Order No. 163 of the Ministry of Public Security
The Ministry of Public Security issued the newly formulated Measures for the Administration of Scoring of Road Traffic Safety Violations (Order No. 163 of the Ministry of Public Security) to be formally implemented on April 1, 2022, and the 2022 edition of the Measures has adjusted the demerit points for traffic violations according to the degree of impact on road traffic safety and smoothness, compared with the "2016 version" of traffic violations and demerits, under the premise of maintaining the high-pressure situation of drunk driving, fleeing after traffic accidents, and using forged and altered license plates. The 2022 edition scored a total of 50 traffic violations, of which 7 were scored with 12 points, 7 by 9 points, 11 by 6 points, 15 by 3 points, and 10 by 1 point. The type of scoring has been increased by 9 points and the deduction of 2 points has been removed.
The deduction of points is reduced
1. Driving a motor vehicle that does not match the type of quasi-driving (12 points reduced to 9 points)
2. Driving a motor vehicle and not giving way to the school bus according to the regulations (6 points reduced to 3 points)
3. Driving a motor vehicle in violation of the prohibition sign or prohibition marking (3 points reduced to 1 point)
4. Old: Fleeing after causing a traffic accident, which does not yet constitute a crime (12 points)
NEW: Fleeing after causing more than minor injuries or deaths, not yet constituting a crime (12 points)
Escape after a traffic accident causing minor injuries or property damage is not yet a crime (6 points)
5. Old: The motor vehicle driving on the road does not hang the number plate of the motor vehicle, or deliberately obscures, defaces, or does not install the number plate of the motor vehicle according to the regulations (12 points)
NEW: Driving a motor vehicle on the road without hanging a motor vehicle number plate or deliberately obscuring or defacing the number plate of the motor vehicle (9 points)
Driving on the road with a motor vehicle that does not have a number plate installed as required (3 points)
6. Old: Motor vehicles on the road do not undergo regular safety technical inspections in accordance with regulations (3 points)
NEW: Driving on the road of a road passenger car, a tourist passenger car, or a dangerous goods transport vehicle that has not carried out regular safety technical inspections as required (3 points)
7. Driving a motor vehicle other than a highway passenger car, a tourist passenger car, or a dangerous goods transport vehicle that has not carried out regular safety technical inspections in accordance with the regulations (1 point)
The deduction increases
1. When driving a motor vehicle in front of the motor vehicle to stop in line or drive slowly, overtaking or occupying the opposite lane and interspersing the waiting vehicle (2 points to 3 points)
2. Driving a motor vehicle and obstructing safe driving, such as making or receiving a handheld phone (2 points to 3 points)
Changes to the Terms
1. Old: Driving a motor vehicle on the highway to reverse, retrograde, cross the central divider and make a U-turn (12 points)
NEW: Driving a motor vehicle to reverse on highways, urban expressways, retrograde, and U-turns across the central divider (12 mins)
2. Old: Driving medium-sized or above passenger and cargo vehicles, school buses, dangerous goods transport vehicles driving more than 20% of the prescribed speed on highways or urban expressways or driving more than 50% of the prescribed speed on roads other than highways and urban expressways, and driving other motor vehicles that exceed the prescribed speed of more than 50% per hour (12 minutes)
NEW: Driving school buses, medium-sized or above passenger and cargo vehicles, dangerous goods transport vehicles driving more than 20% of the prescribed speed on highways or urban expressways, or driving other motor vehicles on highways or urban expressways exceeding the prescribed speed of more than 50% per hour (12 minutes)
3. Old: Driving an operating bus (excluding buses), a school bus carrying more than 20% of the approved number of people, or driving another passenger car to carry more than 20% of the approved number of people (6 points)
New: Driving school buses, highway passenger cars, tourist passenger cars carrying more than 20% of the approved number of people, or driving more than 7 passenger cars carrying more than 20% of the approved number of people but not reaching 50%, or driving other passenger cars carrying more than 50% of the authorized number of people but not reaching 100% (6 points)
4. Old: Driving passenger cars other than buses (excluding buses) and school buses carrying more than 20% of the approved number of people (3 points)
NEW: Driving school buses, highway passenger cars, tourist passenger cars, passenger cars other than passenger cars with more than 7 seats carrying more than 20% of the authorized number of passengers but not reaching 50% (3 points)
5. Old: Driving a motor vehicle that does not overtake, give way, or drive in the opposite direction (3 points)
New: Driving a motor vehicle that does not overtake or give way according to regulations, or retrograde on a road other than a highway or urban expressway (3 points)
6. Old: Driving a two-wheeled motorcycle without wearing a safety helmet (2 points)
New: Driving a motorcycle without a safety helmet (1 point)
7. Old: When driving a motor vehicle on a highway or urban expressway, the driver does not wear a seat belt according to the regulations (2 points)
NEW: When driving a motor vehicle on the road, the driver of the motor vehicle does not wear a seat belt as required (1 point)
8. Old: Driving a motor vehicle that does not meet the regulations (1 point)
New: Driving a motor vehicle that does not meet the regulations, or does not reverse or turn around on roads other than highways and urban expressways (1 point)
Terms added
1. Accepting penalties and demerit points for traffic violations in place of actual motor vehicle drivers for economic gain (12 points)
2. Driving a motor vehicle to park illegally on a highway or urban expressway (9 points)
Terms Removed
1. Old: Under low visibility meteorological conditions, driving a motor vehicle on the highway is not driven according to regulations
2. Old: Using concealment or deception to obtain a motor vehicle driver's license
3. Old: Driving a motor vehicle that is prohibited from entering the highway into the highway
4. Old: Driving a motor vehicle through an intersection without driving or stopping according to regulations
