which was based on historical reasons, but why can't we return the house to us now?" ”

For this issue, the reporter interviewed Wang Zhan, a lawyer at Shanghai Lianye Law Firm, who told East Real Estate: "Sun Wenqiao's incident involved the policy of private housing implementation, that is, the implementation policy of private housing, you can apply to the local administration office, but the premise is to ensure that its administration is eligible, if it is confiscated as a property, then it cannot apply for a certificate." If, as Sun Wenqiao said, the property rights are now owned by the church concerned, then it is necessary to find out why it belongs to the church. ”

From Wang Zhan's account, the reporter also learned that the state has issued a lease policy on behalf of the government after the trusteeship of the house, that is, the operation and management of the lease policy, if the government wants to cancel the lease relationship, it needs to pay relevant compensation to the tenant.
