Recently, the Yueqing Municipal Court heard a dispute over the right to life, and the court rejected the litigation claims of the deceased's family.

"If I don't open the door, I'll report prostitution"

After Zhang broke up with her boyfriend Liu, he moved into a rental house on the 5th floor to live alone. On December 11 last year, shortly after the two broke up, Zhang's birthday arrived. In order to save his girlfriend, late that night, Liu found Zhang's residence, saw the door closed, and knocked on the door to shout.

Why did the man in the house fall?

After investigation, at about 23:20 that night, the man Chen Mou fell from Zhang Mou's rented house and died. When the police investigated the situation, Zhang said that on the day of the incident, Chen launched an invitation to her, and the two bought some wine and vegetables together to celebrate her birthday in the rental house. Later, the ex-boyfriend Liu Mou came to knock on the door, she did not open the door, and then she was drunk and unconscious. After she got a sobering injection in the hospital, she learned about Chen's fall from the building. After Chen's death, Zhang voluntarily compensated Chen's family for death compensation and funeral expenses totaling 30,000 yuan. But the anger of Chen's family did not subside, they filed a lawsuit with the Yueqing Municipal Court, believing that Liu mou loudly said that he wanted to call the 110 police that someone in the room was prostituting, which frightened Chen, and then fell to the building and died, demanding that Liu compensate for funeral expenses, death compensation and other expenses, according to 30% of the responsibility, a total of 450,000 yuan.

The court dismissed the petition of the deceased's family

The court held that there was no meeting or contact between Liu and Chen, and Liu claimed to call the police when knocking on the door without success. Under normal circumstances, the act of calling the police will only have a deterrent effect on the wrongdoing and will not pose a personal threat to the group engaged in the legitimate act, so there is no legal causal relationship between Liu's act of calling the police and Chen's act of falling from the building.

Even if Liu Mou lied to the police, it should be dealt with by the public security department according to law. As an adult with full capacity for civil conduct, Chen should be aware of the possible risks and consequences of falling from the height of five floors, and he did not take appropriate measures to deal with it, resulting in falling down the building and dying, and should be held responsible for the death result caused by his own behavior. In the end, the court rejected the litigation claim of Chen's family. At present, the judgment has entered into force.
