From May onwards, a number of new regulations will be implemented, affecting our lives.

The new regulations on the production and operation of medical devices have been implemented

The revised Measures for the Supervision and Administration of the Production of Medical Devices and the Measures for the Supervision and Administration of the Operation of Medical Devices, as revised by the State Administration for Market Regulation, will come into force on May 1, 2022.

The Measures strengthen the supervision and management of medical device registrants, clarify the responsibilities of both registrants and entrusted production enterprises, and incorporate the relevant requirements for entrusted production management into the quality management system. Improve the management requirements for sales, transportation, storage and other aspects of the business link, refine the relevant provisions on retrospective management such as purchase inspection and sales records, and strengthen the quality and safety responsibilities of registrants and recorders for selling their registered and filed medical devices.

The Measures optimize the license filing process, adjust the requirements for business licenses and filings under the medical device registrant system, cancel the requirements for submitting business licenses and relevant supporting documents when licensing, further compress the time limit for verification and approval, clarify the specific circumstances of exemption from submitting application materials and exemption from business filing, and simplify the procedural requirements such as material submission for those who apply for licenses and filings at the same time.

Children's cosmetics must be marked with the "Little Golden Shield" logo

According to the announcement of the State Food and Drug Administration on the issuance of the Provisions on the Supervision and Administration of Children's Cosmetics, from May 1, 2022, children's cosmetics that apply for registration or filing must be marked with "Little Golden Shield"; if the children's cosmetics that have previously applied for registration or filing have not been labeled in accordance with the regulations, the cosmetics registrant and recorder shall complete the product label update before May 1, 2023.

The sale of e-cigarette products to minors is prohibited

The Administrative Measures for Electronic Cigarettes formulated by the State Tobacco Monopoly Administration came into effect on May 1, 2022. The "Measures" make it clear that the competent administrative department for tobacco monopoly under the State Council shall establish a unified national e-cigarette trading management platform. E-cigarette production enterprises, atomized production enterprises, e-cigarette nicotin production enterprises, e-cigarette wholesale enterprises, and e-cigarette retail business entities that have obtained tobacco monopoly licenses in accordance with law shall conduct transactions through the e-cigarette trading management platform.

The "Measures" also require that enterprises that obtain a license for tobacco monopoly wholesale enterprises shall be approved by the competent administrative department for tobacco monopoly and change the scope of the license before engaging in the wholesale business of electronic cigarette products. E-cigarette product sales outlets must not be set up around ordinary primary and secondary schools, special education schools, secondary vocational schools, specialized schools, and kindergartens. The sale of e-cigarette products to minors is prohibited. It is forbidden to use self-service sales methods such as vending machines to sell or covertly sell e-cigarette products.

Jiangsu ambulances should give way to other vehicles when performing their duties

The Regulations of Jiangsu Province on Pre-hospital Medical Emergency came into effect on May 1. The regulations regulate the allocation of emergency personnel, requiring that each ambulance should be equipped with at least one emergency physician, one emergency nurse and one to two emergency auxiliary personnel. In order to ensure the efficiency of first aid, the regulations stipulate that the emergency center shall issue a dispatch instruction to the standby ambulance at the emergency station (point) within one minute after receiving the complete call information. First aid stations (points) shall not refuse or delay in providing emergency services to patients on the grounds of non-payment or other reasons. Medical institutions shall not refuse, delay or prevaricate for any reason.

At the same time, the regulations require the strengthening of the construction of pre-hospital medical emergency teams, and give ambulances special rights when performing their tasks, stipulating that ambulances are exempt from paying tolls and parking fees on roads and bridges, and stipulating that other vehicles and pedestrians should give way and must not obstruct their passage.

More employment support for the elderly and women

The Employment Promotion Regulations of Jiangsu Province came into effect on May 1, 2022, requiring targeted employment services and policy support for the elderly population and female workers who respond to the national fertility policy to solve the problem of "one old and one small" in the field of employment of social concern. The regulations consist of 11 chapters and 90 articles, and local people's governments at or above the county level shall formulate policies and measures to encourage the reemployment of the elderly, provide support such as employment services and employment training, and safeguard the legitimate rights and interests of the elderly in reemployment.

In addition, the Regulations make it clear that local people's governments at or above the county level shall provide employment services and policy support for female workers who respond to the national fertility policy. Establish a mechanism for sharing the cost of employment during the holidays of female employees, and give corresponding subsidies to the social insurance expenses paid by enterprises during the maternity leave of female employees in accordance with regulations. Policy support will be given to employers who recruit a certain proportion of female workers who respond to the national birth policy and achieve stable employment.

Each primary and secondary school shall have at least one Vice-Principal for the Rule of Law

The Ministry of Education formulated and promulgated the Measures for the Appointment and Management of Vice Principals for the Rule of Law in Primary and Secondary Schools, which will be implemented from 1 May 2022. The "Measures" further clarify the duties of the vice president of the rule of law to assist schools in protecting students' rights and interests, preventing juvenile delinquency, participating in safety management, implementing or guiding the implementation of educational punishments, and guiding governance according to law, giving full play to the legal professional abilities and strengths of the staff of each dispatched organ.

The Measures require that each primary and secondary school be equipped with at least one vice principal for the rule of law, and give priority to the allocation of a vice principal for the rule of law in schools in remote areas, rural areas and weak schools in cities.

Vocational and general high school students enjoy equal opportunities

The revised Vocational Education Law of the People's Republic of China came into effect on May 1. This is the first major overhaul of the Act since its enactment in 1996.

The newly revised Vocational Education Law makes it clear that vocational education is a type of education that has the same important status as general education, and the State encourages the development of vocational education at various levels and forms, and vocational school students enjoy equal opportunities with ordinary school students at the same level in terms of further education, employment, and career development. Optimize the educational structure, scientifically allocate educational resources, and make overall plans to promote the coordinated development of vocational education and general education in different stages after compulsory education according to local conditions. Higher vocational school education is carried out by higher vocational schools and ordinary higher education schools at the level of college, undergraduate and above education.
