Parents divorced, neglect of supervision of children, so that 16-year-old teenagers drunk without a license to drive motorcycles and crash into people to cause tragedies. On January 4, the Jiangjin District People's Court of Chongqing Municipality (hereinafter referred to as the Jiangjin District People's Court) issued a "Order to Accept Family Education Guidance" against the parents of the children in this case. This is also the first guidance order issued by Chongqing after the official implementation of the Law of the People's Republic of China on the Promotion of Family Education.
On the morning of the 6th, the child's parents came to the Jiangjin court, and the judge reprimanded him for his dereliction of duty, and combined with years of family trial experience to guide his communication skills with the child, hoping that they would pay more attention to the child's growth and strengthen guardianship and education.
A 16-year-old drunk driver's tragedy
On the evening of January 22, 2021, Xiao Hao (pseudonym), who was only 16 years old, drunkenly drove a motorcycle without a license plate and carried a friend on the road, knocking an old man down. Soon after, the old man died after ineffective rescue.
After the case was tried by the Jiangjin Court, Xiao Hao was sentenced to nine months in prison, suspended for one year and six months, for committing the crime of causing a traffic accident. At present, after the consensus of the two sides, Xiao Hao's parents will pay the victim's family 200,000 yuan. Cases relating to compensation for medical expenses are still pending.

After reviewing the case file and visiting the investigation, the judge in charge found that Xiao Hao had been living with his father after his parents divorced. Later, his father re-established the family, and his mother took Xiao Hao's sister to work in other places. Both sides lacked care and education for Xiao Hao.
As parents, neither of them actively performed their guardianship duties, did not give their children enough family education, and allowed Xiao Hao to go astray step by step, which was really an educational dereliction of duty. On January 4, 2022, the judge in charge of the case issued a "Order to Accept Family Education Guidance" to Xiao Hao's parents in accordance with the newly implemented Family Education Promotion Law of the People's Republic of China.
Parents are determined to grasp education
On the morning of January 6, Xiao Hao's parents came to the Jiangjin Court's family judge's studio according to the judge's notice.
In response to XiaoHao's parents' dereliction of duty, the judge reprimanded the two, and combined with years of family trial experience, analyzed the psychological needs of the juvenile group and the communication skills with the teenagers, and repeatedly instructed Xiaohao's parents to pay more attention to Xiaohao's growth and strengthen guardianship and education.
Like most "bear child" families, Xiao Hao's parents repented that they had too little communication with Xiao Hao due to the failure of their marriage, and Xiao Hao, who was in adolescence, "disobeyed", and took a laissez-faire attitude towards Xiao Hao's daily whereabouts, communication, and behavior. After this lesson, the two promised to pay attention to Xiao Hao's family education and pay attention to his physical and mental health in the future.
Judge reminds
The Law of the People's Republic of China on the Promotion of Family Education stipulates that the parents or other guardians of minors are responsible for carrying out family education. Where in the course of handling a case, the people's courts discover that minors have serious negative conduct or committed criminal conduct, or that minors' parents or other guardians have incorrectly carried out family education that infringe upon minors' lawful rights and interests, they are to give a reprimand to their parents or other guardians on the basis of the circumstances, and may order them to accept family education guidance.
"The family is the first classroom, and the parents are the first teachers." I hope that parents and other guardians will take this case as a warning, actively take the initiative to assume the main responsibility for their children's family education, and use correct thoughts, methods and behaviors to educate children to develop good thoughts, conduct and habits, be clear about what can and cannot be done, and keep the bottom line of the law.
