Provisions on the functional allocation, internal institutions and staffing of the National Bureau of Disease Control and Prevention

Article 1: These Provisions are formulated on the basis of the "Regulations on the Establishment of The Communist Party of China" and the relevant requirements of the Party Central Committee for disease prevention and control work, in order to standardize the functional allocation, internal organs, and staffing of the National Bureau of Disease Control and Prevention, and to promote the legalization of institutions, functions, powers, procedures, and responsibilities.

The National Bureau of Disease Control and Prevention is a state bureau managed by the National Health Commission and is at the deputy ministerial level.

Article 3: The main responsibilities, institutional settings, and staffing establishments determined in these Provisions are the basic basis for the national bureau of disease prevention and control's institutional duties and powers, staffing, and work operation.

Article 4: The State Bureau of Disease Control and Prevention implements the Party Central Committee's guidelines, policies, and decision-making arrangements on disease prevention and control work, and in the course of performing its duties, adheres to the Party's centralized and unified leadership over disease prevention and control work. The main responsibilities are:

(1) Organize the formulation of draft laws and regulations, policies, plans and standards for the prevention and control of infectious diseases and public health supervision, and be responsible for the construction of disease prevention and control networks and work systems.

(2) Lead the operational work of local disease prevention and control institutions at all levels, formulate supervision, inspection, assessment and evaluation methods, and organize their implementation. Review the monitoring and early warning and other planning plans and emergency response plans of the provincial disease prevention and control bureaus, guide the development of monitoring and early warning, immunization planning and isolation prevention and control and other related work, and establish a division of labor and coordination mechanism for upper and lower linkage.

(3) Formulate and organize the implementation of the national immunization program and interventions that seriously endanger the people's health and public health problems, be responsible for the supervision and management of vaccination, organize the formulation of quarantine and monitoring of infectious disease catalogues, and put forward suggestions for the adjustment of statutory infectious diseases.

(4) Comprehensively plan and supervise the management of disease prevention and control work in infectious disease medical institutions and other medical institutions, guide the establishment of a disease prevention and control supervisor system, formulate guidelines and policies for the construction of the disease prevention and control system team, and organize their implementation.

(5) Plan and guide the construction of an epidemic monitoring and early warning system for infectious diseases, organize and carry out epidemic monitoring and risk assessment work and release epidemic information, and establish and improve cross-departmental and cross-regional epidemic information notification and sharing mechanisms.

(6) Responsible for the work related to the response to the epidemic situation of infectious diseases, organize the work of epidemiological investigation, inspection and testing, emergency response, etc., formulate emergency plans and organize drills, guide the emergency system and capacity building of the disease prevention and control system, be responsible for the construction of emergency teams and volunteer teams, and put forward opinions on the demand and distribution of emergency materials for the epidemic response of infectious diseases.

(7) Coordinate and guide the construction of a scientific research system for disease prevention and control, formulate disease prevention and control science and technology development plans and related policies, and organize their implementation. Carry out international exchanges and cooperation in the field of disease prevention and control, and participate in the formulation of relevant international standards, norms and guidelines.

(8) Responsible for the prevention and treatment of infectious diseases, environmental sanitation, school hygiene, public place sanitation, drinking water sanitation supervision and management, occupational health, radiation hygiene supervision, organize the investigation and handling of major illegal acts in accordance with law, and improve the comprehensive health supervision system.

(9) Complete other tasks assigned by the Party Central Committee and the State Council.

(10) Functional transformation. The National Bureau of Disease Control and Prevention shall strengthen the operational leadership and work coordination of disease prevention and control institutions at all levels, establish and improve the disease prevention and control work system and network, and provide a strong guarantee for safeguarding people's health. Persist in moving the prevention threshold forward, improve multi-channel monitoring and early warning mechanisms, establish intelligent early warning multi-point trigger mechanisms, promote efficient coordination and seamless connection between public health services and medical services, improve mechanisms for major public health risk assessment, judgment, and decision-making, and improve the sensitivity and accuracy of assessment and monitoring. Optimize the allocation of resources, improve the operating mechanism, adhere to prevention and control according to law, implement the requirements of early detection, early reporting, early isolation, and early treatment, promote the construction of a grass-roots governance mechanism that dynamically links normalized management and emergency management, strengthen the scientific research support system, improve the decision-making consultation system, and achieve dynamic prevention and control, scientific prevention and control, and accurate prevention and control.

Article 5 The relevant duties and division of labor between the State Administration for Disease Control and Prevention and the General Administration of Customs shall be to compile a catalogue of infectious diseases for border health quarantine monitoring together with the General Administration of Customs; to establish and improve a mechanism for cooperation in responding to the epidemic situation of infectious diseases at ports, a mechanism for reporting and exchanging the epidemic situation of infectious diseases, and a mechanism for notification, transfer and coordination of imported epidemic situations at ports.

Article 6: The National Bureau of Disease Control and Prevention shall, in accordance with the main duties specified in Article 4 of these Provisions, compile a list of rights and responsibilities, clarifying the names of rights and responsibilities, the types of rights and responsibilities, the basis for setting them, the methods of performing responsibilities, and the circumstances of pursuing responsibilities. On this basis, it is necessary to formulate work guidelines, operation flow charts, etc., optimize administrative procedures, and standardize the operation of powers.

The National Bureau of Disease Control and Prevention has the following internal organs (at the level of deputy department and bureau):

(i) Integrated Division. Responsible for the daily operation of the organs, undertaking security, confidentiality, petitioning, government affairs openness and other work. Formulate measures for the supervision, inspection, assessment and evaluation of the operational work of local disease prevention and control institutions and organize their implementation. Undertake the dissemination of information on the epidemic situation of infectious diseases, and undertake scientific popularization, news publicity, health education and health promotion.

(ii) Planning Finance and Regulation Division. Organize the formulation of medium- and long-term plans for disease prevention and control, and undertake the construction of disease prevention and control systems and informatization. Responsible for the budget and final accounts, finance, asset management and internal audit of organs and directly subordinate units. Organize the drafting of laws, regulations, draft rules and standards, undertake the legality review of normative documents and administrative reconsideration, administrative response to lawsuits, and popularization of law.

(iii) Monitoring and Early Warning Division. Plan and guide the construction of the monitoring and early warning system and improve the network direct reporting system for the epidemic situation of infectious diseases, establish a mechanism for epidemic information notification and sharing, and guide medical institutions to implement the responsibility of reporting information on the epidemic situation of infectious diseases. Organize and carry out monitoring and risk assessment of the epidemic situation of infectious diseases, put forward early warning decisions and initiate emergency response suggestions. Review the provincial disease prevention and control bureau monitoring and early warning planning plan and guide the relevant work.

(4) Emergency Response Division. Undertake the work related to the emergency response of the epidemic situation of infectious diseases, organize the preparation of plans and carry out drills, undertake the construction of the emergency system, capacity and team, and put forward suggestions on the variety and quantity of relevant emergency material reserves, as well as the material demand and distribution opinions under emergency conditions. Review the emergency plan of the provincial disease prevention and control bureau and guide the relevant work.

(5) Department of Prevention and Control of Infectious Diseases. Formulate a catalogue of quarantine and monitoring infectious diseases, and put forward suggestions for the adjustment of statutory infectious diseases. Formulate and organize the implementation of public health interventions related to infectious diseases, and organize the evaluation of the effectiveness of prevention and control of infectious diseases. Manage medical institutions for infectious diseases and guide medical institutions to carry out disease prevention and control work.

(vi) Department of Health and Immunization Programmes. Develop national immunization programmes and organize their implementation. Organize the construction of vaccination service systems and their information systems, and organize the evaluation of the immunization effect of vaccines for the prevention and control of infectious diseases. Guide the prevention and control of parasitic and endemic diseases. Formulate and guide the implementation of policies for the management of environmental sanitation, school sanitation, public place sanitation, and drinking water sanitation. Develop preventive measures related to accidental injuries.

(7) Comprehensive Supervision Division I. Undertake the supervision of disease prevention and control in medical institutions, organize the supervision, inspection and assessment of disease prevention and control work in medical institutions, organize the investigation and handling of major illegal acts in the prevention and treatment of infectious diseases in accordance with law, and guide the establishment of a system of disease prevention and control supervisors.

(8) The Second Division of Comprehensive Supervision. Undertake public health supervision work, organize and guide local governments to carry out occupational health, radiation health, environmental sanitation, school health, public place sanitation, and drinking water sanitation supervision and inspection work, organize the investigation and handling of major violations of public health in accordance with law, and improve the comprehensive health supervision system.

(9) Department of Science, Technology, Education and International Cooperation (Hong Kong, Macao and Taiwan Office). Undertake the construction of disease prevention and control scientific research system, formulate disease prevention and control science and technology development plans and related policies and organize their implementation. Organize and carry out continuing education for public health-related professional and technical personnel, and coordinate to guide public health education within the scope of their duties. Carry out international exchanges and cooperation in the field of disease prevention and control, foreign publicity, and foreign aid, organize cross-border joint prevention and control of infectious diseases, and participate in the formulation of relevant international standards, norms, and guidelines. Carry out exchanges and cooperation with Hong Kong, Macao and Taiwan, and undertake the foreign affairs management of organs and directly subordinate units.

Party Committee of the organ (Personnel Department). It is responsible for party building and discipline inspection work in organs and units directly under Beijing, leading the work of organs and mass organizations, and undertaking internal inspection work. Formulate guidelines and policies for the construction of the cadre team and the talent team of the disease prevention and control system and organize their implementation. It is responsible for the personnel management, organizational establishment, education and training, and retired cadre work of organs and directly subordinate units. Party committees of organs have set up organ discipline inspection committees to undertake work related to discipline inspections of organs and units directly under Beijing and the building of party style and clean government.

Article 8: The administrative establishment of the Organs of the State Administration for Disease Control and Prevention is 170. There are 1 director, 4 deputy directors, and 32 directors and deputy directors (including 1 full-time deputy secretary of the party committee of the organ and 1 leading post of the discipline inspection committee of the organ).

Article 9: The establishment, duties, and establishment matters of public institutions affiliated to the State Bureau for Disease Control and Prevention are provided for separately.

Article 10: The Office of the Central Establishment Committee is responsible for the interpretation of these Provisions, and its adjustment is to be handled by the Office of the Central Establishment Committee in accordance with the prescribed procedures.

According to the authority of institutional establishment management, the institutional establishment matters decided by the party group of the National Bureau of Disease Control and Prevention and reported to the office of the Central Institutional Establishment Committee for the record shall be implemented in accordance with relevant provisions.

Article 11: These Provisions take effect on January 24, 2022.
