Powerbeats users collectively sued Apple

Apple is facing another lawsuit over powerbeats batteries. New York resident Alejandro Vivar has filed a potential class-action lawsuit alleging that Powerbeats Pro's design flaws prevented wireless earbuds from charging properly. It was reported that because it was too easy to lose contact between the earbuds and the charging case, one of the earbuds either could not be charged "continuously" or quickly drained of its power. The plaintiffs say Apple committed fraud by falsely reporting battery life and failing to address issues it should have known.

Vivar's lawyers believe that the combination of the shell design and the ear "washer" (the part that enters the ear) may be the reason. The lawsuit alleges that the customer had to insert a "wedge" to keep the charging pin in contact. Lawyers also rejected Apple's claim that the Powerbeats Pro is sweatproof and waterproof, arguing that sweat corrodes charging contacts.

The lawsuit seeks That Apple to "rectify" the situation, compensate the affected users, and pay unspecified damages. If the lawsuit is fully certified as a class action, it will cover users in New York as well as users in Georgia, Michigan, Montana, North Dakota, Oklahoma, Rhode Island, South Dakota, and Virginia.

We have asked Apple for advice. As with many such lawsuits, it is uncertain whether it will reach class action status or result in reparations. And, even if the case is successful, don't expect a windfall — with some exceptions, class actions often lead to small compensation. If anything, the lawsuit could be more about affecting design choices than the bank accounts of Powerbeats Pro buyers.
