Tesla rights protection employees: the arbitration has been won, and the labor contract continues to be performed

Whipla Jiang, an employee who was "swept out" by Tesla, released the latest development of the incident: the arbitral award leila and Tesla continued to perform their labor contracts.

According to the Arbitration Statement, on December 3, 2021, the Respondent (Tesla) unilaterally and without reason notified to the Applicant (Leila) to leave his post, in fact, the employment contract was terminated in a disguised manner.

The evidence submitted by Leila shows that Leila was deprived of her labor rights without reason, the respondent was locked and did not provide a place of work, the applicant had a high degree of contribution and responsibility in the company, and there were no violations of discipline during the work, but he received double oppression from the leadership spirit.

The Arbitration Commission held that the right to labor is the right and obligation of citizens conferred by the Constitution, the term of the applicant's labor contract in this case has not yet expired, the labor contract stipulates the job position and the place of work, and now requires returning to work, which is in line with the law, and the Commission supports it.

"Justice is late. The trial process made me more determined, and I will continue to fight. Leila wrote.

Whiplaggers previously reported that in 2019, Leila joined the Shanghai Tesla HQ Delivery Center and was once tesla's "Shanghai Top 1 Delivery" and "National Delivery MVP". After Leila was reported by a colleague for "an order number error" in July last year, Tesla's leadership suspended him. After Leila refused to sign written warnings and investigation documents, she was rudely charged and robbed of mobile phones by her direct leaders Lu Mou and others, and was kicked out of all work groups.

In a communication with Tesla's legal department, Leila was reminded that after more than a month (February 19, 2022), her employment contract with the company will expire, and "the company will not renew it with you."

At that time, Leila said that she had applied for labor arbitration, and her first claim was not compensation but reinstatement.

Now, Leila has the outcome of the arbitration and is awaiting a response from Tesla.
