Consumer Rights Protection Express| woman said that buying a second-hand fitness card was routine, Wells: refund is being made

Recently, Ms. Yu of Shanghai reported to the surging quality report complaint platform (https://tousu.thepaper.cn) that she saw someone posting information on the transfer of Wils fitness card on a second-hand trading platform at the beginning of this year, so she agreed to meet with her at the "Ruihong Tiandi Moon Bay" branch of the gym on January 8 to handle the card transfer procedures.

However, after Ms. Yu paid 1600 yuan in the store for the transfer card, she was told that the card was not a personal card, but a company card of the transferor's company. You will need to go to another Wells store on weekday afternoons to attend the company's team building activities at least twice a month, otherwise the card will be frozen. Helplessly, under the suggestion of the store manager, Ms. Yu made a supplement of 23288 yuan and upgraded it to a "ten-year card", planning to apply for a refund later. However, when Ms. Yu paid the money and checked the contract, she found that the gym contract stated in the supplementary clause at the end that the return of the card would be charged a 30% processing fee.

On January 11, The Paper contacted the store involved. The manager said that now the two sides have agreed on a refund, but it is not convenient to respond to more content.

On January 10, Ms. Yu signed a full refund agreement with Wells

Consumer Complaints:

Ms. Yu introduced that when she first found that someone posted information on the transfer of the Wells fitness card at a low price on a certain platform, because of the willingness to exercise, and saw that the card was valid until the end of November 2024, the remaining time was more appropriate, so she agreed with the seller that on January 8, the two would meet at The Wales (Rainbow Heaven and Earth Moon Bay Store) to handle the card transfer procedures.

Ms. Yu said that although the two contacted on the second-hand platform, they did not trade through this platform. After she went to the store with the seller that day, the seller left on the pretext, and her own expenses were handed over to the Wells company.

Ms. Yu told The Paper that she first spent 1,600 yuan on the transfer card according to the guidance of the store manager. This includes a handling fee of $980 and a fitness card fee of $620, of which $620 will be returned to the seller's account.

However, after the card transfer procedures were completed, Ms. Yu received a call from the seller, indicating that the card was a company card. She must go to the Matsue Jiuting store in Wils once every two weeks to participate in the team-building activities of the seller's company, and the time is fixed for Monday from 2 pm to 4 pm, otherwise the card will be frozen and unusable.

Ms. Yu could not accept this "additional condition". Subsequently, the manager of the store came forward to coordinate, and after communicating with the company's email, the manager suggested that Ms. Yu pay 23288 yuan to upgrade to a "ten-year card", and he could operate the merger of personal card and company card. After 3 months, I will ask him for a return card, and after deducting the usage fee of 207.4 yuan per month, Ms. Yu can get a refund of 24265.8 yuan.

In order to reduce the loss, Ms. Yu followed the manager's advice and paid more than 20,000 yuan. She said that she had paid the money before she saw the contract, and when she checked the terms, she accidentally found that the contract was noted in the supplementary clause at the end, and the return of the card would be charged a 30% processing fee.

Although the store manager repeatedly assured that there would be no handling fee for returning the card to him after 3 months, Ms. Yu chose to call the police on the evening of January 8 in order to avoid "another accident", after asking the store for an immediate refund and being rejected.

"Who knows if the manager will leave in 3 months, then the money can't be said what to do, go to the public security organ to report to the peace of mind." Ms. Yu told The Paper.

Processing results:

On January 11, 2022, The Paper contacted the store manager of Wells Fitness's "Rainbow Heaven and Earth Moon Bay" on this matter. The manager said that at present, the two sides have reached an agreement on refunds, but it is not convenient for him to respond specifically to the media.

On January 12, Ms. Yu told The Paper that she and Wells Fitness had signed a mediation agreement on January 10, and the consensus reached a consensus to refund all the 24,888 yuan she had handed over to the store. The store manager said that the refund amount will arrive within 15 to 30 working days.
