No one may commit cyberbullying such as insults against students

The Draft clearly stipulates that the administrative departments of education of provincial, municipal and county people's governments (hereinafter referred to as the administrative departments of education) are responsible for the organization, coordination, supervision and inspection of the prevention and control of bullying in schools within their respective administrative regions. Departments such as for public security, civil affairs, judicial administration, and human resources and social security, as well as people's courts and people's procuratorates, are to do a good job of work related to the prevention and control of bullying in schools in accordance with their respective duties. The Women's Federation and the Disabled Persons' Federation cooperate to do a good job in the prevention and control of bullying in schools.

No unit or individual may use the Internet to carry out cyberbullying such as insulting, defaming, threatening, or maliciously damaging the image of students in the form of text, pictures, audio or video, etc. No unit or individual must use the Internet or other means to spread or disseminate the specific circumstances of bullying incidents on campus, and must not disclose information such as students' names, residences, and photos.

Administrative departments for education shall make the prevention and control of bullying on campuses an important part of the assessment of school safety management work and the construction of civilized and safe campuses, and include it in the teaching plans for education such as ideological ethics, rule of law, mental health, and safety in schools, and include in the on-the-job training of relevant personnel of the administrative departments for education and school principals and teaching staff.

Schools shall carry out education and training on the prevention of bullying in schools, organize faculty and staff to learn relevant policies, measures and methods for the prevention and control of bullying in schools, and shall give the parents or other guardians of relevant students the necessary family education guidance according to the circumstances. Schools shall establish mechanisms for monitoring, assessing, early warning, and intervening students' mental health, appoint or hire mental health education teachers and counseling personnel, set up mental health counseling rooms, conduct mental health education for students, provide psychological counseling for students with behavioral deviations or psychological disorders, and prevent and promptly discover campus bullying caused by psychological or behavioral abnormalities.

Schools should set up and publish student help numbers and contact persons

Schools shall establish and complete working mechanisms for the prevention of bullying in schools, formulate emergency response plans, improve the workflow for the discovery and handling of bullying in schools, strictly investigate and promptly eliminate all kinds of hidden dangers that may lead to bullying by students, and establish mechanisms such as early warning, handling during the incident, and intervention after the fact. Schools shall periodically carry out special investigations on the prevention of bullying in schools for all students, assess whether there is bullying or other situations in the school, and promptly deal with problems of emerging nature and tendencies.

Schools shall establish and publish student help-seeking telephone numbers and contact persons, establish rights protection channels for students to seek help, such as teacher-student contact, mutual assistance among classmates, and emergency assistance, to support and guide bullied students to seek help from the school. School faculty and staff shall pay attention to students who may be in a weak or special position due to physical condition, family background, academic performance, etc., and where it is discovered that students are isolated or excluded, they shall promptly intervene. No unit or individual may instigate, coerce, or induce students to carry out bullying in schools, or provide conditions for students to carry out bullying in schools.

Guardians such as students' parents must not neglect to perform their guardianship duties

Students' parents or other guardians shall bear the main responsibility for implementing family education for students, cultivate a positive and healthy family culture, establish and inherit a good family style, and educate students to develop good thoughts, conduct, and habits with correct thoughts, methods, and behaviors. At the same time, guardianship duties shall also be performed in accordance with law, and where abnormal students' psychology or behavior is discovered, they should promptly understand the situation and carry out education, guidance, and admonition, and must not refuse or neglect to perform guardianship duties.

The "Draft" proposes to encourage and support social organizations, social workers, volunteers, and off-campus counselors to participate in the prevention and control of bullying in schools in accordance with the law, carry out family education guidance services, and carry out ideological and moral education, rule of law publicity, psychological counseling, family assistance and assistance for students.

School teachers and staff who discover that students have obvious emotional abnormalities, physical injuries, and other circumstances shall promptly communicate and understand the situation, and where there may be bullying situations, they shall promptly report to the school; where it is discovered that bullying is being carried out, they shall immediately stop and report to the school. Where students discover that bullying may exist or are being carried out, they shall promptly report it to the school. Upon receipt of the report, the school shall promptly take effective measures to protect the students who have been bullied.

Students' parents or other guardians must not instigate, connive, shield, or allow students to carry out bullying in schools.

For students whose bullying in schools is serious, or who have not been corrected after repeated education and punishment, the school may give disciplinary punishments of warnings, serious warnings, demerits, or probation. Disciplinary sanctions of expulsion from the school may also be imposed on students at the high school level.

Schools shall provide corresponding mental health counseling and support education for bullied students, reduce negative psychological impacts, and help them return to normal study and life; where physical or psychological harm caused by bullying, requests for class adjustment are submitted, the school shall support them after assessment deems necessary; for students who carry out bullying in schools, carry out targeted educational guidance and assistance to avoid discriminatory treatment.

Crimes committed in the prevention and control of bullying in schools will be held criminally responsible

The "Draft" makes it clear that staff members of education administration and other departments who abuse their powers, neglect their duties, engage in favoritism or commit other acts of dereliction of duty or dereliction of duty in the prevention and control of bullying in schools shall be punished in accordance with laws and regulations; where a crime is constituted, criminal responsibility shall be pursued in accordance with law.

Where a student's parents or other guardians instigate, connive, shield, or allow students to carry out bullying on campus, the public security organs are to give a reprimand in accordance with law; where conduct that constitutes a violation of the administration of public security, the public security organs are to give a public security administration punishment in accordance with law; where a crime is constituted, criminal responsibility is to be pursued in accordance with law. Where a student's parents or other guardians refuse to cooperate with or interfere with the school or relevant departments' investigation and handling of bullying on campus, constituting an act that violates the administration of public security, the public security organs are to give a public security administration punishment in accordance with law; where a crime is constituted, criminal responsibility is to be pursued in accordance with law.
